RESOLUTION
WHEREAS, it has been determined by the Board of County Commissioners,
Weld County, Colorado, that a proposed sale of a tract of land more particularly
described as follows, to-wits
A parcel of land lying in the Wz of Section 9, Township 7
North, Range 67 West of the 6th P.M. , Weld County, Colorado,
described as follows: Beginning at a point whence the West
corner, marked by a steel pin 3 feet West of the county
road, bears S71°05'52"W 471.47 feet; thence S00°02'25" W a
distance of 180.00 feet; thence S89°57'35" E a distance of
249.78 feet; thence N00°02'25" E a distance of 180.00 feet;
thence N89°57'35"W a distance of 249.78 feet, more or less,
to the point of beginning.
Also an easement for roadway utility purposes over, under and
across the South 20 feet of the NW-k West of the above described
tract of Section 9, Township 7 North, Range 67 West of the 6th
P.M. , Weld County, Colorado,
to the Public Service Company of Colorado for the purpose of a communication
site does not come within the purview of the definitions of the terms "Subdivision"
and 'bubdivided land" as set forth inCRS 106-2-33, (3) (a) and (b) 1969, as amended
and,
WHEREAS, the Board of County Commissioners of Weld County, Colorado,
desires to exempt this particular division of land for the aforesaid reasons
pursuant to its authority under CRS 106-2-33 (d) , 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the proposed sale and development
of the hereinabove described tract of land to the Public Service Company of
Colorado for the sole purpose of a communication site be exempted from the definition
of the terms "Subdivision" and "subdivided land" as provided for in the new Weld
County Subdivision Regulations at Section 2-1, A., (3) , adopted August 30, 1972.
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote on the 11th day of April, 1973.

The above described tract is to be used as a communication
site by Public Service Company to allow quality communications with
the mobile service trucks in the northern area and also to inter-
connect the office and plant facilities of this area with the total
system.
The proposed facility will not require water or sewer ser-
vice and will not create a traffic problem as it will be unmanned
except for periodic maintenance.

Reasons for requesting exemption Public Service Company Of Colorado needs a
small parcel of land for a communication facility which will be unmanned and
