The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Ste Specific Development Plan and Use by Special Review Permit for uses similar to
a research laboratory (rocket testing facility) in the A (Agricultural) Zone District..
This project is north of CR 78 and is west of CR 71.
Parcel number: 071308400005, 071308000004, 071308100001, 071308100002, 071308200003,
071308200004.
Access is via unmaintained CR 63 onto CR 78.
ACCESS
Development Review has reviewed the application materials related to access.
The applicant has proposed using unmaintained County Road 63 petition (60 feet)/resolution (30 feet) right-
of-way to access County Road 78. The applicant shall obtain an access permit for this location.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access location with Development Review prior to laying out your
site plan. All "preliminarily approved" accesses are subject to change during the access permitting process.
Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road.
Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8
of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
The proposed parcel uses unmaintained County Road 63 right-of-way to access maintained County Road
78 approximately 1,500 feet west of the intersection of CR 78 and CR 65. The submitted plat shall show
any unmaintained rights -of -way or private easements used to access the site from the maintained County
Road, from the lots to and including the maintained County Road access point. The physical location of the
road within the right-of-way or easement shall be shown on the plat. Reception numbers shall be referenced
for right-of-way or easement documents. Please contact Development Review with questions.
This portion of CR 78 is a gravel road and is designated on the Weld County Functional Classification Map
(Code Ordnance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the
required setback is measured from the future right-of-way line. Be aware that physical roadways may not
be centered in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No recent traffic information is available for this portion of CR 78.
Traffic information submitted with the application materials indicates that initially there will be 44 roundtrips
per day of passenger vehicles and delivery trucks. At full build -out, there will be 166 roundtrips of passenger
vehicles and delivery trucks. The report indicates that all traffic would travel west of CR 78 to CR 59.
No additional traffic information is needed.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Development Review for review and consideration.
This site requires double cattle guards and 100 ft. of road base or road base on all driving surfaces.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Development Review is requesting an Improvements and Road Maintenance Agreement for dust control,
damage repairs to specified haul routes, and triggered off -site improvements. This could include but not be
limited to paving the segment of CR 78 between the site access and CR 59.
Improvements/Road Maintenance Agreement: An example agreement is available at:

It will detail the approved haul route(s), outline when off -site improvements will be triggered, and include a
maintenance agreement for the haul routes.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
Detention pond waived and a simple drainage narrative
The applicant has submitted a drainage narrative stating that the site meets drainage exception 11. An
individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency
Management Administration (FEMA) regulatory floodplain channel and the project. Located in Sec. 8-11-
40. Drainage Policy.
The applicant shall amend the narrative to include a site plan that shows any piping, ditching, grading,
and/or other means used to ensure that all stormwater flows to the floodway.
A Final Drainage Narrative is required.
Historic Flows
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL
A. A Final Drainage Narrative is required. (Development Review)
B. An Improvements and Road Maintenance Agreement is required for triggered off -site improvements
at this location. Road maintenance includes, but is not limited to, dust control and damage repair to
specified haul routes. The Agreement shall include provisions addressing engineering requirements,
submission of collateral, and testing and approval of completed improvements. (Development
Review)
C. The plan shall be amended to delineate the following:
1. County Road 63 Section Line is shown to have 60 feet of unmaintained section line/petition right-
of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing right-
of-way on the site plan. Show and label the section line Right -of -Way as "CR 63 Section
Line/Petition Right -Of -Way, not County maintained." All setbacks shall be measured from the edge
of right-of-way. (Development Review)
2. CR 78 is a gravel road and is designated on the Weld County Functional Classification Map as an

3. Show and label the approved access location, approved access width, and the appropriate
turning radii on the site plan. The applicant must obtain an access permit in the approved location
prior to construction. (Development Review)
4. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Development Review)
5. Show and label the approved tracking control on the site plan. (Development Review)
6. Show and label the accepted drainage features (e.g. constructed ditches and swales). Show and
label the drainage flow arrows. (Development Review)
7. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Development Review)
Prior to Construction
A. The approved access point shall be permitted, and the tracking control shall be constructed prior to any
on -site construction. (Development Review)
B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. Access will be along unmaintained County right-of-way and maintenance of the right-of-way will not be
the responsibility of Weld County. ((Development Review)
4. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

5. The Property Owner shall comply with all requirements provided in the executed Improvements

6. The Improvements Agreement for this site may be reviewed on an annual basis, including a site visit

7. Prior to the release of building permits, the applicant shall be required to submit a complete access
application for the "preliminarily approved" access location as shown on this plan. (Development

