HomeMy WebLinkAbout20221619.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, JUNE 13, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 13, 2022, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Controller, Chris D'Ovidio PUBLIC INPUT: No public input was given. .21 AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda, as printed. Commissioner Saine seconded the motion and it carried unanimously. n.:=. COMMISSIONER COORDINATOR REPORTS: Commissioner Buck reported she attended Accelerate Colorado in Washington, D.C., and met with elected municipal officials on behalf of Colorado. She further stated there were various speakers and members of Congress, including Colorado senators, who were also in attendance. • WARRANTS: 1) GENERAL WARRANTS - JUNE 9, AND 10, 2022: Commissioner Buck moved to approve the General Warrants, as printed. Commissioner Moreno seconded the motion and it carried unanimously. • 2) COMMISSIONER WARRANTS (PERRY L. BUCK) - JUNE 10, 2022: Commissioner Freeman moved to approve the Warrant, as printed. Commissioner Moreno seconded the motion, and upon a roll call vote, the motion passed four (4) to zero (0), with Commissioner Buck recused. Commissioner Saine seconded the motion, and upon a roll call vote, the motion passed four (4) to zero (0), with Commissioner Moreno recused. • BIDS: 1) PRESENT BID #B2200091, ADMINISTRATION BOARD ROOM BULLET RESISTANT PANEL INSTALLATION - FACILITIES DEPARTMENT: Christie Peters, Purchasing Department, stated three (3) bids were received and staff will make a recommendation on June 27, 2022. ▪ NEW BUSINESS: 1) CONSIDER CONTRACT ID #5896 TASK ORDER CONTRACT AMENDMENT #4 FOR TUBERCULOSIS PREVENTION AND CONTROL PROGRAM AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mark Lawley, Director of the Department of Public Health and Environment, stated this contract amendment is for the continuation of the Tuburculosis Prevention Program in Weld County. He further stated the term runs from July 1, 2022, through June 30, 2023, for the total amount of $50,000.00, in State funding. Commissioner Buck moved to approve said amendment and authorize the Chair to sign and submit electronically. The motion was seconded by Commissioner Freeman, and it carried unanimously. • 2) CONSIDER CONTRACT ID #5899 AMENDMENT #5 TO CONTRACT FOR IMMUNIZATION CORE SERVICES PROGRAM AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Lawley stated the purpose of the Weld County Immunization Program is to increase the inoculation rates of Weld County residents, thereby reducing morbidity and mortality of infectious diseases. He continued to report Weld County will be reimbursed $117,095.00 in federal funding, and an additional $150,392.00 in state funding, for a combined total amount of $26.7,487.00. Commissioner Moreno moved to approve said amendment and authorize the Chair to sign and submit electronically. Seconded by Commissioner Buck, the motion carried unanimously. (Clerk's Note: Subsequent to considering item #3, Commissioners Moreno and Buck amended their motions to correct the reference to Contract ID #5899.) • 3) CONSIDER CONTRACT ID #5911 AMENDMENT #1 TO TASK ORDER CONTRACT FOR HEALTH DISPARITIES AND COMMUNITY GRANT PROGRAM (HDCGP) FOR THRIVING WELD HOUSING AND LAND USE PROJECT, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Lawley stated housing is a significant public health concern, given the association between chronic stress with housing instability and unaffordability, in conjunction with negative health outcomes associated with over -burdened and overcrowded environments. Mr. Lawley stated funding is in the amount of $265,737.00, for the two (2) year period of this contract, and staff will work with communities and municipal governments to identify effective land use code modifications for affordable housing policies. In response to Commissioner Saine, Mr. Lawley confirmed this is all state funded. Commissioner Freeman moved to approve said amendment and authorize the Chair to sign. The motion, which was seconded by Commissioner Buck, carried unanimously. El 4) CONSIDER CONTRACT ID #5913 AMENDMENT #1 TO TASK ORDER CONTRACT FOR COMMUNITIES THAT CARE YOUTH SUBSTANCE ABUSE PREVENTION PROGRAM AND AUTHORIZE CHAIR TO SIGN AND SUBMIT ELECTRONICALLY: Mr. Lawley stated the Colorado Department of Public Health and Environment (CDPHE) provides substance use prevention funding, in the amount of $167,000.00, support local public health agencies through monies received from Marijuana Tax revenues. He further stated the funds will be used to support staff and efforts to implement the "Communities that Care" model to address youth substance abuse prevention, including marijuana, opioids, and alcohol. Commissioner Freeman moved to approve said contract amendment and authorize the Chair to sign and submit electroncially. Commissioner Buck seconded the motion and it carried Minutes, Monday, June 13, 2022 Page 2 2022-1619 BC0016 unanimously. 5) FINAL READING OF CODE ORDINANCE #2022-03, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION OF THE WELD COUNTY CODE (OIL AND GAS, RESOLUTIONS, AND PROCLAMATIONS): Commissioner Freeman moved to read Code Ordinance #2022-03, by title only. The motion was seconded by Commissioner Saine, and it carried unanimously. Bruce Barker, County Attorney, read the title for the record, and further stated there have been no changes since the Second Reading. No Public testimony was offered concerning this matter. Commissioner Moreno moved to approve Code Ordinance #2022-03 on Final Reading. The motion was seconded by Commissioner Buck, and it carried unanimously. El PLANNING: 1) CONSIDER PARTIAL VACATION OF TWO -LOT AMENDED RECORDED EXEMPTION, AMRE-192, FOR REMOVAL OF LOT A - LARRY AND LYNDA MOORE: Chris Gathman, Department of Planning Services, stated staff received a letter from the applicants requesting the removal of Lot A from Amended Recorded Exemption, AMRE-192, with the resulting unplatted parcel being approximately 80 acres. He gave a brief overview of the property history and location, and explained Lot B is not a part of this action, there are no existing improvements or access points on Lot A, and the applicant owns the adjoining 120 acres to the east. Mr. Gathman stated staff recommends approval, subject to the following Condition: 1) the applicant is to identify a proposed access point for the vacated parcel onto County Road 84 on the vacation plat. The proposed access shall meet spacing criteria from existing permitted access points onto County Road 84. Larry Moore, applicant, was present for questions and had nothing further to add. No public testimony was offered concerning this matter. In response to Commissioner Freeman, Mr. Gathman explained the reason behind the vacation of a Lot A, and noted many years ago the process was reversed from what it is today, with the largest lot being Lot A. Commissioner Buck moved to approve said partial vacation, with the Condition of Approval. The motion was seconded by Commissioner Saine, and it carried unanimously. El 2) CONSIDER PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RECX20-0046, FOR REMOVAL OF LOT B - RONALD AND TRINA ERBES: Maxwell Nadar, Department of Planning Services, stated staff received a letter from the applicants requesting the removal of Lot B from Recorded Exemption, RECX20-0046, with the resulting unplatted parcel being approximately 130 acres. He gave a brief overview of the property history and location, and explained Lot A is not a part of this action, and no easements are impacted by this request. Mr. Nader stated staff recommends approval. Loren Shanks, Engineering and Land Surveying, applicant representative, was present for questions, and had nothing further to add. No public testimony was offered concerning this matter. Commissioner Buck moved to approve said partial vacation. The motion was seconded by Commissioner Saine, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2022-03 was approved on Final Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
