HomeMy WebLinkAbout20221986.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, JULY 13, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, July 13, 2022, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: Commissioner Buck moved to approve the Minutes of the Board of County Commissioners meeting of June 29, 2022, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. —�-- CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on June 29, 2022, as follows: 1) USR22-0005 — Juan Antonio Garcia Ramirez, and 2) 2MJUSR21-02-1343 — Ready Mixed Concrete Company and Raptor Materials, LLC. Commissioner Moreno seconded the motion, which carried unanimously. PUBLIC INPUT: No public input was given. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion, and it carried unanimously. • WARRANTS: 1) GENERAL WARRANTS - JULY 12, 2022: Commissioner Freeman moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously. ct Minutes, Wednesday, July 13, 2022 Page 1 2022-1986 BC0016 R� BIDS: 1) APPROVE BID #62200093, ELECTRONICS WASTE RECYCLING EVENTS — DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Christie Peters, Purchasing Department, stated two (2) bids were received, and staff recommends selecting the lowest bidder who met specifications, Onsite Electronics Recycling, LLC, dba I.T. Refresh, for two events, with the potential of a third event if funds allow, for a total amount not to exceed $65,500.00. Commissioner Saine moved to approve said bid. The motion was seconded by Commissioner Buck. In response to Commissioner Moreno, Ms. Peters explained how the calculations weretabulated per event. Chair James further explained if the $65,500.00 is not expended from the first two events, a third event will take place. There being no more discussion concerning this matter, the motion carried unanimously. NEW BUSINESS: 1) CONSIDER ASSESSED VALUATION OF ALL TAXABLE PROPERTY AND MASTER PROTEST LOG - REAL AND PERSONAL PROPERTY: Brenda Dones, Weld County Assessor, presented the 2022 Abstract of Assessment, a listing of Real, Personal, and Oil and Gas accounts that were protested at the Assessor level, a listing of the accounts that did not report a personal property declaration, and a listing of drilling rigs that were valued by Weld County, but apportioned to other counties. Ms. Dones explained 2022 was not a reappraisal year, and the aggregate of the changes resulted in an overall adjustment in the taxable value from $12.4 Billion in 2021, to $18.5 in 2022, which is a 49% increase in value. She relayed the 2022 County value is subject to change, pending property tax appeals, and summarized the appeal quantities and adjustment percentages. Lastly, Ms. Dones reported the value of drilling rigs, and confirmed the County Board of Equalization hearings will begin on July 28, 2022, and will conclude August 5, 2022, and described the subsequent appeal process. In response to Commissioner Freeman, Ms. Dones explained that Don Warden, Director of the Department of Finance and Administration, is reviewing the current Mill Levy, and at $19 Billion the County will be required to reduce the Mill Levy. She state a significant increase in oil and gas pricing and production is anticipated next year, which is anticipated to impact the overall taxable values on residential and commercial. Commissioner Moreno inquired about the current temporary Mill Levy reduction that is in place, and Ms. Dones confirmed that amount is a $7 Million reduction. Commissioner Buck requested the written report from Ms. Dones be sent to the Board to review. Commissioner Freeman moved to approve and accept said property valuation and protest log. Commissioner Moreno seconded the motion, and it carried unanimously. 2) CONSIDER CONTRACT ID #6121 FUNDING AWARD AGREEMENT FOR 2023 BEAT AUTO THEFT THROUGH LAW ENFORCEMENT (BATTLE) GRANT AND AUTHORIZE CHAIR TO SIGN: Sonja Kohlgraf, Sheriff's Office, stated the County applied for this BATTLE Grant, in the amount of $51,000.00, to cover the cost of a license plate reader and a mobile tracker. She further stated Weld County will receive $1,480.00, as its portion of the grant to cover the mobile tracker only, and this agreement names the Colorado State Patrol as the fiscal agent, for the term of July 1, 2022, through June 30, 2023. Commissioner Moreno moved to approve said agreement and authorize the Chair to sign, which was seconded by Commissioner Freeman, and it carried unanimously. 3) CONSIDER TEMPORARY CLOSURE OF CR 62 BETWEEN CRS 55 AND 57: Amy Mutchie, Department of Public Works, stated this closure is to begin July 19, 2022, and go through July 22, 2022, for replacement of an irrigation culvert. She further stated the detour route is gravel and paved, with water used for dust control on the gravel portion. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner Freeman, and it carried unanimously. Minutes, Wednesday, July 13, 2022 Page 2 2022-1986 BC0016 4) CONSIDER TEMPORARY CLOSURE OF CR 390 BETWEEN CRS 104 AND 105: Ms. Mutchie stated this closure is to begin on July 18, 2022, and go through July 22, 2022, for road construction. She further stated the detour route has one (1) mile paved, the gravel portion of the detour will use magnesium chloride for dust mitigation, and message boards are in place for advance notification to the public. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner Freeman, and it carried unanimously. e 5) CONSIDER TEMPORARY CLOSURE OF CR 390 BETWEEN CRS 104 AND 122: Ms. Mutchie stated this closure is to begin on July 25, 2022, and go through July 29, 2022, for the second phase of road construction. She further stated the detour route has both paved and gravel portions, with magnesium chloride for dust mitigation on the gravel portions, and message boards are in place for advance for notification to the public. Commissioner Moreno moved to approve said temporary closure. The motion was seconded by Commissioner Buck, and it carried unanimously. 6) CONSIDER QUOTE AND RENTAL AGREEMENT FOR GOLF CART SHUTTLES FOR 2022 WELD COUNTY FAIR AND AUTHORIZE CHAIR TO SIGN - MASEK ROCKY MOUNTAIN GOLF CARTS: Jenette Masarie, CSU Extension Services of Weld County, stated this quote and agreement is to rent golf carts for shuttle services at the 2022 Weld County Fair. Commissioner Freeman moved to approve said quote and agreement and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. 7) CONSIDER APPOINTMENT TO WORKFORCE DEVELOPMENT BOARD: Commissioner Moreno moved to approve said appointment. The motion was seconded by Commissioner Saine, and it carried unanimously. PLANNING: 1) CONSIDER PARTIAL VACATION OF FOUR -LOT RECORDED EXEMPTION, RECX18-0131, FOR REMOVAL OF LOT D - MST FARMS, LLC, C/O MICHAEL FREEMAN: Commissioner Freeman recused himself from hearing this matter. Michael Hall, Department of Planning Services, stated staff received a letter from the applicant requesting the removal of Lot D from Recorded Exemption, RECX18-0131, with the resulting parcel consisting of approximately 124 unplatted acres. Mr. Hall gave a brief overview of the property history and location, stated Lots A, B, and C are not a part of this partial vacation request, and further noted staff recommends approval. Mike Freeman, applicant, was present for questions, and clarified MST stands for Mike, Steve, and Theresa with him and his siblings as the owners of the Trust to this farm. No public testimony was offered concerning this matter. Commissioner Saine moved to approve said partial vacation. The motion was seconded by Commissioner Buck, and it passed unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
