PLANNING QUESTIONNAIRE
Answer the following questions per Section 23-2-260. A, B, C & E of the Weld County Code. Please type
on a separate sheet. If a question does not pertain to your proposal, please respond with an
explanation — do not leave questions blank.
1. Explain the proposed use and business name.
This proposal is to add a new use to the existing 1MUSR18-17-0024 which would allow for truck expo
shows, 100x100 asphalted area for truck burnout, live music, and an area for ATV off road course on
about 10 acres of the 80 -acre parcel which its current use is a horse racing facility. Business name
will be Takuacheland which is a term identified in the truck scene community. It is not envisioned for
the new use and horse racing to take place simultaneously.
The site is proposed to host a maximum of 5 events in a 6 -month seasonal period dating from May to
October. One event if any per month is envisioned at this time. The number of spectators in each event
is expected to reach no more than 1,000. The 1,000 include trash crew, employees, security and
emergency personnel.
Truck Expo consists of trucks parked in designated areas to showcase vehicle.
The 100x100 asphalted burnout pit will provide a safe and enclosed area where participants may
burnout truck.
A mobile stage for live music performances will be brought on to premises for the duration of the event
and will be stationed directly North of the burnout pit area. The burnout pit will be used as a dance floor
once live music starts and at that time vehicles will no longer be allowed inside the burnout pit. A
designated enclosed area for ATVs is proposed West of the burnout pit as shown on map where a
course can be driven on.
Licensed food vendors are proposed to serve food during the events. Trash containers will strategically
be placed throughout the property to ensure proper disposal of trash. Trash crew will be hired to pick
up trash throughout the property during and after the event as well as surrounding roadways leading to
property to prevent littering.
Contracted insured security company is proposed for all events which main focus will be to
inspect vehicles as they come in the property to ensure that no alcohol nor weapons are brought
in and to provide safety and wellbeing of all spectators, employees and event participants. The
number of security personnel on -site will be two (2) security personnel for the first one hundred
(100) participants and one (1) additional security professional for each additional fifty (50)
participants.
Alcohol will be sold on property as property has a current Alcohol license with the State of Colorado
Department of Revenue. Liquor license number: 03-11931 which authorizes malt, vinous and
spirituous liquor. Standby ambulance service with EMTs will be contracted to be present onsite
throughout the duration of the event by Banner Health or UC Health as used for horse racing facility.

2. Explain the need for the proposed use.
As a local truck show event organizer, it has been brought up to my attention by Denver police
department the need to have a place where truck meets can be held to prevent further
property trespassing and accidents due to a non -existing location for such meets to take place.
3. Describe the current and previous use of the land.
The current use of the land is as described in approved 1MUSR18-17-0024 — Which states: It is approved
for recreational facility uses, including racetracks and racecourses (Used for Horse Racing). No more
than 24 weekend events per year, with adequate security/emergency personnel, restrooms, and water
accessible to the patrons.
4. Describe the proximity of the proposed use to residences.
Closest residence is ± 4,175' East from proposed use. Owner - CRAIG STUART KUHLMAN, 46810
COUNTY ROAD 39.
5. Describe the surrounding land uses of the site and how the proposed use is compatible with
them. The uses of the site will be compatible with the existing surrounding land uses.
The adjacent lands consist of pastures and crops. The closest residence is approximately three
quarters of a mile east of the site. There is two (2) USR's within one mile of this site.
SUP -298 for gravel mining is located southeast of the site.
USR 11-0020 for Mineral Resource Development and located southwest 1 parcel. The Parcel directly
West is a unpermitted gravel pit owned and ran by Weld County Public Works. The site is in a remote
location and is not expected to negatively impact surrounding property owners.
6. Describe the hours and days of operation (i.e. Monday thru Friday 8:00 a.m. to 5:00 p.m.).
Saturday or Sunday - 8:00 a.m. - 8:00 p.m. Through the months of May to October. There will be 5 (1)
day events per year.
7. Describe the number of employees including full-time, part-time and contractors. If shift work
is proposed, detail number of employees, schedule and duration of shifts.
Up to 20 part-time employees are proposed to work during each event. These employees include trash
pick up crew, security, emergency personnel and management. Four full time employees are proposed
to manage and operate the facility.
No shift work is proposed.
8. Describe the maximum number of users, patrons, members, buyers or other visitors that the
site will accommodate at any one time.
The maximum number of persons that the site will accommodate at any one time is 1,000 including
trash crew, employees, security and emergency personnel.

