SUBJECT: #B2200094 Liquid Application Tank Trailers Qty -2
Fleet Services and Public Works have reviewed all bids that were received for bid
B2200094 and recommends awarding the bid to Power Equipment Company as they are the
second lowest bidder that meets all specifications with no requirement of down payment or
quote expiration date, and delivery within 150 - 180 days after receipt of order. The bid is for
two 2022 Liquid Application Tank Trailers that are to be used by Public Works during the Gravel
Roads milling operation. The cost is $195,952.00 each, for a total of $391,904.00.

Even though the bid for B220094/Tank Trailer Liquid Applications Milling has not yet been awarded,
their quote expires today. Please see attached letter.
Although our boilerplate does not indicate a bid will be disqualified for requiring a deposit, Section 5-
4-60 of the County Code indicates, "In all cases, the County shall reserve the right to reject any and all bids. The County strives to
select the bid which is in the best interest of the County."

We are disappointed to hear that even though we were low bid by more than $25,000 and met the specifications
100%, Weld County intends to award this bid to the next bidder. There is nothing in the bid document that says
we will be disqualified for requiring a deposit. We are working through unprecedented times. Supply chain issues
and radical price increase risk can be mitigated to an extent but we need to adapt.
We have found success with many of our customers, some even in Weld County that are willing to adapt to the
new business environment. For example, when a plow truck is ordered, all the components that will be mounted
to the chassis are ordered immediately. Our customers are willing to pay for the equipment as it arrives to secure
pricing despite possibly waiting over a year for the chassis.
We have a long history of building trailers for Weld County and making sure that the delivered product is of the
highest quality and performs up to County standards. We have built tank trailers for many Colorado customers.
We have a strong local presence and have been in business in Colorado for over 54 years. We may be slower than
some at times, but we do what we say we are going to do and deliver a product that exceeds expectations. Most
recently we bid trailers over a year ago and were the only bidder. You didn't award that bid to us, went out to
rebid, entertained people out of state that had never worked with you before, sent out a new bid, awarded it to
them for $3,000 less than our rebid and now a year later they cancelled your purchase order saying they wouldn't
fulfill the order. These are different times and due to supply chain issues, we believe it would be to your benefit to
work with our company familiar to your needs and wants.
We urge you to please reconsider spending an extra $25,000 of taxpayer money and awarding the bid to the next
bidder, that hasn't supplied you with trailers in recent years. Our suppliers deposit requirement ensures that the
material will be purchased immediately for a guaranteed build. We have seen other vendors add surcharges to
orders at time of delivery. This deposit ensures that the price quoted is what will be invoiced. We will deliver the
trailers for the price bid within the time frame stated and will not come back to you with surcharges. Please
reconsider you award.
