SUBJECT: Zoning Districts DISCUSSION: Mr. Lorenson presented 'a proposed list on zoning districts with a break dour of each zone and the number of acres allowed in each. GENERAL DISCUSSION: Mr. Lorenson reviewed the items ,•to be on the afternoon ' agenda..and his recommendations. The regular meeting of the Weld County Planning Commission was held Monday, • - February 2, 1971 at 2:00 P. M. in the 4th floor-hearing room of the Court House. Recommended disapproval, primarily because of the distance from the adjacent residences. ,Mr. Collins presented 'his proposed kennel operation. Mrs. Collins stated that the neighbors that are 190' plan to apply for a kennel also. MOTION: By Mr. Bowles to take the matter under advisement. Second by Mr. Heitman. A unanimous vote of "Aye". Motion carried. • RESOLUTION: tape 331. Be it therefore resolved to recommend approval to the Board of County Commissioners subject to a limitation of 20 adult dogs. M. , on the application of Patrick Collins , of 2060 East 114th Place, Northglenn, Colorado , for a land use permit for a dog kennel operation to be located on a tract of land in the Southeast Quarter Section 12, Township 2 North, Range 68 West of the 6th P . M. Weld County, Colorado and more particularly described in metes and bounds and as was published in the Greeley Booster on February 12th and March 12,. 1971 respectively, and containing 10 . 07 acres more or less . Let the record also show that there is in the file six receipts testifying to the fact that certified mailoof .this hearing was sent to the adjacent landowners apprising them of this hearing giving them an opportunity to testify in favor or against this site approval . Let the record further show that the applicant Mr. Collins is present in person. And let the record still further show that there is on file recommendations from the Weld County Planning Commission recommending favorably to the site approval and which limitation can gone into in more detail principally by our Planning Director Mr. Lorensen. Anderson: , „ Mr. Collins „ do -you ,want to proceed. • Mr. Collins : My name is Pat Collins , I live at 2060 East -114th Place, Northglenn. I bought this 10 acres ,+two -years ago, and I think I was the second one to buy this land' that ,was sold• on 'metes . and -bounds ,' And I-,informed everybody 'then that I was going- to put in a few dogs .: And nobody said anything had• any opposition against it. And I asked these ,people down here at-,the ' zon.ing board about agricultural use :of land because. there 'wouldlbe no problem in getting the kennel . . So now I am petitioning for a kennel . What is use for 'agricultural use of land? Mr. Telep: .Well . Mr .• -Chairman, I • might add that this type of an operation is permissible, however, on the express permission of the approval of the Board of County Commissioners en 'many many factors- 'which I am sure . we well, go over - during the couse of this- hearing . This is a multi million dollar industry in Cpiorado. And •a .lotiof this money- goes out of this state to other breeders and I don' t know - I have only s-ix or seven -dogs ' at the present time ..- • ; l 'don' t•, know ;if-. I will get any biggen .than this , ' But :it is a big industry ,in Colorado . A lot of people from other states are taking a lot of money out of Colorado and as everyone knows ' there has been a little disbute at this last track -2- • • . Mr. Anderson: ', Your name is what? • ' - Mr . Felder:" Felder. • - Mr . Anderson: Felder . • Mr. Felder: Right. Mr. Anderson: What ' is. your address Mr. Felder? Mr. Felder : Its Route 4 Box 109 C. I live right beside - Mr. Anderson; Longmont. Mr. Felder: • Right. My property is right adjoins Mr . Collins . Mr . Telep : Your first name is Herman? Mr . Felder: • Right. Mr ., Telep :. -. Where do you live Mr . Felder? Mr. Felder; We live right there ; Mr. Anderson: How far do you live from the property? Are you right .next door to him on the west? Mr.. Felder : • From his house it would be a half /his runs of a mile from the house I would imagine- lengthways • down behind my property and I am facing the south road. So our property adjoins . • Collins :- But the dog runs are a half mile from his house. Probably a quarter mile. Mr. Ashley: You use to live in Denver is that • ' right? • •Mr. Felder : Right. I 've been' livin out there Eorthree years now and I don' t know why they - we notified here the County of our address change, probably sent the -mail to Denver and I don't know why it hasn' t been changed. =11= ' Mr . Anderson: Thats not the County, thats you notify the Post Office . Mr . Felder: But the Post Office Department has been notified. The address is for Denver . Mr. Telep : I would