4-1• RESOLUTION WHEREAS, a public hearing was held on July 17, 1972 in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Farr Farms Company, Greeley, Colorado, requesting permission to locate a cattle feed lot operation on the following described property, to-wit: The Southwest Quarter (SW4) of Section Thirty-one (31), Township Six (6) North, Range Sixty-four (64) West of the Sixth P. M. and all that part of the Northwest Quarter (NW+) of Section Six (6), Township Five (5) North, Range Sixty-four (64) West of the 6th P. M. lying North of the • Ogilvy Irrigating Canal as the same is now located and used over and across said land, containing 240 acres, more or less, and WHEREAS, the petitioner was present and represented by counsel, and WHEREAS, there was no one present in opposition to the request of petitioner for the location of said cattle feed lot operation, and WHEREAS, the said requested cattle feed lot operation is located in an agricultural zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County,. said cattle feed lot operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner, and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Farr Farms Company, Greeley, Colorado, for location of a cattle feed lot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect said cattle feed lot operation and that he shall have up to one year from date hereof to begin construction of same. 3. That when said cattle feed lot operation is completed, same shall not contain more than 35, 000 head at any one time. 4. That petitioner shall construct sealed retention ponds. 5. Subject to a greenbelt being established along the side of county roads, thus screening off such roads with a suitable type of vegetation. 5a. That a strip of land, as agreed upon, along the West side of such property be conveyed to Weld County for road purposes, thus assuring uniform widening of County Road No. 49 . All applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. REPORT : Mr. Lorenson distributed a report of the building activity and the income for the month of July . SUBJECT : New form Mr. Lorenson explained a new form being used for submittal of subdivision applications showing all necessary information has been submitted and dates for review by Utility Board and 797 r_ the Planning Commission are set. SUBJECT : Graphic displays DISCUSSION : Gary Fortner gave a progress report and outline of the study he is now working on . The current study is largely , concerned with developing tools to aid in the implementation of the Weld County policy in regard to agricultural land use , analysis of programs in other states aimed at protecting agricultural lands , analysis of land use policy in Weld County in reference to the policies of the State , dollection and analysis of Agricultural Census data for the County. Creation of a system of maps to be used in decisions on land use . SUBJECT : Regional Work Program assignments DISCUSSION.: Mr . Cruce stated the State Planning Office would like to create a planning staff on the regional level . They felt that one man from the Larimer office and one from the Weld county office rather than having several work on the scope of services required by HUD. Mr. Cruce stated that both counties have well developed planning staffs and felt the work program could be implemented by staff members of the two counties . Mr. Lorenson stated there will be four members of the staff performing doing regional planning functions . Dick Deyoe on drainage , Gary Fortner on soils , Jim Ohi updating the local plans from Weld County and Gary Eastman on the housing report. Meeting adjourned . The feedlot will require 40 acres of a 160 acre farm. There will be a total of 33 pens , 200 ' x 200 ' . There will be a. capacity of 10 ,000 head of cattle . They are pro- viding for cement slabs , underground sprinklers for dust control , underground tiling to the lagoon for run-off purposes . The lagoon will be located in the center of the pens and drainage will be from 4 directions . Mr . Dinner read a letter from Mr. Paul recom- mending approval of the project. A letter from the North Weld Water District was read stating they will furnish the necessary water. A letter from the Soil Conservation District was read regarding the soils information for this parcel stating there is little run-off and not subject to flooding . If a lagoon is heeded , the soils are suitable although a blanket of impervious material may be necessary. The lagoon is designed to provide whatever run-off needs that are determined necessary . Mr. Dinner stated this use is compatible with surrounding land use and zoning . He pointed out other existing feed- lots and dairies in the immediate area . Mr . Dinner presented the petition signed by surrounding property owners approving the pro- posed operation . Mr . Dinner called on the following farmers in area that will be selling corn for this feeding operation some of whom have been selling to Monforts which are moving to a new loc- ation : John Firestein , Wilburt Firestein , Conrad Firestein , Jack Boegel , Jerry Firestein and Bob Tigges . 