9. List the types and maximum numbers of animals to be on the site at any one time (for dairies,
livestock confinement operations, kennels, etc.).
No animals will be on site at any one time.
10. List the types and number of operating and processing equipment.
There is no operating nor processing equipment.
11. List the types, number and uses of the existing and proposed structures.
There are 3 existing structures which alcohol is sold out from and have been approved when alcohol
license was requested. No new structures are proposed. Temporary band stands will be put up for
the concert venues.
12. Describe the size of any stockpile, storage or waste areas.
No stockpile, storage or waste areas are proposed on property.
13. Describe the method and time schedule of removal or disposal of debris, junk and other
wastes associated with the proposed use.
Employees to clean during and after events. Disposal of debris, junk and other wastes associated with
the proposed use will be removed by a third -party garbage disposal company which will collect on the
following business day.
14. Include a timetable showing the periods of time required for the construction of the
operation. Property as of now is ready for use. No construction is required.
15. Describe the proposed and existing lot surface type and the square footage of each type
(i.e. asphalt, gravel, landscaping, dirt, grass, buildings).
There is an 100x100 asphalted area which is the necessary dimensions needed for burnout competition
and a small ATV course is already in place which is dirt. Parking area and all outstanding surfaces are
covered by dirt, mowed grass and gravel. Parking and drive surface are a short grass, as approved in
the previous MUSR.
16. How many parking spaces are proposed? How many handicap -accessible parking spaces
are proposed?
The same 400 parking spaces are proposed that are currently approved for the horse racing facility
with 10 stalls meeting ADA standards.

17. Describe the existing and proposed fencing and screening for the site including all parking and
outdoor storage areas.
The entire site is enclosed in wire fencing. Pipe fencing lines the current horse track, an
additional fencing separates the trailer parking area from the spectator parking.
Fencing that runs through the far West area of the property will separate the ATV area from the
truck expo parking and burnout pit area.
No screening or outdoor storage areas are proposed as the events are 1 day only with 5 events
planned per year.
18. Describe the existing and proposed landscaping for the site. Open land is the existing landscape on
site. No additional landscaping is proposed.
19. Describe reclamation procedures to be employed as stages of the operation are phased out
or upon cessation of the Use by Special Review activity.
Upon termination of the proposed use, the property can be used solely for agricultural purposes. The
100'x100' burn out pad will be removed and reseeded w/ native prairie grass.
20. Describe the proposed fire protection measures.
Nunn Fire Protection District provides fire protection to the site.
Two large water tank trucks will be on premises as well as commercial grade fire extinguishers. The
site (short grass) can be watered before event if extremely dry conditions exist.
21. Explain how this proposal is consistent with the Weld County Comprehensive Plan per
Chapter 22 of the Weld County Code.
ARTICLE 11- Principles, Goals, and Objectives
Sec. 22-2-10. - Guiding principles.
The following Guiding Principles are the foundation for land use policy in the County. All of the
Goals and Objectives within the Weld County Comprehensive Plan are adopted with the intent
that they are consistent with the Guiding Principles.
A. Respecting Our Agricultural Heritage. Weld County has an agricultural heritage built upon
the hard work of pioneers and farmers on traditional family farms. Weld County is now one of
the most economically productive agricultural counties in the nation. The Weld County Right to
Farm Statement and the Goals and Objectives in this Plan support the importance of agriculture
in the County.
The proposed uses on the site would not affect the use or appearance of the property,
between the proposed events and during the off season, the site could be utilized as pasture for
livestock grazing or support other agricultural activities.