like to for the record Mr. Chairman, would you give me your address again Mr. Felder? Mr . Felder: Route 4 Box 109 C Mr . Telep : 109 C and thats out of Firestone? Mr. Felder : No its Longmont. Mr . Telep : Longmont, thats a Longmont- route okay thank you. Mr. Lorensen: The address that it was sent to was a Denver address because it was obtained from the tax notice . that is where they sent the tax notice . Mr. Felder : Yes to send the tax notice into Denver and I 've been living out there for three years and we did notify the County - when we moved. But it evidently hasn' t been changed. Mr . Anderson: Do you have anything more to say on this . Mr . Felder: No . Mr . Telep : Thank you Mr. Anderson: Is there anyone else who has something to say against it. Will you give your name and address please. Mr . Best: Floyd Best, Route 4 Box 109E, Longmont. My chief objection to the dog kennel, if we let the dog kennel plus the other one that is proposed Coors is also going to put in a packing plant out there . -12- If we make it commercial for one we will have to go commercial all the way . Is that not so? Mr . Telep ; No its not commercial - its a type- its a business allowed in an agricultural zone as far as the way we have Weld County zoned. Mr . Best: I see . Mr . Anderson;. Does your property adjoin his Mr. Best? Mr . Best; I am a quarter of a mile to the west of Mr. Felder ' s and I am across the road on the south side in Buffalo Acres . - Mr . Anderson: You' d be about a half of a mile from the kennel is that right? Mr . Best; Roughly a half a mile , yes sir . Mr. Anderson: Do you have anything else to add? Mr . Best : Nothing . Mr . Anderson: Is there anyone else? Mr . Vogt: My name is Curtis Vogt, Route 4 Box 109 B , ( V o g t) I would be approximately a quarter of a mile away I would believe . Ithink these other people pretty well wrapped it up but I would like to get it on record that I am opposed to it. Mr . Anderson: Do you object to the not audible Mr . Vogt: No , they are not a noisy as dogs Mr . Anderson: You wouldn 't care if they had some cattle out there? Mr . Vogt: A reasonable amount . -13- Mr . Anderson: Do you have anything else you would like to add? Mr . Vogt: No not really . Mr . Telep : HOw many, I would like to ask some questions - how much land do you own there? Mr . Vogt : Twelve acres Mr. Telep : You've got 12 acres you live out there . Mr . Vogt : Yes . • Mr. Telep : How long have you been out there? Mr. Vogt: Four years at least. Mr. Telep : Okay I have no further questions . Mr. Anderson: Do you have any questions Glenn, Mr . Billings : No • Mr. Ashley: I don' t. Mr . Anderson: Anyone else that wants Mr . Kokes : I am Robert Kokes , I don' t know I am opposed to the kennel because of the fact of the that I have lived oh way back in the farms area of Nebraska and people has had hounds there and you can hear them for a long ways off day and night and I just - well when you are working days you would like to sleep at night. Mr . Anderson: You live right next door . Mr. Kokes : It just adjoins us . Oh its not over a 100 feet I know to the end of the kennel . Mr . Anderson: Is there anything more you would like to add? -14- Mr. Kokes : Well, I don' t know - I guess thats about the only thing I would oppose really - is that - I dont know you have probably heard the hounds howl and they are just not like a regular dog . Boy they - they pierce . Mr. Collins : Your talking about trail hounds hounds these dogs do not have voices like trail/- we are talking. about an all together different bred of dogs . Your talking about trail hounds - like beegle hounds - and a trail hound your not talking about a grePhound. Mr. Kokes: Well now Mr. Collins: Nobody really understands - these runs that I've got are for puppies now - were not talking about kennels when this come up about a kennel - were talking about a racing dog that is kept in a building, whatever size building you;ve got I mean - if you've got racing dogs and you race, them at them at the race track these dogs are kept in a building. They have each got a crate in this building. This is the way racing dogs are kept to conserve all their energy, they don't want them running up and down runs, howling and going crazy. They are put in crates 32 inches by about 2 foot with paper in them. These dogs are turned out at 6:00 o'clock in the morning, these dogs are turned out again at 10:00 in the morning and again at 3:00 o'clock in the afternoon and at 9:30 at night and then they go to the race tracks. A racing kennel is never seen. That is the way racing dogs are kept. You can go to any kennel - if you go the race track its the exact same thing. These runs that I've got areLfor puppies. Now