The proposed change of zone has been reviewed on behalf of the Weld County Department of Public
Works. Staff comments made during this phase of the application process may not be all-inclusive, as other
issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Planned Unit Development (PUD) Change of Zone request for E (Estate) Zone District
uses and certain A (Agricultural) Zone District uses, specifically allowing for one (1) second single-family
home per lot and the allowed animal units per lot.
This project is north of and adjacent to CR 74 and is west of CR 29.

ACCESS
Weld County Public Works has reviewed the application materials related to access.
The parcel has an existing permitted residential access onto County Road 74. This is the proposed access
for the internal road of the planned unit development. This proposed access does not meet the Minimum
Access Spacing Criteria, as specified in Table 1 below.
The applicant submitted a variance request to the Minimum Access Spacing Criteria so that the existing
residential access point could be used for the development access location.
After review of the variance request, it was determined that the existing access location (AP13-00064),
even though it does not meet the Minimum Access Spacing Criteria as specified in Table 1 of Sec 8-14-
30 (i.e. 1,320 feet), will be accepted. A new access permit shall be obtained as the use will be upgraded
to a "development access" for an internal road. — Sec.8-14-40. B. Please note that this access location is
included in the CR 74 Access Control Plan as "residential." Future use will be limited to "residential."

Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please
refer to Chapter 12 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 74 is a paved road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as an arterial road, which requires 140 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld
County Code, Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware
that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
County Road 74 is considered adequate in functional classification, width, and structural capacity to meet
the potential traffic requirements.
It is noted that CR 74 is subject to an Access Control Plan that can be found at the following location:

Per Chapter 8, Article 13, Section 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgov.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
INTERNAL ROAD
The Weld County Code specifies Sec 27-2-20 A. All PUD developments will be served by an internally
paved road system according to County standards.
The internal road system shall include the required right-of-way per and meet all standards of Chapter 8 of
the Code.
TRAFFIC
Latest Average Daily Traffic (2020) on this section of CR 74 counted 3,744 vehicles per day with 14%
trucks. The 85th percentile speed is 60 mph.
A traffic narrative was submitted with the application. The narrative predicted typical residential traffic that
would evenly travel County Road 74 (i.e. 50% to the east and 50% to the west).
No other traffic information is needed.
CONDITIONS OF APPROVAL
The PUDZ plat shall be amended to delineate the following:
1. County Road 74 is a paved road and is designated on the Weld County Functional Classification
Map as an arterial road which requires 140 feet of right-of-way at full buildout. The applicant shall
delineate on the site plan the existing right-of-way. All setbacks shall be measured from the edge
of right-of-way. This road is maintained by Weld County. (Development Review)
2. The proposed internal road system, that delineates right-of-way width, road surface width and
depth, and access to public right -of- way, that meets the requirements of Chapter 8 of the Weld

3. Show and label the approved access location, width, and the appropriate turning radii on the plat.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. Weld County will not replace overlapping easements located within existing right-of-way or pay to
relocate existing utilities within the existing County right-of-way. (Development Review)
3. The access on the site shall be maintained to mitigate any impacts to the public road including damages
and/or off -site tracking. (Department of Pu)
4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Department of Public Works)
5. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

Environmental Health Services has reviewed this Planned Unit Development (PUD)
Change of Zone request for E (Estate) Zone District uses and certain A (Agricultural)
Zone District uses, specifically allowing for one (1) second single-family home per lot
and the allowed animal units per lot.
Proposed Lot B is served by North Weld County Water District by existing meter 363.
The application indicates North Weld Water District will provide water to proposed Lot A.
A letter from the District, dated April 5, 2021, was included in the application and states:
"1.The District is able to provide water service to the Property, contingent upon all
requirements of the District being satisfied. If all District requirements, including all
contracts, have not been satisfied and completed with the District within 1 year of the
date of this Letter, the District may refuse to supply water to the Property. After 1 year, it
should be understood that the District reserves the right to refuse water service, if raw
water is unavailable, and/or pipeline or water treatment capacity is not capable of
providing water service to the above -described property."
The building department requires proof of adequate water when a permit is applied for
and either a copy of an issued well permit or a copy of a paid water tap agreement, if
served by a public water district, is required with the submittal.
There are two existing residences located on proposed Lot B. On -site wastewater
treatment systems (OWTS) provide separate sewer provisions to each residence. SP -
9700122 is permitted for two bedrooms and SP -1300048 is permitted for 3 bedrooms.
A new OWTS will provide sewer when a home is constructed on proposed Lot A.

We recommend the following appear as notes on the Change of Zone plat:
1. Water service may be obtained North Weld County Water District.
2. The parcels are currently not served by a municipal sanitary sewer system.
Sewage disposal may be by On -site wastewater treatment systems (OWTS)
designed in accordance with the regulations of the Colorado Department of
Public Health and Environment, Water Quality Control Division, and the Weld
County Code in effect at the time of construction, repair, replacement, or
modification of the system.
3. Activity or use on the surface of the ground over any part of the OWTS must be
restricted to that which shall allow the system to function as designed and which
shall not contribute to compaction of the soil or to structural loading detrimental
to the structural integrity or capability of the component to function as designed.