Environmental Health Services has reviewed this Site -Specific Development Plan and Use by
Special Review Permit for uses similar to a research laboratory (rocket testing facility) in the A
(Agricultural) Zone District.
The property is currently vacant and will consist of approximately 400 acres when all parcels
are combined. The proposed facility will include four 9,450 sq. ft. warehouse/office buildings,
one 9,600 sq. ft. equipment storage building, two chemical/fuel bulk storage locations, and up
to nine 40,000 sq. ft. rocket engine test sites each containing a 1,200 sq. ft. test building. The
application states the rocket test facilities comply with all local, state, and federal
requirements including the Department of Defense and NASA requirements for rocket engine
testing.
There is an existing livestock well (153242-A) that will be repermitted to commercial if this
request is approved. The Division of Water Resources indicated in their referral dated May
27, 2022, "the USR should not be approved for more than 50 employees unless the applicant
can provide information regarding how the water needs of additional employees can legally
be met."
On -site wastewater treatment systems (OWTS) will provide sewer. Each OWTS will serve
two buildings and must comply with "Site Application Policy 6: Multiple On -Site Wastewater
Treatment Systems" as required by the Water Quality Control Division of the Colorado
Department of Public Health and Environment . An injection well class V permit from the EPA
is required for systems that serve 20 or more people. Colorado Department of Public Health
Environment approval is required if the systems will serve over 2,000 gallons per day.

An air emission permit from the State is required. The bulk tank storage site will contain the
fuel for the rocket engine testing site and the fuel is transported via an internal pipeline. Fuel
tanks will require permitting through the State and shall include secondary containment as
required.
On -site dust will be contained by an internal speed limit under 20 MPH and magnesium
chloride will be utilized as needed.
The application indicates no hazardous waste will be generated. Dumpsters will be provided
for typical office waste and will be emptied on a weekly basis.
Noise is generally restricted to the industrial limit and a noise study was submitted. The study
indicates: "The engine testing will be done in a test control building, approximately 1,200 ft2,
situated on a concrete pad in the center of the test site and directed towards the uphill side of
the slopes. The test stands will be situated within the buildings so the engine exhaust cone
(noise source) is just inside the uphill face of the building firing through a 16 ft wide door. On
average one test stand can perform 5 tests per twelve-hour workday. Each test takes
anywhere from 5 seconds to 5 minutes to conduct with several hours needed for test
preparation and breakdown. Each test site will be continuously operating during business
hours for a total of 20-30 minutes of actual rocket engine firing per site. Testing is only
performed Monday through Friday, 8 am to 6 pm, with some Saturday operations. Passive
sound suppression includes berms, utilizing natural topography, and other sound deflection
and attenuation structures. Passive sound suppression often provides a more effective
means of sound attenuation and knock -down compared to active methods. At the nearest
neighbor, the sound level is likely to be much lower and equivalent to a car passing on a
nearby road."
The application indicates "Using conservative estimates for the effect of passive sound
mitigation, the expected levels will be 90-100 dBA within 1,000 feet of the north, east, and
south property lines of the subject property." The applicants are requesting to exceed the
noise level during rocket testing.

We recommend the following requirements are incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the Solid
Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the
Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the property should
comply with the Colorado Air Quality Commission's air quality regulations.
5. The facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in 25-12-103 C.R.S. except during rocket engine testing when the limit
shall be 100 dBA 1,000 feet from property lines.
6. Any On -site Wastewater Treatment Systems located on the property must comply with all
provisions of the Weld County Code, pertaining to On -site Wastewater Treatment
Systems.
7. If an On -site Wastewater Treatment System serves twenty or more full time employees,
the facility shall submit an Underground Injection Control (UIC) Class V Injection Well
permit to the Environmental Protection Agency (EPA).
8. For employees or patrons on site for less than 2 consecutive hours a day, and 2 or less
full-time employees on site, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained on a quarterly basis
and available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County,
contain hand sanitizers and be screened from existing adjacent residential properties and

