Dear Commissioners: My concern with the approval of this plan for development is the traffic that would increase on WCR 35.5. This road runs between WCR 46 on the North side and the Peckham Road (WCR 44) on the South side. It becomes a shorter route going West on WCR 46 needing to cut over to WCR 44. WCR 44 then goes East to WCR 49 or West to Hwy 85. It saves people a little time, and it is an easier turn for semi's onto WCR 44. Right now we get more then our share of heavy trucks down our road for oil and gas, and just regular traffic from Lasalle. WCR 46 which currently crosses the railroad tracks at Hwy 85, will be closed, which in turn will direct more traffic down 35.5 headed to WCR 44. The modification of WCR 44 over the railroad tracks and Hwy 85 means more traffic to WCR 44. Poor drainage on WCR 35.5 has always been a problem especially with heavier rains. In May of 2022 they added what they called road base to WCR 35.5 but it was really a mixture of black clay and a few rocks. When we get any kind of moisture it turns into black slippery mess. I included pictures below to show what I'm talking about. This is why I'm concerned about more traffic on this road. I have lived here for 21 years, and since this road base was put down in 2021 this road gets almost impassable with any moisture. It has always had poor drainage, so water just collects at the North end of WCR 35.5 at WCR 46. Something needs to be done before WCR 46 that crosses the railroad track and Hwy 85 is shut down. Everyone that lives on WCR 35.5 would agree that improvements must be made whether this development plan is approved or not. Concerning the fertilizer storage and amount - the Weld County Office of Emergency Management replied to the case with conditions and the Department of Public Health and Environment also provided comments. (both attached) The site plan shows 12 tanks to be installed at full buildout. The detention/retention pond has not been fully designed and is a Condition of Approval. The applicant will need to submit the final design to the County prior to full approval of the project and the design will be reviewed by our engineer. We didn't get notice or misplaced the notice, but anyhow I learned from another neighbor that the planning commission approved the request but there were several unanswered questions. Can you please send me the link or the documents associated with the application? A few questions I have is understanding the volume of fertilizer to be stored, how it is proposed to be stored, who regulates that storage and how to mitigate any groundwater contamination. As you might know, the fertilizer plant/storage facility in Gilcrest has a significant groundwater pollution plume. I heard the storage facility will hold 1.5 million gallons in two tanks. I hear there will be a retention pond, a detention pond? Question was asked about what will happen with the water that is detained. Answer at the hearing is it will be pumped onto adjacent property? Natural precipitation needs to by Colorado law returned to the river via deep percolation or by surface run off to nearby streams to tributaries to the river. Any pumping from the pond couldn't result in the water being consumed. I'll look forward to the information so I can better understand what is going on. Thanks for providing the information.
