TWO (2) RESIDENTIAL LOTS WITH E (ESTATE) ZONE DISTRICT USES AND CERTAIN
A (AGRICULTURAL) ZONE DISTRICT USES, SPECIFICALLY ALLOWING FOR
ONE (1) SECOND SINGLE-FAMILY HOME PER LOT AND THE ALLOWED ANIMAL
UNITS PER LOT - WESLEY AND SHAUN BASILIERE
A public hearing was conducted on May 25, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 11, 2022, and duly published April 13,
2022, in the Greeley Tribune, a public hearing was conducted to consider the request of
Wesley and Shaun Basiliere, for a Change of Zone, PUDZ22-0002, from the A (Agricultural) Zone
District to the PUD (Planned Unit Development) Zone District for two (2) residential lots with
E (Estate) Zone District Uses and certain A (Agricultural) Zone District Uses, specifically allowing
for one (1) Second Single -Family Home per lot and the allowed animal units per lot. Bruce Barker,
County Attorney, made this a matter of record.
Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal
requesting a Second Single -Family Home, per lot, and four (4) animal units per acre, per the
Agricultural bulk requirements. He described the sign posting and stated staff has not received
correspondence from surrounding property owners (SPOs). Mr. Nader relayed the Development
Review comments of February 16, 2022, indicating the parcel has an existing, permitted
residential access onto County Road (CR) 74, which is the proposed access for the internal road
of the Planned Unit Development, and a variance request has been submitted and accepted for
the minimum access spacing criteria. He stated CR 74 is a paved, arterial road which requires
140 feet of right-of-way, a Traffic Narrative was submitted with the application, which indicated
typical residential traffic, and CR 74 is adequate in functional classification. Mr. Nader explained
the proposed PUD is located within the three (3) mile referral and Coordinated Planning
Agreement Boundary area of the Town of Severance, and their referral stated no comments or
requests. Mr. Nader displayed images of the site and surrounding views, and entered the
favorable recommendation of the Planning Commission into the record as written.

ICJ Lauren Light, Department of Public Health and Environment, stated the proposed Lot 1 is
served by the North Weld County Water District, by an existing meter, the Water District will
provide water to proposed Lot 2, per a letter dated April 5, 2021, which stated after one year, they
may not be able to serve water; however, according to an updated email from the Water District
stated they will honor the letter. She relayed there are two (2) existing residences located on
proposed Lot 1, the second residence was approved, and there are two existing septic systems
which are permitted. Ms. Light stated the Department of Public Health and Environment has
suggested several notes for the plat related to water and septic, and staff has no concerns with
the request.
Wesley Basiliere, applicant, requested the Final Plan be Administratively approved, and the
Board concurred.
re No public testimony was offered concerning this matter.
IE The Board discussed the Conditions of Approval, in response to Commissioner Moreno,
Mr. Nader stated he believed the acknowledgement of requirements may be a payment in lieu of
land to Weld County School District RE -2, under Condition of Approval #1.A, and he will confirm.
The Board made no changes to the Conditions of Approval.
El Commissioner Buck moved to approve the request of Wesley and Shaun Basiliere for a
Change of Zone, PUDZ22-0002, from the A (Agricultural) Zone District to the PUD (Planned Unit
Development) Zone District for two (2) residential lots with E (Estate) Zone District Uses and
certain A (Agricultural) Zone District Uses, specifically allowing for one (1) Second Single -Family
Home per lot and the allowed animal units per lot, based on the recommendations of Planning
staff and the Planning Commission, with the Conditions of Approval, as amended. The motion
was seconded by Commissioner Saine, and it carried unanimously. There being no further
discussion, the hearing was completed at 10:13 a.m.