public rights -of -way.
9. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.
The well permitted as 153242-A cannot be used unless it is repermitted for commercial
use.
10. In the event the facility's water system serves more than 25 persons on a daily basis the
water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR
1003-1). If not subject to these requirements, the Weld County Department of Public
Health and Environment strongly encourages well users to test their drinking water prior to
consumption and periodically thereafter.
11.The facility shall comply with all provisions of the State Underground and Above Ground
Storage Tank Regulations.
12.All chemicals must be handled in a safe manner in accordance with product labeling and
in a manner that minimizes the release of hazardous air pollutants (HAPs) and volatile
organic compounds (VOCs). All chemicals must be stored securely, on an impervious
surface, and in accordance with manufacturers' recommendations.
13.The operation shall comply with the Colorado Department of Labor & Employment,
Division of Oil and Public Safety Explosive Regulations (7 C.C.R. 1101-9).
14.The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit
requirements as stipulated by the Air Pollution Control Division, Colorado Department of
Public Health and Environment.
15.A Colorado Discharge Permit System (CDPS) from the Colorado Department of Public
Health and Environment (CDPH&E), Water Quality Control Division, shall be obtained as
applicable.
16.The facility shall notify the County of any revocation and/or suspension of any State issued
permit.
17.The operation shall comply with all applicable rules and regulations of State and Federal
agencies and the Weld County Code.

Hi Michael, after a quick review of the application OEM is requesting an EAP for this site in coordination with the Fire
District. One item that Chief Kane brought up is the planned development of a drilling site in the same area. I want to
make sure the applicate irate is aware of the EPA EPCRA, RA, Clean Air Act and Toxic Release Inventory programs and the
reporting requirements. I've also attached the template for the EAP to this email.

Weld County Facility EAP Template
The EAP is designed to assist local agencies with critical information that may aid first responders and company
personnel during an emergency. Local agencies may include but are not limited to, fire department(s), emergency
medical se rvice(s) (EMS), law enforcement agencies (LE), and City or County Office of Emergency Management
(OEM). State and Federal agencies consisting ofColorado Department of Public Health and Environment (CDPHE),
and the Environmental Protection Agency (EPA), may also reference the EAP.
The intent of the Facility EAP is for emergency planning between Local agencies and facilities. If applicable, all
fire code requirements shall be coordinated with the fire district having jurisdiction, As the final approval
signatory, Weld OEM will not delay signing an EAP due to fire code related issues or concerns. Weld County
encourages facility operators to work with the local fire districts to ensure they are meeting their adopted fire
codes and if applicable, their local jurisdictions permitting requirements.

SECTION 6 - SPILL RESPONSE AND CLEAN-UP
a) Spill Response

Once a release has been discovered, it will be immediately stopped and contained
if possible and if safe to do so. When containing a spill; a combination of sorbent rolls, pads, mats, socks, or
containment boom may be deployed, or earthen berms will be constructed around the release to keep spilled
material contained and from spreading. These materials will be provided by ABC Company and the contract
company and kept on -site. During a spill, efforts will be made to minimize contact with live vegetation, nearby
drainage, rivers, creeks, or streams. If the release is outside of secondary containment or poses a threat to
flow off site, or impact environmentally sensitive areas, the spill response contractor should be notified for
cleanup assistance, if needed, and for removal and disposal of spilled materials and contaminated areas.
In the event of a large incident requiring outside assistance/cascading resources, ABC Company has contracted
with a Consulting Spill Management Team (SMT) Company XYZ. Consulting SMT Company XYZ possesses a
working knowledge of ABC Company operations, emergency response and the Incident Command System (ICS).

The person reporting a spill may be required to supply the minimum spill assessment
information to provide a complete understanding of the incident as possible to local, state, or federal agencies if
applicable. Some initial spill response actions and information that may be reported are presented below:
• A spill/release will be reported to the Weld County LEPC if released material is property of
and meets the reporting thresholds mandated by Section 304 of the Emergency Planning and Community
Right -To -Know Act (EPCRA).
• A spill/release will be reported to the CDPHE if released material is in the custody of a third party for spills
meeting CDPHE reporting thresholds or are of any size that impact or threaten to impact waters of the
state, a residence or occupied structure, livestock or public byway. An example would be an oil hauler
over filling a truck and spills product onto the ground next to a flowing irrigation ditch.

• Once a spill is determined reportable, there is a 24 -hour deadline to make
initial notification to the LEPC and CDPHE depending on the product ownership. Spills/releases in the

SECTION 7 - REPORTABLE QUANTITIES
a) Reportable Quantities

Mandated by Section 312 of the Emergency Planning and Community Right -To -Know
Act (EPCRA) — also known as SARA Title III —the Tier II form captures information about the types, quantities, and
locations of hazardous chemicals at a given facility. The form also lists contact information for the facility's
designated emergency point -of -contact.
• Any facility that is required to maintain MSDSs (or SDSs) under the Occupational Safety and Health
Administration (OSHA) 49 CFR 1910.1200 regulations for hazardous chemicals stored or used in the
workplace.
• Facilities with chemicals in quantities that equal or exceed the lists of lists thresholds must report.
• Propane, benzene, propane and methane are on the lists of lists and are known to be in crude oil. In
addition, diesel is on the lists of lists and may be stored on oil and gas sites during construction and
development.
b. Reportable Requirements
Instructions: If your facility will meet the requirements under 40 CFR Part 370, you must submit your Tier II report
to the State of Colorado every year before March 1st.