B. Respecting Private Property Rights. One of the basic principles upon which the United States
was founded is the right of citizens to own and utilize property so long as that use complies with
local regulations and does not interfere with or infringe upon the rights of others.
The proposed uses on the site would have little to no impact on the adjacent properties as
they are undeveloped/vacant or have been developed as gravel pits.
1) The property on the west side of WCR 37, adjacent to the property, is a gravel pit
operated by Weld County Public Works.
2) A second gravel pit is located just southwest of the intersection of WCR 37 and
WCR 96,
3) A third gravel pit is located 1 mile east of the site on the south side of WCR 96.
4) The closest home is %+ mile to the northwest on WCR 98.
5) WCR 96, from WCR 33 to the site, has little to no residential traffic.
The closest incorporated town is Nunn, the site is located 3.01 miles from the most
southeastern corner of the town limits as measured from the Northwestern corner of the
property.
The proposed use would not interfere or infringe upon the rights of others.
C. Promoting Economic Growth and Stability. Land use policies have a significant impact on
economic conditions in the County and should be structured to encourage economic prosperity.
To ensure the continued strength of Weld County's economy, land use processes and
decisions
based on this plan shall be consistent and promote fiscally responsible growth.
The proposed use would bring people in from the surrounding areas to attend the proposed
events, thus spending in the surrounding communities would increase for goods and
services obtained by people attending the events.
No public improvements or increases in maintenance to the county road system will be
required. The 5 yearly seasonal events will have a smaller or lower impact on the local
roads than the present impact generated by the gravel trucks that now use the roads in this
area.
The site is located in the 2016 Enterprise Zone as defined by the Weld County Property
Portal.
D. Protecting Health, Safety, and General Welfare. Land use regulations and policies will
protect and enhance the health, safety, and general welfare of the citizens of Weld County.
Sec. 23-1-40. - Purpose and intent.
B. This Chapter is further intended to protect the public health, safety and welfare by:
1. Regulating activities and DEVELOPMENT in hazardous areas.
The site of the proposed use is not located in a hazardous overlay district or the

2. Protecting lands from activities which would cause immediate or foreseeable material
danger to significant wildlife habitat and would endanger a wildlife species.
The proposed use of the site is assumed to not affect any wildlife habitat or wildlife
species.
3. Preserving areas of historical and archaeological importance.
There are no known areas of historical or archaeological importance on this property.
4. Regulating, with respect to the establishment of, roads on public lands administered by
the federal government, this authority includes authority to prohibit, set conditions for or
require a permit for the establishment of any road authorized under the general right-of-
way granted to the public by 43 U.S.C. 932 (R. S. 2447) but does not include authority to
prohibit, set conditions for or require a permit for the establishment of any road
authorized for mining claim purposes by 30 U.S.C. 21 et seq., or under any specific
permit or lease granted by the federal government.
The proposed use would utilize the existing county road system. No additional
roadway improvements will be required. The site has three approved access points.
Only one of these access points is being utilized for access to the site for events.
5. Regulating the location of activities and DEVELOPMENTS which may result in
significant changes in population density.
The proposed use does not affect the population density in area or at the site.
6. Providing for phased DEVELOPMENT of PUBLIC services and facilities.
No new public services or facilities are required for the proposed use at the site.
7. Regulating the USE of land on the basis of the impact of land USE changes on the
community or surrounding areas.
1) The proposed uses on the site would have little to no impact on the adjacent
properties as they are undeveloped/vacant or have been developed as gravel pits.
2) The property on the west side of WCR 37, adjacent to the property, is a gravel
pit operated by Weld County Public Works.
3) A second gravel pit is located just southwest of the intersection of WCR 37 and
WCR 96,
4) A third gravel pit is located 1 mile east of the site on the south side of WCR 96.
5) The closest home is 1/z+ mile to the northwest on WCR 98.

