Sean Standridge and Sonja Kohlgraf, WCSO Budget Manager Brief description of the problem/issue: The Sheriffs Office would like to apply for the 2024 Beat Auto Theft Through Law Enforcement (BATTLE) Grant sub grantee funding` and request an Automatic License Plate Recognition (ALPR) system in the total amount of $45,864.95, which includes a 4 -year software maintenance plan and a tracker. WCSO will cover the sim card and ongoing airtime of $48/month. The grant is funded by the Dept. of Public Safety, CO Automobile Theft Prevention Authority (CAPTA). The Sheriffs Office currently has two ALPRs and would like to add an additional one to be deployed with the goal to rapidly identify suspects that drive stolen vehicles by providing a date/time and location information of the vehicle, including photographs. The data can be immediately retrieved by our agency and shared with partnering LE agencies. It also has the capability to remotely log into the system and look for specific license plates. The ALPR will be utilized by the Patrol Division. This device is not used for issuing traffic infraction citations. The Sheriffs Office patrol division year to date has had 26 stolen vehicles cases, and 165 recovered steal cases from January 2022 to November 21', 2022. The application deadline is 12/2/2022 What options exist for the Board? To be eligible for this funding, you must complete the below application process and send your response and supporting documentation to Captain Michael Ryan via email at michael.ryangstate.co.us, by December 2, 2022. The FY24 CATPA Grant Guidance document will be released on Thursday, November 17 on CATPA's website, located here https://csp.colorado.gov/services-we-provide/colorado-auto-theft-prevention- authority/catpa-grant-programs-available. This document is essential to understanding the requirements associated with this CATPA grant, especially depending on the type of budgetary grant funds requested (i.e. personnel/overtime, equipment, supplies and operating, travel and/or training). If you are requesting license plate readers (LPRs) please pay special attention to the CATPA FY24 Grant Guidance document section on LPRs as there are specific conditions involving this equipment. It is also important to note that although the initial LPR purchase and installation costs can be covered by the CATPA BATTLE grant, the continual associated LPR costs (e.g. annual vendor subscription service costs) beyond the initial purchase and installation will be the financial responsibility of the purchasing subgrantee and is not a recurring expense that BATTLE will reimburse for. If you are requesting a continuation of funding from previous CATPA BATTLE grants that must be included in this application process to be considered. It is also important to note that we will need you to submit a recent price quote from the vendor your will be using for each piece of equipment that you are requesting. One of our BATTLE priority funding focus efforts is on overtime funds used to support multijurisdictional BATTLE operations that serve a variety of geographical areas to interdict, investigate and enforce motor vehicle theft -related crimes, as we have observed significant success from this model statewide, especially to date through the FY23 grant cycle. Statement of motor vehicle theft (MVT) problems in your jurisdiction and how it relates to the funds requested. (Note: The ATICC will provide MVT statistics for the BATTLE Region. Weld County covers just under 4000 square miles, with two interstates and eleven highways. There are eight cities and 23 incorporated towns which 25 of those cities and towns have their own police departments. Weld County also has 15 unincorporate towns which the Sheriff's Office provides law enforcement services to. The Weld County Sheriff's Office enjoys a collaborative partnership with every one of them. There are two interstates through Weld County leading to other states provide throughways for stolen vehicles and criminal activity. Due to the size and proximity to the Denver Metro area, Weld County has become a "dumping ground" for vehicles that were stolen outside of Weld County. There have been 3,048 vehicles reported stolen in October FY22, statewide. The stolen vehicle recovery rate in October 2022 was 91 percent, a 5 percent increase compared to October 2021, with 32 more vehicles recovered. The Sheriffs Office patrol division year to date has had 26 stolen vehicles cases, and 165 recovered steal cases from January 2022 to November 21St, 2022. The Weld County Strike Team (special crimes unit) had the following recovery stats. The value of stolen/recovered motor vehicles for the same period is $255,885 value of stolen vehicles and a recovery rate of only $271,385 dollars. 