if we are talking about a racing kennel they are all kept in buildings and this building I plan to put on the very north edge of my property. If this goes through now. And they also I been around racing kennels - they've got a muzzle, they don't want them dogs howling and disturbing the other dogs that are sleeping -15- cause they have got torrace that night and this is the only way and this is the only way you can win and get some ,money. Mrs. Kokes: Are you going to keep thai muzzle on the dogs all the time, thats cruel. Mr. Anderson: Mam, you will have a chance to come back to the microphone Mr. Collins: And' they have got muzzles, they have a regular muzzle that they are turned out with everytime so they won't fight amoungst themselves and they have a racing muzzle that they putl:,tin when they race. And if you got a howling dog in the kennel they've got a muzzle so he can't open his mouth and howl. You keep that on him two or three days and he's broke from it. Now wetare talking about a racing kennel , now if we are talking about a kennel - I am telling you how these dogs are kept inside al-building 24 hours a day. All they are is turned out for them half hours or 45 minutes to relieve themselves and then they are put backn, and they go to the and down race track. They might be sprinted up /n the field andput back in the kennel. This is the way a racing kennel operates. Mr: Kokes: I would like to know how many dogs are going to be there at one time. have Mr. Collins: I have no idea, I might/these dogs and none of them might run and theyemight cost me:so much money I might be finished. What if - if you were in a business or was trying to start a business and got some good dogs and they was making money what' would-you do? Would you say well I am not going to raise anymore dogs. Blair Brothers out of Hialeah Florida took one hundred thousand dollars out of the State of Colorado last year. This is money that want out of the State. Now I am talking about income tax purposes for the State and everything else. We have got more to think about here than some howling dogs. -16- Mr. KokB t Well ya thats right, but there are a lot of; people around there but - the thing is before we ever bought out there - we had looked and we came up to the County Commissioners - the Planning Commission and we looked in to see if - there was too many things that was - - that was dog kennels and feedlots. We didn't want either one of them, and they said no thats zoned agriculture and they couldn't have it and thats it. Mr. Collins: But yet I have looked for five years and I found 10 acres and he said, when the 'man said - I said can you keep dogs here. It cost me - I put two down payments on other land and I let it go because there were covenants on it and they didn't want any dogs there. When he sold me that land hez;said you can havekdogs here. I called Greeley and I came up here once and they said I could have dogs on- this place. Now I have a $25,000.00 house and everything else - why I could have soldthe land - why does everybody sit: here until its time and then say. Audience: Wec.didn't know anything about it. Mr. Collins: You did know - I stopped out there and Mr. Telep: Mr. Chairman - we don't want to get into a dialogue here - Let this gentlemen express any further objection if he has any and then lets proceed. Mr. Anderson: Do you have anything else to say Mr. Kokes: I guess thats about it. Mr. Anderson: Is there anyone else in opposition. Please state yours name and address. Mrs. Felder: I live at Route 4 Box 109C. Mr. Telep: That was your husband that testified. Do you have anything to add other than what your husband did notaalready say? Mrs. Felder: I just can't remember just all he said -17- Mr. Telep: He said he was against the dog kennel. Mrs. Felder: I am against it - if he gets, it, I don't know how many dogs the will get and if the one besides him ,gets it 'its and that two kennels - 40 dogs; maybe - I don't if he is going to have 20 - but if he gets a permit there is no saying how many he can have and the,:+other guy gets a permit - 40 dogs out there - right directly: behind you place - thats a lot of dogs. That is. all I have got to say. Mr. Anderson: Is there anyone else in -opposition to the applicant? Anyone else who wants to add anything forgot something they said. Would you please come up to the microphone so they cangcget this on tape. Mrs. Koke: Theres things to be said here about the stock - if he wants his horses, he wants to have his cows - that is what we are out there for. We were just over there and we asked how many were allowed. So if it goes into that if he wants his'. horses and his cows he can have as many as he wants. And we just