SECTION 8- EVACUATION INFORMATION
Evacuation Plan Procedures (public)
The procedure to be used in alerting the public in the event of than incident which could
pose a threat to life or property will be arranged and coordinated with first responders and Weld County Emergency
Management.

In the event of an actual emergency, the following steps will be immediately taken:
1. The ABC Company representative will immediately notify first responders (911), to warn the public of a potential
chemical exposure.
First responders may conduct door to door evacuation notices in addition to reverse 911 and utilizing the
Integrated Public Alert and Warning System (IPAWS).
3. The ABC Company responsible for employees and contract personnel will monitor essential and non -essential
personnel traffic on or near the incident site.
4. General:
a. The area included within the radius of exposure is considered to be the zone with the maximum potential
hazard, per the Emergency Response Guide (ERG). When it is determined that conditions exist which
create an additional area (beyond the initial zone of maximum potential hazard) vulnerable to possible
hazard, public areas in the additional hazardous area will be evacuated.
b. In the event of a incident, after the public areas have been evacuated and traffic stopped, it is expected
that local civil authorities will have arrived and within a few hours will have assumed direction of and
control of the public, including all public areas.

The National Incident Management System (NIMS) guides all levels of
government, nongovernmental organizations and the private sector to work together to prevent, protect against,
mitigate, respond to and recover from incidents.
NIMS provides stakeholders across the whole community with the shared vocabulary, systems and processes to
successfully deliver the capabilities described in the National Preparedness System. NIMS defines operational systems
that guide how personnel work together during incidents.
ABC Company
plays a vital role in the Incident Management System. ABC Company has a significant impact on local,
regional, and national economic recovery, and is part of the whole community and essential to the function of the
Community Lifelines.
To maximize ABC Company's impact and willingness to participate in incident operations, ABC Company should
coordinate and integrate with first responders into a Unified Command (UC) including planning; training, and
preparedness exercises. In addition, it is also recommended all ABC Company employees who will respond to an incident
have training in ICS 100, ICS 200, and ICS 700 at a minimum, for company and agency emergency response
interoperability to manage a response.
EXERCISES: (Edit as needed, EXAMPLE) Exercises are an important component to test an organization's response
readiness, training and familiarity with various emergency response scenarios, participation and engagement with local
and or state agencies, and to develop lessons learned to improve emergency response capabilities. Per COGCC guidance
number 16, a proposed schedule and type of exercises are provided below:

Good Morning Michael,
The District has reviewed the above referenced project application and narrative. Further, we have qualified this review
with research of the existing site in Berthoud and found a good operating history. The District is generally amenable to
this development with the following concerns:
1. Fire Flow -It is understood that there is inherent fire suppression built into the design of the test units with
Nitrogen. Office/Warehouse & Equipment units may however require in excess of 3000 Gallons per Minute (NFA
Formula). These units will be occupied with up to 20 employees during business hours. Our rural community
bases it's ISOPublic Protection Classification of 3 on a hauled water equation from it's 46 hydrants spread over
155 square miles. The nearest hydrant is approximately 5 miles. The proposed facility is beyond 5 driving miles
(7.5 & 11 respectively from our stations). As such/ we encourage applicants to consider alternatives such as on
site hauled water storage, fire suppression systems, and fire resistive construction techniques in lieu of public
water supply.
2. Hazardous Materials- Maximum Quantity On Site -There is significant discussion regarding hazardous materials
transport, use, and storage on site. However, there is not sufficient data (max volume/weight) to determine if
the facility has exceeded Threshold Planning Quantities for various regulations that require emergency action
planning. In any case, each phase will require on -site training with the District.
3. Emergency Action Planning -Basic emergency action planning will be coordinated with the District and Weld
Office of Emergency Management.
4. Travel Routes -The district concurs with Weld o E M and the project narrative that the privately maintained
section of CR 63 will require maintenance to support all weather ruse. This CR as well as site access roads must
be designed and maintained to support the imposed loads of fire apparatus (i.e. 75,000 lbs.) and must have a
surface that provides all-weather driving capabilities. Planned activities by energy companies in the area may
prove complimentary.
5. Security -The site will only have a barbed wire stock fence around it due to its remote location. The rural
experience nationally with remote sites is that they have become targets for theft of recycfables, technical
equipment, and chemicals with potential hazardous materials releases and fires. The applicants should consider
physical and technical security plans to anticipate and prevent such events.
6. Pipe Rack Clearances -It is not clear if pipe racks supplying testing gasses and fuels will be under or above
ground. If it is the latter where the racks intersect the road the vertical clearance will be a minimum of 14' and
the width of the road
7. Conflicting Surface Uses- The District has recently reviewed and supported a comprehensive drilling plan by
mineral rights owners that may involve these parcels. While your proposal is compatible with these activities,
spatial conflicts may be anticipated requiring coordination between the two entities.

