.A-7(./X2 dc> RESOLUTION WHEREAS, a public hearing was held on April 30, 1973 in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of Duane A. Cato, Route 1, Box 82R, LaSalle, Colorado, requesting permission to locate a hog farm operation on the following described property, to-wit: Lot 14, Milton Lake Estates, First Filing, a part of Sections 12 and 13, Township 3 North, Range 65 West of the 6th P. M. , Weld County, Colorado, containing 20 acres, more or less, and, WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to locate said hog farm operation on the above-described premises, and WHEREAS, the said requested hog farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said hog farm operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the I3oard of County Commissioners, that the application of Duane A. Cato, Route 1, Box 82R, LaSalle, Colorado, to locate a hog farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct said hog farm operation and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That when said hog farm operation is completed same shall be limited to pen size as indicated on plans as submitted. 4. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Mr. Anderson introduced Dean Severin and welcomed him as a new member to the Planning Commission . • SUBJECT • Left Hand Water District DISCUSSION : Mr. Lorenson reported they had met with sgwq of the members and directors of the Left Hand Water Boartl ?equested a letter of commitment for water for any building permit in their district before the permit is issued . Permits have been issued and they were not able to serve them. This happened with the new Ramada Inn at DelCamino . Mr . Paul stated they plan to put in a well . Mr . Lorenson stated in all other areas the proof of water is required . Mr. Connell stated this would require an amendment to the• regulations . Mr . Lorenson stated these districts are asking for the cooperation of the Planning Commission . Mr. Weigand stated this would have to be a joint effort with the adjoining counties where these districts serve more than just Weld County . MOTION : By Mr. Weigand to recommend to the Board of County Commis- sions to require proof of water from the water districts be- fore a building permit can be issued and to coordinate this with the adjacent counties . DISCUSSION : On further discussion , Mr. Billings stated he will be . sending some letters to the water districts . SUBJECT : Proposed Comprehensive Plan DISCUSSION : Mr. Lorenson reported on a letter received from the Colorado Division of Planning commending Weld County and its Planning staff on the development of the Plan. Members of the Commission received letters from John Haley regarding the Plan and Mr. Lorenson stated he will respond, to the letter. Lorenson read the staff' s recommendations for denial : not compatible with surrounding land use and zoning , it would hinder the Town of Gilcrest ' s future expansion , it has been recommended for denial ,by the Health Department , the soil report indicates that drainage pockets around Gilcrest are in evidence and all lagoons built to hold runoff would have to be sealed to prevent contamination of underground water . Intensive agricultural use should be further separated from the urban growth areas . Mr. Dinner reviewed the proposed ex- pansion of the feeding operation and the previous history. The size and capacity of the proposed pens have been reduced to 18 pens and 4860 head. They have moved to be in compliance with the 660 ' set-back from the highway regulation . There will be landscaping and there is an adequate water supply . They have maintained good housekeeping techniques on the ex- isting lots . There will be dust control devices used through- out the entire area . There will be dikes to take care of any runoff water . Mr . Edw . Dill spoke in favor of the operation . It provides a market for their corn and in turn the feedlot provides fertilizer for the farmers in the area . Mr. Dinner stated the lagoons will be sealed . A petition was presented signed by the surrounding property owners approving the oper- a :icn . Mr . Glen, Paul stated he has had no complaint on the existing operations , however the State Air Pollution Commission has recommended denial . Mr . Henry Keiser spoke in favor of the operation . Mr. Sidney Strear reviewed their operations in Weld County and Boulder County . Mr. Dean Crosier stated he is from Gilcrest and wanted to reaffirm the opposition of the Town of Gilcrest . A letter was received from the Town of Gilcrest , stating they are opposed to the operation . MOTION : By Mr . Heitman to take the matter under advisement . Second by Mr. Clark . Mr. Sears stated this faeility has been sized to _ fit this project only, and has visited like , 871 r facilities and there was no odor. Prr. Olhausen stated Ron Schuyler and, Glen Paul have reviewed the proposed facility and have at Teast given tentative approval . It •is •design,ed to meet E . P .A. standards and State Health Department. Lorenson stated he recommended the preliminary plat be tabled as the County Commissioners are now considering Cimarron Hills and a group of proposed agricultural uses to be included as part of the Planned Unit Development . These same . proposals would be overlaying this subdivision and if they approve Cimarron Hills there is no reason not to approve this one . If the proposal is approved it is recommended it should be subject to one fire hydrant being placed on the north side _ of Lot 3 and a variance to the subdivision regulations be grunted concerning the. length of the road on the South . Mr . Lorenson stated the Subdivision Regulations do state that fire hydrants are not .required unless there are 10 or more lots h. wever , Mr . Bigbee is working on another subdivision adjacent to this which contains 8 lots , this one has 5 and Cimarron Hills with 19 lots and he felt they need the one fire hydrant and he would have to provide easements for emergency vehicles to get to the hydrant . The hydrant would be located on the ex- isting line . MOTION : By Mr . Elliott that the preliminary plat be approved subject to the approval of Cimarron Hills by the County Commissioners . Second by Mr . Rothe . If Cimarron Hills is denied , this appli - cation would be. denied . A vote of "Aye" by Anderson , Clark , Elliott , Heitman ,. Rothe , Severin and Weigand . Motion carried . The lot is 600 ' away from Gilcrest . Mr. Weigand stated if a precedent is set here , they will be opening the doors for other operations around the small communities . It was agreed they were trying to encourage the development of the towns and if this is approved , it is in opposition of what is trying to be accomplished . Lorenson reviewed the application , stating the -plan has - been approved by the Planning Commission and the County Commissioners . 'They wrote a resolution that the approval was contingent upon water and sewer. The PUD has not been recorded because these commitments had not been ful - filled . Mr. Sears indicates that he does have the water com- mitment . The PUD did not envision the placement of a sewage facility within it . If this is approved , a recommendation to change the PUD should be made to include this sewage system within it and the creation of a sewage district . The Plan showed a lake within the area and the lake was to drain the underground water and use it an an amenity and a clubhouse . was shown near it for'- the Home Owner' s Association . A school site was proposed on the opposite end of an open area which • let down to the lake area . If it is approved, he recommended that the District that would be formed have some wayfbeing absorbed by an existing district and not to continue as an individual district . There was discussion regarding a Regional sewer system. RESOLUTION: . Be it there .fare resolved to recommend approval to the Board of County Commissioners subject to merging with a reg- ional district when one becomes available , and to change the 7 :D to include the facility. I have reviewed the water supply for the pro- posed hog operation and have found that Mr. Cato has cancelled his domestic well permit #62970 and has obtained a commercial and domestic well permit #17093-F with an annual appropriation of 1.5 acre-feet. Mr. Cato stated''in his well permit application that for a 600 hog operation he would need 1325 gallons per day which is equivalent to 1.5 acre-feet annually. As to whether this is an adequate amount, I cannot question Mr. Cato's estimate and must say that he has to operate within the annual appropriation in that his well has a flow meter installed for verification. Evaluation is to determine the suitability of the area for a hog feeding operation. The area is mapped as deep, moderately coarse textured, well drained soil. The area has very little runoff and is not subject to flooding. All drainage or runoff from the feedlot would need to be diverted from the Neres Canal which runs through the Southeast part of the area.
