ZONE DISTRICT TO THE A (AGRICULTURAL) ZONE DISTRICT - ISAIA AND KRISTA
ARICAYOS
A public hearing was conducted on January 26, 2022, at 10:00 a.m., with the following present:
Commissioner Scott K. James, Chair

The following business was transacted:
I hereby certify that pursuant to a notice dated November 9, 2021, and duly published
November 12, 2021, in the Greeley Tribune, a public hearing was conducted on January 5, 2022,
to consider the request of Isaia and Krista Aricayos, for a Change of Zone, COZ21-0004, from
the R-1 (Low -Density Residential) Zone District to the A (Agricultural) Zone District, at which time
the matter was continued to allow the applicants adequate time to meet the 30 -day notification
requirement for surrounding mineral owners. Bruce Barker, County Attorney, made this a matter
of record.
Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal
and stated the request is for a second home on the property. He described the sign posting of the
hearing, and relayed no correspondence was received from surrounding property owners (SPOs).
Mr. Nader shared the parcel has an existing, unpermitted access onto Northwest C Street, stating
to meet the minimum access criteria, an access permit shall be obtained, and no other access
is proposed. He relayed Northwest C Street is a paved, local road that requires 60 feet of
right-of-way. Mr. Nader explained the site is located within the three (3) mile referral area of the
City of Greeley and the Town of Eaton, and neither municipality had concerns with this request.
He described the subject lot, as displayed, and stated the property is currently zoned R-1
(Low -Density Residential) and the applicant is requesting a zone change to A (Agricultural).
Mr. Nader entered the favorable recommendation of the Planning Commission into the record as
written and displayed images of the site and surrounding views. In response to Chair James,
Mr. Nader confirmed there could be an impact on the Change of the Zone, due to the potential
increase of Uses allowed by Special Use Permits, or Zoning Permits for certain uses in the
A (Agricultural) Zone; however, such requests must go through a permitting process.

=� Lauren Light, Department of Public Health and Environment, stated the City of Greeley
provides water to the existing residence and the septic system is permitted for a three (3) bedroom
home. She shared three notes were suggested to be added to the plat that relate to water and
sewer service and staff has no other outstanding issues with this request.
Krista Aricayos, applicant, stated the original plan was to care of an elderly parent who has
since passed, so a second home is no longer needed; however, the family is heavily involved in
4-H and the A (Agricultural) Zone District provides for housing of animals to be in compliance with
the Weld County Code.
No public testimony was offered concerning this matter.
The Board reviewed the Conditions of Approval and made no changes.
In response to Chair James, Ms. Aricayos indicated she had reviewed, and agreed to abide
by, the Conditions of Approval, as presented.
Commissioner Saine moved to approve the request of Isaia and Krista Aricayos, for Change
of Zone, COZ21-0004, from the R-1 (Low -Density Residential) Zone District to the A (Agricultural)
Zone District, based on the recommendations of Planning staff and the Planning Commission,
with the Conditions of Approval, as presented. The motion was seconded by Commissioner Buck,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:42 a.m.
This Certification was approved on the 9th day of February, 2022.