At this time, a Major Amendment to the existing 1MUSR18-17-0024 is in process for
the proposed additional site events.
Sec. 22-2-30. - Land use goals and objectives.
C. Harmonize development with surrounding land uses.
1. Transition between land use types and intensities with buffers. Uses that are incompatible
with existing uses must be able to mitigate conflicts.
The proposed uses on the site would have little to no impact on the adjacent properties as
they are undeveloped/vacant or have been developed as gravel pits.

RECREATIONAL FACILITIES: The following classes of recreational facilities have the
following meanings:
c. COMMERCIAL RECREATIONAL FACILITIES: Includes, but is not limited to,
bowling alleys, health spas, swimming pools, tennis courts, miniature golf facilities
or WATER SKIING operated on a COMMERCIAL basis by the paying public.
COMMERCIAL RECREATIONAL FACILITIES do not include rodeos, roping
arenas, RACING FACILITIES, or SHOOTING RANGES.
The proposed truck events in the burn -out pit would fall into this type of use as it is similar
to water skiing on a commercial basis by the paying public.
J. EVENT FACILITIES not agriculture -related.

EVENT FACILITY: A USE providing a gathering space for rent for weddings, business
meetings, and similar events not open to the general public.
The proposed live music should be accounted for in this use category.

RACING FACILITIES: An establishment where animal, motorized vehicle, or bicycle races are
conducted outdoors, including ACCESSORY BUILDINGS or USES, such as spectator seating,
food vendors, and parking, but excluding facilities on PUBLIC SCHOOL property, tracks
exclusively for pedestrians, and facilities not open to the public.
The existing horse racing events and the proposed ATV track fall into this category or use.
23. Explain how this proposal will be compatible with future development of the surrounding
area or adopted master plans of affected municipalities.

25. Describe any irrigation features. If the proposed use is to be located in the A (Agricultural)
Zone District, explain your efforts to conserve prime agricultural land in the locational decision for
the proposed use.
No irrigation features are proposed. The surrounding land is mainly a grazing land that does not do
well as agricultural crops. This area is underutilized in the agricultural scene and may also be part of
the CRP.
26. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal is
located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites Overlay
Districts) or a Special Flood Hazard Area identified by maps officially adopted by the County. This
proposal complies with Article V and Article XI of Chapter 23, of the Weld County Code. The
property is not within the Geologic Hazard Overlay District, a Special Flood Hazard Area or the
Airport Overlay District.
This parcel is also located in the enterprise zone. Which allows for more leniency in the area for
an enterprise.

98 is the main access point for events and is located 190'± from the edge of road.

There are no existing accesses on adjacent parcels and one existing access on parcel located on the west
side of WCR 37. This access is located about 1400'± from the intersection of WCR 37 and WCR 96. The
access is for Weld County Public Works gravel pit and is not permitted at this time.

There are no difficulties seeing oncoming traffic from existing access due to the flat nature of the

of public and private property. No stormater detention will be required for sites that meet any
of the following conditions.

All storm water flows, offsite and onsite, flow in a southeasterly direction as observed from the
Topographic information obtained from the Weld County Information Portal, as attached,
tormwater flogs from the Forth, native grasses, onto the site, onsite flows continue to the
southeast at approximately 0.5% and flow off the site into the WCR 96 ROW. No known
previous drainage problems have occurred at the site. No irrigation facilities exist on or adjacent
to the site.

