HomeMy WebLinkAbout20220376.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, JANUARY 24, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 24, 2022, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of January 10, 2022, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on January 10, 2022, as follows: 1) Probable Cause Hearing, PCSC21-0039 — Bennie Rodriguez. Commissioner Buck seconded the motion, which carried unanimously. PUBLIC INPUT: No public input was given. AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed:. Commissioner Freeman seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Commissioner Buck reported she is excited to be the coordinator for the Oil and Gas Energy Department, and stated at her first briefing with Jason Maxey., Director of the Oil and. Gas Energy Department, she was amazed by, how well Weld County does at prioritizing the environment and health of the citizens of Weld County. Commissioner Buck further mentioned she attended the Oil and Gas Working Group meeting in the southwest Weld County buildings. Commissioner Freeman reported he met with all six (6) of his department heads and everything is well. Commissioner Saine stated she joined a state legislation hearing last week pertaining to the Department Minutes, Monday, January 24, 2022 2022-037$ Page 1 BC0016 of Human Services. Commissioner Moreno stated he met with the Department of Public Works, and reported that David Springer with Fleet Services confirmed there was no fuel leak at the fuel site. Commissioner Moreno further mentioned that he attended the Downtown Business Authority (DBA) meeting, and one of the presenters was Allo Communications, who is planning on scheduling a meeting with the Board to introduce their business and what they contribute here in Weld County and to other states. Chair James stated everything is running smoothly with Finance, Treasurer, and Human Resources. He also reported there is a Lunch and Learn, today at Noon, and employees are encouraged to attend or join the Teams meeting. PROCLAMATIONS: 1) ROOSEVELT ROUGHRIDERS' DAY, CLASS 4A POMS TEAM STATE CHAMPIONSHIP - JANUARY 24, 2022: Chair James read the proclamation for the record. Each team member introduced themselves for the record. Jenny Frank, Head Coach, Nichole Anderson, Assistant Coach, and Chad Walker, Athletic Director for Roosevelt High School, thanked the school administration for their support, for the dedication of the students that train all year, and further noted that over half of the team are freshman and are excited to see where the talent goes in the coming years. Chloe Sauer, team captain, expressed her gratitude, and stated she is humbled and blessed to be a part of a team with a strong work ethic. She further thanked their coaches for their efforts and for the Board's recognition. Each Commissioner, in turn, gave their congratulated the team on thier leadership and for setting the bar high at their school but also for their competitors. Chair James commented on the leadership and positive impacts this team has made in Johnstown and Milliken, and encouraged the athletes to harness the feeling of success to carry them into the future. (Clerk's Note: The group gathered for a photo opportunity.) WARRANTS: 1) GENERAL WARRANTS - JANUARY 21, 2022: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Saine seconded the motion, and it carried unanimously. I 2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - JANUARY 21, 2022: Commissioner Moreno moved to approve the Greeley -Weld County Airport Authority Warrants, as printed. Commissioner Freeman seconded the motion, and upon a roll call vote, the motion passed four (4) to one (1), with Commissioner Saine opposed. NEW BUSINESS: 1) CONSIDER TEMPORARY CLOSURE OF CR 36.5 BETWEEN CRS 17 AND 38: Amy Mutchie, Department of Public Works, stated this closure is scheduled to begin January 24, 2022, and go through February 11, 2022, for a 60 -inch drainage culvert replacement. She explained the detour route is paved and local residents will continue to have full access. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner Saine and it carried unanimously. I PLANNING: 1) CONSIDER APPLICATION FOR SMALL BUSINESS INCENTIVE PROGRAM AND AUTHORIZE RELEASE OF ECONOMIC DEVELOPMENT TRUST FUNDS (TIER I) - REDEFINED PROPERTIES, LLC, DBA REDEFINED EQUESTRIAN, LLC: Tom Parko, Director of the Department of Planning Services, explained Redefined Properties, LLC, dba Redefined Equestrian, LLC, engages in horse training and boarding, and meets all criteria for Tier I. Mr. Parko requested the release of $4,291.51 from the Economic Development Trust Fund. Commissioner Saine moved to approve said application and release of funds. The motion was seconded by Commissioner Moreno and it carried unanimously. Minutes, Monday, January 24, 2022 2022-0376 Page 2 BC0016 2) CONSIDER PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RECX16-0016 FOR REMOVAL OF LOT B - PARC CORNICHE, LLC, C/O AARON EVERITT: Diana Aungst, Department of Planning Services, stated staff received a letter dated December 29, 2021, requesting the partial vacation of RECX1 6-00016 for the removal of Lot B, being the largest lot, and further stated there are no easements affected by this request and "gave a brief overview of the property location. Ms. Aungst stated the remaining parcel is larger than 35 acres, and Lot A is owned by Richard and Carmen Strait, which is not a part of this consideration. Ms. Aungst also confirmed Lots A and B have separate access points. Shana Morgan, Blue Star Capital Advisors, representative of property owner, was present for questions. No public testimony was offered concerning this matter. Commissioner Freeman moved to approve said partial vacation. The motion was seconded by Commissioner Saine and it carried unanimously. 3) CONSIDER PARTIAL VACATION OF FOUR -LOT RECORDED EXEMPTION, RECX20-0065 FOR REMOVAL OF LOT D — LEGACY FARMS, LLC: Ms. Aungst stated staff received a letter dated December 26, 2021, requesting the partial vacation of Lot D, being the largest lot, and further stated there are no easements affected by this request, and gave a brief overview of the property location. Ms. Aungst stated the resulting parcel will be larger than 35 acres, and Lots A and C are also owned by Legacy Farms, LLC, Lot B is owned by Ms. Morgan, and those lots, are not a part of this consideration. Ms. Morgan, was, present for questions. No public testimony was offered concerning this matter. Commissioner Saine moved to approve said partial vacation. The motion was seconded by Commissioner Freeman and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
