HomeMy WebLinkAbout20223260.tiffWELD COUNTY EMERGENCY CODE ORDINANCE 2022-10 IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD COUNTY CODE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF WELD, STATE OF COLORADO: WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld County Code Ordinance 2000-1, enacting a comprehensive Code for the County of Weld, including the codification of all previously adopted ordinances of a general and permanent nature enacted on or before said date of adoption, and WHEREAS, the Weld County Code is in need of emergency revision and clarification with regard to the purchase of new vehicles which are deemed necessary for the protection of life, health, and/or safety ("New LHS Vehicles"), because of supply -chain deficiencies being experienced by vehicle manufacturers, and WHEREAS, New LHS Vehicles include, without limitation, Weld County Sheriff's Office vehicles, vehicles used by Public Works to access parts of the County in all kinds of weather and in places normal road vehicles do not go, and vehicles used by the Coroner's Office for transports and investigations, and WHEREAS, because such non -availability of New LHS Vehicles creates an emergency lack of reliable vehicles in the departments listed above, this Ordinance is declared to be an Emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the County of Weld, State of Colorado, that certain existing Chapters of the Weld County Code be, and hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to read as follows. Expenditures not requiring a procurement process. A. It has been determined that it is in the best interests of the County to exempt certain purchases of goods or services from the requirements of this code. The following is a list of the expenses which will be processed for payment in the Department of Accounting without a requisition and purchase order: 1. thru 26. — No change. 27. Emergency purchases when: a. thru c. — No change. d. Purchases of new vehicles deemed necessary for the protection of life, health, and/or safety during supply chain deficiencies to ensure availability at the most efficient price. The Board of County Commissioners shall by resolution detail procedure and protocol for such emergency purchases of new vehicles that establishes a sunset date which may be extended by subsequent resolution of the Board. Remainder of Section — No change. BE IT FURTHER ORDAINED by the Board that an emergency exists, because such non - availability of New LHS Vehicles creates a lack of reliable vehicles in the departments listed above; therefore, this Ordinance is declared to be an Emergency Ordinance under the provisions of Section 3-14 of the Weld County Home Rule Charter. BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is, directed to arrange for Municode to supplement the Weld County Code with the amendments contained herein, to coincide with chapters, articles, divisions, sections, and subsections as they currently exist within said Code; and to resolve any inconsistencies regarding capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and subsections in said Code. BE IT FURTHER ORDAINED by the Board, if any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such decision shall not affect the validity of the remaining portions hereof. The Board of County Commissioners hereby declares that it would have enacted this Ordinance in each and every section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be declared to be unconstitutional or invalid.