2) An ATV course, no racing of ATVs is proposed, through research, it was determined that the sound levels of an
AN range from 70 db to 100 db. The ATV course is to be located on the western portion of the site.
3} A concert venue, from the research that has been performed, the concert will be the loudest of the three
activities, 1.10 db is for a large Rock Concert and assumes crowds of 5,000 or more. The proposed use will be
crowds up to 1,000, it can be assumed that the noise levels will be somewhat lover than the published value of
110 db, however the value of 110 db is being used for this noise report with some assumptions. From the
information provided the concert venue is located in a central area of the site, x.,595' from the north property
line, 456! from the cast property lime, 955' from the south property line and 915' from the crest property line.
"Burn -out Pit"
Eloise calculation for the burn -out pit have not been calculated as the pit is in the same location as the concert venue,
please see the concert venue noise calculations as the concerts produce higher sound levels.
"ATV Course"
Noise calculations are being provided to determine how close the ATV course can be placed next to the western
property line. These calculations assume that the ATVs will be spade out with a distance of at least 2.5! between ATVs.

25-12-103 - Maximum permissible noise levels:
(1) Every activity to which this article is applicable shall be conducted in a manner so that any
noise produced is not objectionable due to intermittence, beat frequency, or shrillness. Sound
levels of noise radiating from a property line at a distance oftwenty-five feet or more therefrom
in excess of the db(A) established for the following time periods and zones shall constitute prima
facie evidence that such noise is a public nuisance:

(7) This article is not applicable to the use of property for purposes of conducting speed or
endurance events involving motor or other vehicles, but such exception is effective only during
the specific period of time within which such use of the property is authorized by the political
subdivision or governmental agency having lawful jurisdiction to authorize such use.
(8) For the purposes of this article, measurements with sound level meters shall be made when
the wind velocity at the time and place of such measurement is not more than five miles per
hour.
(9) In all sound level measurements, consideration shall be given to the effect ect of the ambient
noise level created by the encompassing noise of the environment from all sources at the time
and place of such sound level measurement.
(10) This article is not applicable to the use ofproperty for the purpose of manufacturing,
maintaining, or grooming machine -made snow. This subsection (10) shall not be construed to
preempt or limit the authority of any political subdivision having jurisdiction to regulate noise
abatement.
(11) This article is not applicable to the use of property by this state, any political subdivision
of this state, or any other entity not organized for profit, inclining, but not limited to, nonprofit
corporations, or any of their lessees, licensees, or permittees, for the purpose of promoting,