799 Mr. Dinner stated the existing mill capacity will accomodate the proposed expansion . Mr . Lorenson stated the present Greeley Comprehensive Plan shows the area as agricultural . They pro- pose residential on the south side of the river up to the flood plain , however this may be a problem because of the odor problems . A letter from the City Planning Commission recommend- ing denial . Mr. Carl Leffler spoke in opposition to the expan- sion . MOTION : By Mr. Watson to take the matter under advisement. Webster and Jim Witmore DISCUSSION : Mr. Webster presented the plans of the proposed expansion . The present operation has a capacity of approximately 13 ,000 head . The proposed lots will have a capacity of 7500 head of cattle . The green belt will be continued along highway 263 for 200 ' . The holding ponds have been approved by the Colorado State Water Pollution Control . Mr. Webster read a list of property owners in the area approving the feeding operation . Mr . Lorenson read the recommendations of the Planning staff that stated it is re- commended for approval , the land use is compatible with the sur- rounding land use and zoning , the use is in agreement with the land use policy , it is recommended for approval by the Health Department , the Extension Agent states the design is appropriate for this type of operation . If approved , it should be subject to a maximum of 24 , 000 head , construction of the lagoons as proposed , construction of a 200' feep green belt along Highway 263 , 20 ' ROW dedication on Co . Rd . #49 , construction to begin within one year of approval by the Board of County Commissioners and only one access point as shown on the plat to Highway 263 . There was discussion regarding the pumping of the lagoons . Mr. P stated Mr. Webster could get a permit from the E. P . A. and the'' %burld be pumped to the river'. Mr. Webster stated they have North Weld water for use in the lunch room and rest rooms . Other water for lots is from wells on the property. Sam Sasaki stated the meteorology department had advised him that the pre- vailing winds here are from the northwest. Cindy Telep additional data should be obtained supporting the city' s air pollution stand , before making a decision . Bill Farr presented a drawing showing the pens , the truck alleys and the drainage alleys , the lagoons , the mill , corn pits , dipping vats , etc . The green belt will be 60 ' wide. There will be stack yards for the manure . It will have perimeter lighting. The mill will be 75 ' in height. Sprinkling of the pens will be by truck . This will be a new lot for custom feeding . Mr. Farr stated the operating capacity would be 30 ,000 and would like the maximum head to be 35 ,000. Mr. Lorenson ' s recommendations were for a greenbelt, a sealed lagoon , no structure to exceed 145 ' , a maximum of 35 ,000 head and construction to begin within one year of approval by the County Commissioners . RESOLUTION : Be it therefore resolved to recommend approval to the Board of County Commissioners subject to Mr. Lorenson ' s recommendations . Motion by Mr. Nix , second by Mr. Heitman . SUBJECT: Dacono Fire Protection District APPEARANCE : Joseph Rebel DISCUSSION : Mr. Rebel presented the plans for the fire •protection district and a map showing the area to be covered. The station will be located in Dacono. Mr. Rebel stated they will have 3 units 2 are in existence and a 1972 pumper has been ordered. A new station is being built. RESOLUTION : Be it therefore resolved to recommend approval of the Fire Protection District for Dacono . Motion by Mr. Nix , second by Mr. Anderson. A vote of "Aye" by Anderson, Bowles , Heitman , Nix , Rothe , and Watson. Motion carried . 