This meeting was called to order by Chair, Elijah Hatch, at 12:30 pm. Roll Call. Present Elijah Hatch, Skip Holland, Butch White, Michael Wailes, Pamela Edens, Michael Palizzi, Shana Morgan. Absent: Sam Gluck. Also Present: Chris Gathman, Maxwell Nader, and Jim Flesher, Department of Planning Services; Karin McDougal, County Attorney, and Michelle Wall, Secretary. Motion: Approve the July 12, 2022, Weld County Planning Commission minutes, Moved by Skip Holland, Seconded by Butch White. Motion passed unanimously. Commissioner Morgan abstained because she was not present at the July 12, 2022, Planning Commission Hearing. Pamela Edens nominated Elijah Hatch as Chair. There were no other nominations. The Chair asked for a vote on the approval of the nomination. The nomination passed unanimously. Michael Wailes nominated Butch White as Vice Chair. There were no other nominations. The Chair asked for a vote on the approval of the nomination. The nomination passed unanimously. Elijah Hatch will serve as Chair and Butch White will serve as Vice Chair for 2022-2023 year. CASE NUMBER: USR22-0009 APPLICANT: ENRIQUE RETANA PLANNER: MAXWELL NADER REQUEST: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW TO EXCEED THE MAXIMUM ALLOWED BUILDING COVERAGE (UP TO 14%) IN THE A (AGRICULTURAL) ZONE DISTRICT. Maxwell Nader, Planning Services, said that due to an error in the publication of the legal notice with the newspaper, staff must request a continuance of USR22-0009. Staff requests the case be continued to September 6, 2022, for the Planning Commission and September 21, 2022, for the Board of County Commissioners. The Chair asked if there was anyone in the audience who wished to speak for or against the continuance. No one wished to speak. Commissioner Wailes asked staff if there is an active zoning violation on the property. Staff responded yes. Mr. Wailes asked if the continuance affects the violation. Mr. Nader said he spoke with Compliance, and it will not. Mr. Wailes asked why this case was not being heard by Board of Adjustment with a request for a variance. Mr. Nader replied that the building meets the offsets but was built without getting building permits. Motion: Continue Case USR22-0009, Moved by Michael Wailes, Seconded by Butch White. PLANNER: CHRIS GATHMAN REQUEST: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT FOR OIL AND GAS SUPPORT AND SERVICE INCLUDING OUTDOOR STORAGE YARDS FOR OIL AND GAS VEHICLES AND EQUIPMENT IN THE A (AGRICULTURAL) ZONE DISTRICT. LEGAL: LOT B RE -1541; BEING PART OF THE E2 SECTION 23, T2N, R67W OF THE 6TH P.M., WELD COUNTY, COLORADO. LOCATION: WEST OF AND ADJACENT TO CR 23; APPROXIMATELY 0.25 MILES SOUTH OFCR20. Chris Gathman, Planning Services, presented Case USR22-0012, reading the recommendation and comments into the record. Seven surrounding property owners were notified of this request. Staff received no phone calls or correspondence back. There is an active zoning violation (ZCV20-00212) on the property for operating an oil and gas support and services facility without the appropriate land use and zoning permits. The Department of Planning Services recommends approval of this application along with conditions of approval and development standards. Commissioner Wailes asked what the violation complaint was about. Staff responded the complaint was that the oil and gas support and services facility was running without the proper permits. Mr. Gathman explained that if the USR is approved, the zoning will be addressed. Commissioner Holland mentioned that this was a sizable piece of property and asked staff if there is any limitation to the utilization of the land for the storage yard. Staff explained that their site plan clearly shows the extent of their storage area which is approximately five acres. Commissioner Edens asked if the applicant would be able to expand the five -acre area in the future if they wanted to. Staff explained they could request to amend their USR. Cory and Traci Knote, 8711 County Road 23, Fort Lupton, Colorado. The Knotes introduced themselves as the applicants and property owners. Vanessa and James Ingalls, Diamond T Services Inc, 7555 Nile Way, Arvada, Colorado. Ms. Ingalls explained that she is an owner of Diamond T Services. She said they are leasing an area on the Knote's property for their lay -down yard. Ms. Ingalls stated they are happy to have a place to store equipment, so they do not have to take the equipment to Wyoming which is where their other office is. The Chair asked if there was anyone in the audience who wished to speak for or against this application. No one wished to speak. The Chair asked the applicant if they have read through the Development Standards and Conditions of Approval and if they are in agreement with those. The applicant replied that they are in agreement. Motion: Forward Case USR22-0012 to the Board of County Commissioners along with the Conditions of Approval and Development Standards with the Planning Commission's recommendation of approval, Moved by Michael Wailes, Seconded by Michael Palizzi. Commissioner Wailes stated that the applicant meets the requirements of Section 23-2-220. CASE NUMBER: ORDINANCE 2022-05 PRESENTED BY: JIM FLESHER REQUEST: IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING AND CHAPTER 29 BUILDING REGULATIONS OF THE WELD COUNTY CODE (TELECOMMUNICATION TOWERS). Jim Flesher, Planning Services, stated that the Planning Commission and staff were able to review the requested code changes during the lunch meeting held prior to the hearing. A memo summarizing the changes was provided. He asked the Planning Commissioners if they had any questions or comments. No one did. Staff recommends adoption of the ordinance. The Chair asked if there was anyone in the audience who wished to speak for or against the proposed code changes. No one wished to speak. Motion: Forward Ordinance 2022-05 to the Board of County Commissioners with the Planning Commission's recommendation of approval, Moved by Butch White, Seconded by Michael Wailes.