This memorandum is a traffic impact study (TIS) for the proposed Imperial Horse Facing
Facility located in the northwest quadrant of the WCR96NVC R37 intersection in VVe Id County. The
site location is shown in Figure 11 The scope of this TI S was discussed with Evan P i n kham, Weld
County Public works. This memorandum presents a narrative of the trip activity and the impact on
the key vveld County roads in the area.
The site plan, as provided by the applicant/operator, is shown in Figure 2. The Imperial
Horse Facing Facility (IHRF) will operate on weekends (Saturday or Sunday), weather permitting.
According to information provided by the applicant/operator, races would occur on Saturday or
Sunday on a given weekend, but not on both days on a given weekend. There are nine potential
racing months in a given year, with two race days in a given month. This results in 18 race days per
year. There will be five large everts, which could draw up to 200O spectators. There will be 13
typical everts that will draw 200-500 spectators, Spring and summer hours of operation will be 10
am to 7 pm (g hours). The fall hours of operation will be 10 am to 4 pm (0 hours). For analysis
purposes, a race day will last 8 hours.
According to the project app! ica ntioperator f the 13 typical events will draw 200-500
spectators (average 350). An automobile occupancy of -4 persons per vehicle (use 3.5) results in
100 vehicles at the site. This results in 200 trip ends related to spectators. There will be two races
per hour. These can be 2 -gorse races or 4 -bourse races. For analysis purposes, it is assumed that
each typical event race will have 3 participants. This results in 48 participant vehicles or 96 trip ends
on a typical event day. It is estimated that there will 15 event staff, resulting in 30 trip ends. The
total trip generation for a typical event will be 326 daily trip ends (200+96+30).
The five large events will draw up to 2000 spectators. An automobile occupancy of 3.4
persons per vehicle (use 3.5) results in 572 vehicles at the site. This results in 1144 trip ends
related to spectators. There will be two races per hour. These can be 2 -horse races or 4 -bourse
races. For analysis purposes' it is assumed that each large event race will have 4 participants. This
results in 64 participant vehicles or 128 trip ends on a large event day. It is estimated that there will
20 event staff, resulting in 40 trip ends. The total trip generation for a typical event will be 1312 daily
trip ends (1144+128+40).
Since both race events occur infrequently it a given year, the trip generation was annualized
over the entire year (365 days). The typical event will generate 4,230 trip ends in a given year [(320
trip endslevent)('13 events/year) _ 4,238 trip ends/year]. The large event will generate 6,560 trip
ends in a given year [(1312 trip ends/event)(5 events/year) = 6,560 trip ends/year]. The total race
event related traffic is 10,798 trip ends in a given year. The traffic annualized over the year is 30 trip
sends per day [(10,798 trip ends/year)/(365 days/year)].
The primary/preferred travel route to/from the IHRF will be via
US$5/WCR90JWCR38/WCh96. Weld County Road 90 is paved. Weld County Road 39 is paved
from WCR90 to WCR94 (2 miles) and has a gravel surface between WCR94 and WCR96 (1 mile).
Weld County Road 96 has a gravel surface between WCR39 and the site entrance (0.8 miles).
Daily traffic counts, on the gravel segments of this travel route, were provided by Weld
County as shown in the Appendix. There are three counts from the year 2010 and one court from
the year 2015. On WCR39, the differences in the counts in the year 2010 reflect the gravel mining
operation on the crest side of WCR39. . Assuming that the traffic related to the gravel Trifling
operation has, been constant, the growth on WCR39 is 1.686 [("118)1(70) _ 1.686] in a five year
period. This is the equivalent traffic growth of 11 percent per year (compounded). The graphic in
the Appendix also shows the 2017 background daily traffic, the annualized site generated daily
traffic} and the 2017 total daily traffic on the key road segments.
It is my understanding that the traffic volume paving threshold is >400 vehicles per day and
the gravel treatment threshold is >200 vehicles per day. None of the key gravel road segments
exceed the paving threshold. The segment of WCR39, between WCR94 and the gravel miring
operation exceeds the gravel treatment threshold with the background traffic volume. The project
impact is less than 10 percent of the total daily traffic in this segment.
It is concluded that the Imperial Horse Facing Facility traffic will have minimal annualized
impact on the key roads in the area. Based upon the background wily traffic, the segment of
WCR39, between WCR94 and the gravel mining operation, should be treated for dust abaternent.

This memorandum provides traffic analyses related to the Imperial Horse Facing Facility

location is shown in Figure I. The Imperial Horse Facing Facility Traffic Impact Study (TIS),
dated .July 28, 2017t F was submitted to and accepted by Weld County Public Works. The purpose of
this analysis is the document conformance with the attendance/traffic in the cited TIS.
As stated in the T1S, typical events are expected to drain 200-500 spectators (average 350).
Given the expected auto occupancy (3-4 persons per vehicle), this would result in 200 trip ends per
event related to spectators. Participants and event staff would result in 126 trip ends per event. The
total trip generation was estimated at 326 trip ends per event.
The Imperial Horse Racing Facility began operations in early 2018. There were 12 racing
events in 2018 (March 3 to September 16) . Information, provided by the operator, indicated that the
average attendance at each event was 285 spectators. This is less than the estimated average
attendance shown in the cited TI. The range of actual attendance was 182-584 spectators, The
attendance that was greater than 500 spectators occurred once in 2018. Generally, the attendance
was less than 300 spectators.
It is concluded that the average attendance at the Imperial Morse Facing Facility was less
than that shown in the TI S. Therefore, event attendance and traffic at this site were in conformance