788 APPLICANTS : Windsor Investment Company SUBJECT : Proposed rezoning of the Weber farm LOCATION : Wz Sec 35 T6 R67 APPEARANCE : Bruce Keenan of M & I Engineering Co . DISCUSSION : Mr. Keenan stated the property has been purchased by the investment company and the price does not lend itself to an economic farming operation . It was purchased with some kind of a development in mind . The property is adjacent to the Eastman Kodak property. Their first proposal is for industrial zoning . There is industrial zoning to the west and to the north . To the south is a bluff. Part of the area is in the flood plain zone and would have to be dyked . ' There was discussion regarding any building in a flood plain zone . Mr. Lorenson stated that this area is no fit place to develop any- . thing . It stradles the flood plain . Two counties and two cities • are spending $25 ,000 to determine the flood plain , plus what will be paid to the Corps of Engineers . This company is asking to violate this before it is even completed. On the north side of the area , the water table fluctuates within a couple of inches of the surface . There is unstable eroded soil on the south side and up the bluff which has swink-swell potential which can be engineered around , but there would be grades up to 20% in locations . The County Regulations only provide for an 8% grade for a local type road . On the Eastman PUD it was required that no building encroach upon the Flood Plain Zone that is being determined in this area. The Planning Commission should urge this project not be continued. MOTION : By Mr. Nix that these people be given no green light to proceed . Second by Mr. Anderson and added that the Windsor Planning Commission had tabled any action on the project. Mr. Anderson stated he felt it is undesirable and asked what liability they would incur by changing the river channel . Miss Telep stated she felt they would incur a great deal of liability in rechannelling the river. The motion by Nix and seconded by Mr. Anderson was carried by a unanimous vote . The motion was restated that the Planning Commission go on record disapproving any of the plans as submitted for the property and generally find it not suitable for any type of con- struction or development. APPLICANT; H. D. Scott - continued - tape 435 DISCUSSION : There was ''iscussion regarding the definition of "Over- , night camp ground" and "translent . The application is for an, ' "over-night camp ground '. RESOLUTION : Be it therefore resolved to recommend approval to the Board - of County Commissioners subject to Mr. Lorenson ' s recommendations of the PUD in final form, approval of the Highway Dept. concern- ing the access road , drainage plan be approved by the City Eng- ineer and connect to city water and sewer when available. SUBJECT: Interladco • DISCUSSION : Mr. Lorenson read a letter from the Farmer' s Home Administration regarding their Feasibility Analysis of the proposal for Indianhead Subdivision . They informed the develop- ers their proposal is ineligible for FHA participation due to the economic , environmental and other causes and lack of amenities to provide favorable elements in the establishment of ,remote , and premature development. In their opinion further consideration is not warranted . SUBJECT : Minor Subdivision regulations - Section 9 of Subdivisions DISCUSSION : Mr. Lorenson reviewed the process of filing a minor subdivision plat as written in the proposed subdivision regula- • tions . The proposed filing fee is $50 . 00. Abstracts will be requested for 5 years prior to the application, MOTION : by Mr. Watson to approve the procedure for Minor Subdivision Second by Mr. Nix. A vote of "Aye" by Anderson , Bowles , Heitman Nix , Rothe and Watson . Motion carried. SUBJECT : Subdivision Regulations DISCUSSION : Mr. Lorenson stated 25 copies have been sent to the State Planning Office. The fee schedule will be by separate resolution , also the construction standards . All of the changes recommended at the joint meeting have been changed. These reg- 3 ulations have to be adopted by 9/1 /72. 790 RESOLUTION : Be it therefore resolved to 'recommend approval to the Board of County Commissioners to adopt and advertise the proposed Subdivision Regulations . SUBJECT : Construction Standards DISCUSSION : Mr. Ewing presented the construction standards which wil be adopted by separate resolution. SUBJECT : Western Resources Conference DISCUSSION : Marshall Anderson reported on the Bureau of Reclamation panel , the Corps of Engineers and other agencies regarding re- creation. ANNOUNCEMENTS : The next Planning Commission meeting (executive) will be at the Farm Fare at Lucerne . There will be a joint meeting July 25th , at the City Complex council chambers at 7 :30 P. O.BOX 878 GREELEY,COLORADO 80631 (303)- 3S2-5513 BASIC GREEN BETT SPECIFICATIONS The north and west boundaries of the proposed feedlot site are to have a . sixty foot wide grass and tree green belt, which will be broken only for the three residences and gated entrance ways. There will be a four strand perimeter fence enclosing the property. Twenty feet inside the fence line will be a planted row of Viburnum lantana. This shrub has been suggested because of -its disease resistance, rapid growth and ' beautiful, dense foliage. At maturity, this