BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MONDAY, JULY 18, 2022
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, July 18, 2022, at the hour of 9:00 a.m.
El ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Scott K. James, Chair
Commissioner Mike Freeman, Pro -Tern
Commissioner Perry L. Buck
Commissioner Steve Moreno
Commissioner Lori Saine
Also present:
County Attorney, Bruce Barker
Acting Clerk to the Board, Houstan Aragon
Chief Financial Officer, Cheryl Pattelli
PUBLIC INPUT: No public input was given.
le AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed.
Commissioner Saine seconded the motion and it carried unanimously.
• COMMISSIONER COORDINATOR REPORTS: Commissioner Buck reported last Tuesday she
and Commissioner Moreno toured the Aims Aviation Center in Loveland, Colorado. In addition, she
attended a Weld County Workforce Development Board meeting and reported there are now 80 young
adults connected with jobs and internships. Commissioner Freeman recognized the staff who are working
in the elements, and cautioned them to take care with the extreme temperatures. Commissioner Moreno
commended Bob Lembke, President of United Water and Sanitation District, for the tour of several
facilities, and expressed how informational it was highlighting what they are doing in Weld County.
• WARRANTS:
1) GENERAL WARRANTS - JULY 15, 2022: Commissioner Saine moved to approve the General
Warrants, as printed, with the exception of Check #3375709 (12210900), dated July 18, 2022, in the
amount of $10,000.00, for Grand Hyatt Vail, to be considered separately. Commissioner Moreno
seconded the motion for the purposes of discussion, and commented this payment was discussed in a
work session and the amount is for the purpose of making a down payment to secure the location of the
2023 Ten -County Budget Conference. There being no further discussion, the motion carried
unanimously.

2) GENERAL WARRANTS - JULY 15, 2022: Commissioner Freeman moved to approve Check No.
3375709 (12210900), dated July 18, 2022, in the amount of $10,000.00, payable to the Grand Hyatt Vail.
Commissioner Buck seconded the motion, and upon a roll call vote, the motion passed four (4) to one (1),
with Commissioner Saine opposed.
NEW BUSINESS:
1) CONSIDER COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) 2022 ANNUAL ACTION PLAN:
Cynthia Martin, CDBG Analyst, stated this annual action plan is required by the United States Department
of Housing and Urban Development (HUD), to ensure the grants that were awarded are consistent with
the Consolidated Master Plan. Commissioner Freeman moved to approve said Annual Action Plan. The
motion was seconded by Commissioner Buck and it carried unanimously.
PLANNING:
1) CONSIDER PARTIAL VACATION OF TWO -LOT AMENDED RECORDED EXEMPTION,
AMRE-2556, FOR REMOVAL OF LOT B — MICHAEL AND JEANNE WARE: Chris Gathman, Department
of Planning Services, stated staff received a request from the applicants for the removal of Lot B from
Amended Recorded Exemption, AMRE-2556. He gave a brief overview of the property history and
location, and stated Lot A is not part of this request, nor will easements be affected. Mr. Gathman
explained each lot has an existing access onto County Road (CR) 19, that were constructed in 2001,
which do not meet the 206 -foot spacing requirement for an arterial roadway; however, they were
constructed prior to the current access permitting system requirements. He stated there are two (2)
existing oil and gas wells with access points onto CR 4, which do meet the minimum criteria, and further
stated there is an existing 20 -inch high-pressure natural gas line that is permitted through Use by Special
Review Permit, USR17-0032, that runs along the western property line of the lot to be vacated, and is
addressed in the Conditions of Approval. Michael Ware, applicant, was present for questions. No public
testimony was offered concerning this matter. Commissioner Moreno moved to approve said partial
vacation, with the Condition of Approval. The motion was seconded by Commissioner Saine and it carried
unanimously.
El 2) CONSIDER CERTIFICATION TO WELD COUNTY TREASURER OF ZONING VIOLATION
PENALTIES AS SPECIAL ASSESSMENT - LUCINA FLORES (CONT'D FROM 4/18/2022):
Matthew Conroy, Assistant County Attorney, stated Lucina Flores has a court -ordered daily penalty of
$25.00 per day, beginning on March 12, 2020, for violations including excessive animal units onsite and
greater than allowed lot coverage for the onsite structures. He confirmed the Board of County
Commissioners previously heard this matter on April 18, 2022, and granted a 90 -day continuance to bring
the site into compliance, but the property owner has failed to do so and is now 316 days delinquent,
which results in a total of $7,900.00 to be certified as a special assessment. Bethany Pascoe, Zoning
Compliance Officer, displayed photos from her inspection conducted on July 13, 2022, and in response
to Chair James, stated no progress has been made and the demolition permit has expired. There was
no respondent or representative present. Commissioner Freeman moved to approve said certification of
zoning violation penalties as a special assessment. Commissioner Moreno seconded the motion, and it
carried unanimously.
RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board. There being no further business, this meeting was adjourned at 9:13 a.m.