Wildfire -The proposed improvements will provide, access/egress, anchors and safety zones for fighting wildland
fires on the adjacent open range and drainage.
In summary, the District does not find the proposal with the address of considerations listed above, incompatible with
existing uses, population density, and life safety. Should you have further questions, please advise.

As the Community Planner at F.E. Warren AFB, I appreciate the opportunity to review case L R -001S. The project
proposed by Ursa Major Technologies, Inc. (UMT) is further west of two nautical miles from missile sites N-07, N -OS, and
N-09 (see attached) so we do not have many concerns with the proposal. If any structures (e.g. cell phone repeater) are
planned to exceed 199 vertical feet we would ask that the tower be lit with an approved FAA light that is visible under
night vision goggles. I did not see anything in the proposal mentioning anything about the potential for smoke or steam
being released from any of the proposed buildings. Due to the Air Force Helicopters utilizing visual flight rules (VER); if
there is the potential for smoke or steam impeding sight distance please notify the base so the helicopter squadron can
be informed.

We have reviewed the above referenced application for a Site Specific Development Plan and
Use by Special Review Permit. The submitted material does not qualify as a "subdivision" as defined
in section 30-28-101(10) (a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and
March 11, 2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide comments regarding the proposed water supply. The
comments will not state an opinion on the adequacy of the water supply or the ability of the water
supply plan to satisfy any county regulations or requirements, and cannot be used to guarantee the

acres located northeast of Galeton, Colorado. The site is currently dryland pasture. The facility will
include four warehouse /office buildings, an equipment storage and maintenance building, two fuel
bulk storage sites, and up to nine rocket engine test sites, each with a test building. The facility will
initially operate with approximately 20 full-time employees generally working during normal business
hours five days a week. Over the next ten years, it is expected that the facility will have up to 75
full-time employees. The site will not be open to the public, but may be visited by organized tour
groups on occasion.
Potable water is proposed to be supplied by an existing well constructed under well permit
no. 153242-A. Permit no. 153242-A was issued for the use of the well for livestock watering
purposes. This office does not have an abandonment report on file for the original well on the
property registered under permit no.. 153242. If the well no longer exists, the property owners
should submit a Well Abandonment Report (GWS-09), available at https://dwr.state.co.usieforms, to
document that the old well was plugged and abandoned.
The applicant proposes to convert the well constructed under permit no. 153242-A to
commercial use upon approval of this U'SR. It is anticipated that a new permit could be issued for
the use of the existing well for indoor drinking and sanitary purposes inside a commercial business
with a maximum annual withdrawal of % acre-foot (108,600 gallons). The well would be required to
be equipped with a totalizing flow meter, recorded by the well owner at least annually.

Water from the well is anticipated to be primarily used for restrooms, with bottled water
and/or water coolers provided to employees for drinking water. Water is not proposed to be used for
dust control purposes at the site, instead magnesium chloride will periodically be applied to reduce
dust on internal roads.
Daily water use for restrooms ranges from 8-12 gallons per person per day, depending on
whether or not water -efficient fixtures are used. Assuming that the facility will operate 260 days per
year, water requirements for 20 employees would be between 0.13 acre-feet and 0.19 acre-feet per
year, within the limit for a commercial exempt well. However, water requirements for 75 employees
would total between 0.47 and 0.71 acre-feet per year, which would exceed the amount of water that
can legally be provided from an exempt commercial well. The USR should not be approved for more
than 50 employees unless the applicant can provide information regarding how the water needs of
additional employees can legally be met. This information may include data from the totalizing flow
meter required to be installed on the well.
The applicant has requested an exemption from stormwater detention requirements,
therefore no stormwater detention facilities are currently proposed. Sedimentation ponds are
proposed to be designed for all culvert outlets. All water collected by the sedimentation ponds must
be released to the stream system or have infiltrated into the ground within 72 hours, otherwise the
applicant will need to obtain a substitute water supply plan or plan for augmentation to make
replacements for evaporation.
