IN THE A (AGRICULTURAL) ZONE DISTRICT - KYLE SCHWARTZ AND
ABIGAIL RENNER
A public hearing was conducted on October 19, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
gi I hereby certify that pursuant to a notice dated September 19, 2022, and duly published
September 21, 2022, in the Greeley Tribune, a public hearing was conducted to consider the
request of Kyle Schwartz and Abigail Renner, for a Site Specific Development Plan and Use by
Special Review Permit, USR22-0021, for one (1) second Single -Family Dwelling per legal lot in
the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record.
11 Chair Pro-Tem Freeman reviewed the procedures to follow should this case result in a tie
vote due to four (4) Commissioners being present and Chair James being excused.
El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal
and described the location of the site. She shared 15 referrals were sent out, ten (10) referral
agencies responded with no concerns or included conditions that have been addressed in the
Conditions of Approval (COA) and Development Standards (DS), and five (5) referral agencies
did not respond. Ms. Aungst stated the applicant is proposing a second home to be built within
the existing 50 x 60 -foot outbuilding, explaining the site meets the maximum outbuilding
requirements. She described the use of the site and adjacent land uses, shared the Town of
Firestone has annexed the property to the west and platted two, high -density residential
subdivisions, established around 1999. She explained there were no responses from the 31
surrounding property owners (SPOs), and based on the referral agency responses, the proposed
uses are in an area that can support this development and assure compatibility with surrounding
land uses. Ms. Aungst stated the site is located within the Coordinated Planning Agreement (CPA)
areas of the Town of Firestone and City of Fort Lupton, although neither requested annexation.
She relayed the Comprehensive Plan Map of the Town of Firestone depicts the property, as

Residential Low Density (R -L), and according to the Comprehensive Plan of the Town of
Firestone, adopted in 2013, the site is also located within the three (3) mile referral area of the
Towns of Frederick and Firestone and the City of Fort Lupton. Additionally, the Town of
Firestone's referral, dated July 8, 2022, states: "the portion of Frontier Street (County Road
(CR) 15) that is adjacent to the subject property is within the municipal limits of the Town of
Firestone, the Town respectfully requests the County require the owner to deed ten (10) feet of
property for right-of-way purposes," and Staff has not included a COA for this request. She shared,
per the Development Review staff, the site has existing, permitted accesses onto Elm Street, and
no other accesses are requested. Elm Street is a local, gravel road requiring 60 feet of right-of-
way, and traffic will be typical of a residential dwelling. She shared the applicant has submitted a
Drainage Narrative, stating the site meets the stormwater detention exception. Ms. Aungst
entered the favorable recommendation of the Planning Commission into the record as written and
displayed images of the site and surrounding views.
', Lauren Light, Department of Public Health and Environment, stated the main residence is
served by the Central Weld County Water District and an on -site wastewater treatment system
(OWTS) which is permitted for three (3) bedrooms. The second residence, which will be located
in the existing outbuilding, will share the tap, and has a septic system designed for two bedrooms,
as well as the personal shop. Ms. Light relayed two DS address water and sewer and there are
no outstanding issues with the request.
Abigail Renner, applicant, stated the apartment will house her elderly mother.
No public testimony was offered concerning this matter.
.' The Board discussed the COA and DS as presented. In response to Chair Pro-Tem Freeman,
regarding DS #10 (Necessary personnel having access), Ms. Aungst confirmed it is standard
language, and Mr. Barker explained the building permit will allow for inspection. The Board agreed
to delete DS #10.
El No public testimony was offered concerning the change to the DS.
lE In response to Chair Pro-Tem Freeman, Ms. Renner indicated they have reviewed, and
agreed to abide by, the Conditions of Approval and Development Standards, as amended.
IC Commissioner Buck moved to approve the request of Kyle Schwartz and Abigail Renner for
a Site Specific Development Plan and Use by Special Review Permit, USR22-0021, for one (1)
second Single -Family Dwelling per legal lot in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Moreno,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:25 a.m.