found out but if you have to feed more than 50 percent then you have too many animals on your place - if you have to buy more than 50 percent of your feed. And when he goes to sell if he gets those dog kennels and he decides he wants to sell .them dogs - I can't see whatwould keep that from being commercial because they just told us overtthere that if we took our animals to the auction and sold them - we would have to have a commercial license. They just told us that a while ago. So what is the difference between stock and the dogs I would like to know and how come his dog kennels wouldn't be commercial. If he should decide to sell thedogs - hes making money off,of that and we are not allowed to do it. Mr. Anderson: I think we will quit arguing the amount of money that is being made here. -18- Mr. Telep: I think what we are talking about is totally irevelant to the issue Mrs. Kokes: Well a lot of us want to know if he gets a dog kennel in here can' he - does he have' tio stick strickly to that dog kennel or can he use that as a commercial basis over there and go into whatever he wants to. Cause what he is doing is going into a business over there. Mr. Telep: The answeris no he has a dog kennel that doesn't mean he can go ahead and have a cattle feedyard if that is what you are talking about. Mrs. Kokes: And he can not sell anything out of his house- he can not go into any other kind of business except dogs Mr. Telep: Well I am notigoing to speculate as co counsel I can or can not do. There may be a lot of things that you may want to do in the future and you may have to come before this Board just like this Gentlemen also. Mrs. Kokes: But everybody out there - we are interested out there - we are raising a cow for milk, we are raising one for beef and maybe one or two - we have two children- for one apiece for agriculture - to go into 4-H. We are not out there to make money off of it. We are out there to live and have our homes and that is why everyone else is out there. Mr. TeleP: Yes I realize that - we don't want to get involved in an argument, here because you are posing some questions I could run out of answers. Now you are raising something for your 4-H, you know and I know that that critter is going to be sold it doesn't necessarily mean you are in the commercial business and I think maybe afforded things like that - because you should take involved care of your children - they should be/in 4-H and I am for itc 100 percent. What we are here rrying to establish is whether or not the Board of County Commissioners upon good cause shown can do one of two things grant this permit or deny it. This is where -19- we are at, okay. Mrs. Kokes: You are saying that this will be strictly for dogs and won't be anything else, for anythingelse commercial. You can not do anything but have his dogs Mr. Telep; Thats right. Mrs. Kokes: That was another Mr. Anderson: Thats all he is asking for at this time. Mrs. Kokes: Well, at this time. Mr. Telep: Thats right. Mrs. Kokes: Well that is what we are all worried about that ---- dog kennels would lead into anything else that he wanted to do through the home through business. Mr. Billings: We are not making a change of zone, this is a land use permit. Some of the things you are talking about you have to get a change of zone - for commercial or for industry of any kind - regardless of what it is. This is just a land use there are permit/num'erous things about that I can see here that are "A" permissible under/agriculture under land use permits. Dog kennels happens to be one Mrs. Koke: Is he going to - is there anyway - there is no way he can guarantee those dogs can be quiet. If he keeps those dogs confined as he says he is going to - isn't that cruel to just let them out for a short while to get exercise. Mr. Anderson: We can't argue that humane side of it. Mrs. Kokes: How about the noise - is he going to keep something on their months all the time to keep them quiet? Mr. Anderson: We got a lot of problems besides -worrying aboutidogs. Is there, anything else - do you have anything else. Mrs. Kokes: Thats it and oh his runs that he has out,cr�5z there so far are his runs - run over toward our property • Ine. He -20- has the dog houses there - there is a place where they stay, and his runs run right toward to the South. • ~—`.. Well, that's because right next to my runs. Mrs. Kokes: I don't care-are they out-are they going to be getting over on your property? Mr. Thlep : I don't know, I don't know. Mis. Kokes: raising alot of racket? Mr. Telep: Idon't know, I don't know. Mrs. Kokes: And how about your---water and your sabitation and stuff down there? Mr. Anderson: Is there anyone else in the room that has any- thing to say?