variety will maintain a height of ten to fifteen feet. The leaves are gray-green in bolor, turning red'in the fall. This fruit turns 'black in the fall and they remain through mid-winter. As the shrub grows in height, it also will fill the space between, being planted on eight to ten foot centers. Twenty feet inside the shrub row will locate a planted line of Populus del- toidea, more commonly known as cottonless cottonwoods. These trees have been recommended primarily because of their rapid growth and adaptibility to our Northern Colorado climate, as well as their beauty throughout the year. At maturity these trees will be approximately fifty feet high and about forty feet in width. The leaves are dark green in color, turning bright yellow in the fall before dropping to the ground. The spacing of the trees will be from forty to fifty feet. ' Twenty feet inside the tree line will be a fifty foot wide perimeter road servicing all of the interior feedlot traffic. Therefore, from the property boundary, actual facilities will be located no closer than one hundred and ten feet from the edge of the county roadway. The existing greenery around the present residences will be removed and replaced with similar trees and shrubs to maintain continuity throughout the feedlot property. Flowering crabs and evergreens will accent these homes as well. An orchard and brome grass mixture will be,planted within the green belt area to enhance the beauty of the trees and shrubbery. These grasses do not get over fifteen inches in height prior to their going to seed. They are also very well adapted for flood irrigation. At the primary and secondary entrances to the property, approximately thirty feet on either side of the gateway will be several low evergreens, such as the Gold Coast Juniper replacing the Viburnum. This shrub is very well adjusted to this climate and will not grow over two feet tall, permitting excellent vision for traffic returning to the county roadway. The final design and installation of the entire green belt area will be supervised by a landscape architect. This person will also provide the required technical knowledge for disease and insect control and a complete fertilization of the grass, shrubs, and trees. CATTLE FEEDERS RANCHING IRRIGATED FARMING CHIPPING POTATOES rae FARM FARMS COMPANY P. 0 BOX 070 GREELEY,COLORADO 80631 • (303) 352-5513 The retention ponds at the proposed Farr Farms Company feedlot have been designed to prevent any polluted water from the soiled areas of the feedlot from entering the waters of Colorado. The retention facilities, at maximum capacity will store 57 acre feet of water. This capacity is approximately 30% more than the regulations require for • the 10 year storm during a single 24 hour period of time. Provisions for adequate drainage collection throughout the soiled area will be accomplished by an extensive network of buried pipe lines. Surface water will move through this system to the holding facilities for later use by irrigation systems, primarily on company property. All ponds will be rectangle in shape and have an actual depth of thirteen feet. Twelve feet of this depth is available for storage, allowing one foot of freeboard to facilitate any wave action. Side slopes of the ponds will be on a 3 foot to 1 foot grade, while the end ramps of the area will be graded to a 6 foot to 1 foot slope, permitting cleaning equipment to enter and exit easily. The entire area of the pollution control facilities shall be sterilized to prevent any vegetative growth. The surrounding ground shall also be graded in such a manner so as to eliminate any soil erosion in the roadways or pond banks. The floors of the ponds will be level, but sloped to one given point to permit removal of the liquid product for irrigation. The ponds will be sealed to prevent percolation of pollutants into the ground waters of Colorado. During the dry times of the year the collected solids in the ponds will be removed and distributed to farm land in the general area of the feedlot. This will open the cubic area of the ponds for the wet times of the year and make avail- able 100% of their storage capacity. The area is to be used for future expansion for cattle feedlots. Most of the soils in this area are well drained, medium to moderately coarse textured with sand and gravel substratums below 20 to 40 inches. They are nearly level and are not subject to flooding. The south end of the area is a steeper ridge with runoff into the Ogilvy Canal. The soils along this ridge are coarser textured with sand and gravel substra- tums below 12 to 20 inches. Storm runoff from the area would be into the Ogilvy Canal to the south or Lone Tree Creek to the east.
