RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-951 - GEORGE ZADEL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated October 23, 1991, the Board approved Use by Special Review Permit, USR-951, for a Commercial Use (excavating contractor shop) in the A (Agricultural) Zone District, for Elaine Zadel on the following described real estate, to -wit: Lot B of Recorded Exemption, RE -1359; being part of the SW1/4 SW1/4 of Section 34, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners has received a request from the current property owner, George Zadel, 18100 County Road 19, Johnstown, Colorado 80534, to vacate said Use by Special Review Permit, USR-951, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. Within two weeks of approval by the Board of County Commissioners and prior to recording the plat map, the applicant shall submit estimate of costs, and a proposal for a performance guarantee as allowed in the Weld County Zoning Ordinance, Section 24.4.3, for construction and installation of the screening plan approved by the Department of Planning Services and the Soil Erosion Control Plan approved by the Platte Valley Soil Conservation District. The estimated amount and performance guarantee shall be reviewed and approved by the Board of County Commissioners. The performance guarantee shall be in a form acceptable to the Board of County Commissioners. 4. Prior to recording the plat map: a. A recorded exemption shall be reviewed and approved by the Department of Planning Services. As part of the recorded exemption application materials, evidence shall be submitted that the land split with the property to the east is in compliance with the Weld County Subdivision Regulations. b. The performance guarantee to ensure installation, and completion of the approved screening and soil erosion control plans shall be filed with the Clerk to the Board for the proper amount. The guarantee shall be returned to the 911287 Page 3 RE: USR - ZADEL applicants or released after the improvements have been satisfactorily completed. Should the improvements not be completed within 120 days from the date of approval of the Special Review Permit by the Board of County Commissioners, the County shall take corrective action to ensure compliance with the approved plans and the guarantee shall be forfeited. 5. Within 30 days of approval by the Board of County Commissioners an I.S.D.S. evaluation on all existing septic systems shall be necessary, prior to issuing the required septic permits on the existing systems. 6. A bathroom with adequate toilet facilities serviced by an individual sewage disposal system, is required for the proposed facility and the system shall be designed by a registered professional engineer and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 7. A zoning permit for temporary use during construction shall be applied for and approved for the existing mobile home prior to the issuance of a building permit for the site constructed dwelling. 8. The existing mobile home shall be removed from the Special Review Permit Area within 30 days of occupancy of the site constructed dwelling. The Site Specific Development Plan and Special Review Permit is for a commercial use (excavating contractor shop) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 4. Any required emissions permit shall be obtained from the Air Pollution Control Division, Colorado Department of Health for fugitive dust and odors. 5. No permanent disposal of wastes shall be permitted at this site. 6. All waste materials shall be handled, stored, and disposed of in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 7. Fugitive dust shall be controlled on this site. 8. The maximum permissible noise level shall not exceed the industrial limit of 80 dB(A), as measured according to 25-12-102, Colorado Revised Statutes. 9. The approved screening and soil erosion control plan shall be maintained at all times. Any dead or dying plants shall be replaced within the next planting season with substantially similar kind. 10. Weld County Road 19 shall not be used as a haul route. 11. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 12. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 13. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 15. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 16. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards.