700 Kipling Street Suite 1000, Lakewood, CO 80215 cdpsweb.state.co.us Jared Polls, Governor I Stan Hilkey, Executive Director The Sheriff's Office Strike Team also recovered an estimated $593,859 dollars in stolen property (trailers, skid steers etc.) during the same time periods and directly connected to stolen vehicle cases. The Sheriff's Office Strike Team served 14 search warrants, conducted over 33 hours of hard surveillance on possible auto theft suspects and chop shops, served 8 consent to search of properties. The Sheriff's Office Strike Team worked two large cases that occurred in Weld County this past year. The first case 22W004627, resulted in the following stats: • Confirmed stolen vehicles amount of $146,208 • Unconfrimed stolen with vin plates removed, $38,000 • Total seizure of $184,208, confirmed stolen $165,008 Second property we served a serach warrant (22W004508) on had the following stats: • 6 stolen motor vehicles, 2 ATVs, 10 trailers, 2 pieces of heavy machinery. • Total vehicle and stolen property recoverd was an estimated $303,500 Most of the above cases resulted in vehicles and property being stored on abandon or rual properties without the property owners knowledge. Due to the size of Weld County and througways, criminals are driving from one location to the next. Funds from the battle grant will help the Sheriff's Office to interdict, investigate and enforce motor vehicle theft -related crimes. The Sheriff's Office will also use the multijursdiction advantage with other juridictions to combat auto theft crime in and around Weld County. The Sheriff's Office goal is to stratigically place LPR cameras in high crime areas and major roadways around the county. The Sheriff's Office will aslo allow surrounding agencies to use the LPR cameras to help track vehicles or equipment from their respected juridictions. One of the stratigic plans for the Sheriff's Office is to eventually purchase its own LPR system and with battle grants, LPR systems to be stratigiclaly placed around Weld County. One of our long term goals is to have LPR fixed and mobile systems around the county to track stolen vehicles coming into and out of Weld County. Three victim impact statements given to us about auto theft and how it affected them; 1) Victim #1 advised they saved two years to purchase a truck and only had liability insurance. The family was without a vehicle, which caused major issues getting the kids to school and the parents to work. The Sheriff's Office recovered his vehicle, which was chopped and put together with different parts. Victim advised he didn't care as long as the vehicle ran. 700 Kipling Street Suite 1000, Lakewood, CO 80215 cdpsweb.state.co.us Jared Polls, Governor I Stan Hilkey, Executive Director 2) Victim #1 advised, they are an elder couple and the vehicle is essential on getting to the doctor's office and picking up their medications as well as oxygen. Victim #1 advised the lose of his vehicle caused them extream financial issues as they had no way of picking up needed oxygen and medications. Victim #1 advised they were on a fixed income and had to pay for rides to pick up their essential items. 3) Victim#1, a business owner. Who had his work truck, along with a trailer that had havey equipment on it for concrete work stolen. Victim advised who ever stole his vehicle, trailer, and heavy machinary has not only put him out of business but he had to advise his employee they were out of work. Fortunaley for all the above victimes, the Sheriff's Office Strike Team was able to track and recover all their vehicles with the help of LPR systems around the state and metro Denver area. As stated above the funds received by this grant will help purchase a LPR trailer to be stratigically placed in and around Weld County. This LPR trailer will help the Sheriff's Office as well as other jurisdicitons to combat the rising issue of auto theft and the crimes that comes with it. Equipment requested. A recent itemized price quote is required to request equipment. This quote needs to include all aspects of the equipment requested (e.g. costs of the equipment, installation costs, initial deployment costs, how will recurring (subscription) costs be accounted for, how will maintenance costs be addressed, and are there any other costs associated with this equipment request? Note that you will only be awarded what you request, so please make sure everything that is going to be needed is included in the quote. Again, if you are requesting an LPR you must review the CATPA FY24 Grant Guidance document and account for the requirements, including a letter of commitment and completion of the evaluation and assessment form. It is also important to note that if you are planning to place LPRs on CDOT infrastructure or rights of way, then CDOT has a permitting process for that, which also requires traffic safety and barricade plans that may require additional costs and should be accounted for in this funding request process. • List equipment and the price of each piece of equipment requested (must additionally attach the price quote from the vendor for each piece of equipment requested) • Explain how each piece of equipment will be used to accomplish CATPA BATTLE objectives. How often is it anticipated the equipment will be used? The above equipment is put together into a trailer as seen in the picture below. They trailer would be stratigically placed in high crime areas to investigate auto theft crimes and auto theft related crimes. The trailer would be deployed on a weekly basis to not only assit the Weld County Sheriffs Office but other local agencies inside and out of Weld County. According to the last Battle October Bulletin, between October 2021 and October 2022 demonstrate increases in two (2) of the six (6) CATPA Regions. Metro and Norhern show increases, with Northern Colorado demonstrating the largest increase at 3 percent. With this