COUNTY OF WELD ) NOTICE OF HEARING
IN THE MATTER OF COMPLAINT
IN RE:
THOMAS U. CLARK
11702 Spring Drive
Denver, Colorado
WHEREAS, heretofore and on February 28, 1972, the Board
of County Commissioners, Weld County, Colorado, at your request,
did rezone a parcel of land from "A" Agricultural District to "C"
Commercial District, said area being more particularly described
as follows:
A tract of land located in the Southwest Quarter (SW-k) of
Section 23, Township 1 North, Range 68 West of the Sixth
Principal Meridian, Weld County, Colorado and being
further described as follows:
Beginning at the Southwest Corner (SW Cor) of said Section
23, and considering the West Line of said Section 23 to
bear North 00° 07' 30" East, with all bearings herein being
relative thereto:
Thence North 00° 07' 30" East, along the West Line of
said Section 23, a distance of 330 feet;
Thence North 89° 48' 19" East, 50. 00 feet to the East
Right-of-Way Line of Interstate Highway No. 25;
Thence continuing North 89° 48' 19" East, 610. 00 feet;
Thence South 00° 07' 30" West, 300. 00 feet to the North
Right -of-Way Line of County Road No. 6;
Thence continuing South 00° 07' 30" West, 30. 00 feet to
the South Line of said Section 23;
Thence South 89° 48' 19" West, along the South Line of
said Section 23, a distance of 660. 00 feet to the Point
of beginning, consisting of 5 acres, more or less, and
WHEREAS, said rezoning was granted under certain conditions,
and
WHEREAS, it has been made to appear to the Board that you
have not complied with certain conditions in the following respects:
1. Failure to properly fence and landscape the area rezoned.
2. Failure to proceed with due diligence to begin development
of the area rezoned.

3. Failure to submit plans for such development for approval
of the WeLd County Planning Commission.
NOW, THEREFORE, you are hereby ordered to appear before
the Board of Weld County Commissioners in the Weld County Court-
house in Greeley, Colorado, on the 9th day of July, A. D. , 1973, at
the hour of 3:00 P. M. , or as soon after as you can be heard
to show cause why the aforesaid premises should not be rezoned and
revert to their previous agricultural classification.
IT IS FURTHER ORDERED, that a copy of this Order and Notice
shall be mailed by certified mail, return receipt requested, or delivered
personally, to the above named, Thomas U. Clark, 11702 Spring Drive,
Denver, Colorado.

Dear Glen :
The Planning Commission at their regular meeting of May 14 ,
1973 , recommended that the Board of County Commissioners take
necessary legal action to require Mr . Clark to build a fence
as required by the Resolution of the Board of County Commissioners
when the zoning was granted . The Resolution indicated that the
fence should be built by March 8 , 1973 , and to this point in
time , no fence has been constructed .