information, the trailer could be deployed in the following areas; Brighton, Broomfield, Dacono, Frederick, Firestone, Longmont, Fort Lupton, Milliken, Johnstown, Windsor, Loveland and Greeley munipalites. Due to the size of Weld County, the LPR trailer could help each one of these municiplaties to combat autotheft and the crimes that come with it. The Sheriffs Office is not seeking funds for the annual maitance or training for this system. Sheriff's Office personnel are already trained on using the system and how to maintain it. This Quote and the Prices stated herein shall be valid through the Expiration Date listed above. Quote Pricing is sLbject to change for the Customer Purchase Orders issued after Quote Expiration Date. U nless the Purchase Order is pursuant to a State or Federal cooperative purchasing agreement, or a separately executed Master Agreement, these Terms and Conditions supersede and replace any prior estimate, offer, quote, agreement, understanding or arTangement whether written or oral between the parties. These Terms and Conditions may not be changed or modified unless in writing and signed by an authorized representative of (Senior Vice President or above) of Selex. Selex will not be bound by any terms of Customer's purchase order unless expressly agreed to in writing and signed by an authorized representative (Senior Vice President or above) of Selex. S hipment and Delivery. All orders shipped FOB Greensboro. For purchases of Products that require installation: Unless otherwise agreed to by the Parties, Selex ES agrees not to ship P roduct until an Installation date is scheduled. Title. Ownership of and Title to the Products shall transfer to the Customer upon shipment. All intellectual property rights, including without lim tation, patents and /or the relevant applications, in or relating to the Products, to the Documentation and to the Software are and shall remain the property of Selex ES or its licensors. Refer to the Selex Software License Agreement documentation provided with the shipment. Payment Terms. Selex shall invoice Customer no later than sixty (60) calendar days after shipment of the Products and/or performance of any Work or Services. Payment is due Net 30 days. Taxes may not be reflected in this Quote. However, taxes may be added to the amount in the payment invoice(s) sent to Customer, unless Customer provides a certificate confirming tax exempt status. Cancellation or Delay. Orders accepted by Selex are subject to cancellation by Customer only upon the express written consent of Selex. Upon such cancellation and consent, Selex shall cease all work pertaining to the Customer's order, and Customer shall pay Selex for all work and materials that have been committed to and/or identified in Customers order plus a cancellation charge as prescribed by Selex. Warranty. EXCEPT AS SET FORTH IN THIS AGREEMENT AND IN THE SELEX WARRANTY COVERAGE DOCUMENTATION, SELEX INC. MAKES NO OTHER WARRANTIES EXPRESS OR IMPLIED RELATING TO THE P RODUCTS OR SERVICES. Applicable Law. The terms of this Quote, their interpretation, performance or any breach thereof, shall be construed in accordance with, and all questions with respect thereto shall be determined by, the laws of the state of North Carolina applicable to contracts entered into and wholly to be performed within said state. Any legal proceeding brought by either party pursuant to this Agreement shall be brought in a County or District Court located in Guilford County, North Carolina and the parties irrevocably consent to the jurisdiction of such courts. FORCE MAJEURE. Either Party shall be excused for delays in delivery or in performance where such delay is directly due to act of God, acts of civil or military authority, fires, strikes, floods, epidemics, war, riot, or other similar causes beyond such Party's reasonable control. Such Party shall promptly give written notice to the other Party specifying the nature and probable extent of such delay. The Parties shall then immediately attempt to determine what fair and reasonable extension of schedules may be necessary. The parties agree to use their best efforts to mitigate the effects of the delay. COMPLIANCE WITH LAWS. Customer shall comply with all federal, state, local; and territorial laws, including without limitation any export control, employment, tax, anti -corruption, anti -bribery, privacy and data protection, immigration and anti -discrimination laws, and shall indemnify Selex for any liability incurred by Selex as a result of breach of any such obligation. EXPORT COMPLIANCE. This sale is subject to all laws, rules, regulations and public policies of the United States, particularly those relating to the exportation of goods from the United States and the transmission of technical data or other information outside the United States. By this purchase, Customer agrees to comply with all applicable U.S. laws and regulations which prohibit the export of technical data that originates in the U.S., or any product direct y based on such data without prior written authorization from appropriate U.S. agencies. Such compliance obligates Customer not to export Selex's confidential information or make it available to aliens or any unauthorized personnel, and to indemnify Selex for any liability incurred as a result of breach of such obligation.
