HomeMy WebLinkAbout20222363.tiffHEARING CERTIFICATION DOCKET NO. 2022-70 RE: PUBLIC HEARING TO CONSIDER DECLINING PARTICIPATION IN THE COLORADO PAID FAMILY AND MEDICAL LEAVE INSURANCE PROGRAM ("FAMLI"), AS AUTHORIZED BY C.R.S. § 8-13.3-522, AND TO DECLINE TO COLLECT EMPLOYEE PREMIUMS THROUGH PAYCHECK DEDUCTIONS FOR PAYMENT TO FAMLI FOR THOSE EMPLOYEES WHO ELECT FAMLI COVERAGE, PURSUANT TO C.R.S. § 8- 13.3-514(1), BY PERSONALLY PAYING TO FAMLI EMPLOYEE PREMIUMS IN A FASHION AND MANNER SIMILAR TO THAT REQUIRED OF SELF-EMPLOYED INDIVIDUALS A public hearing was conducted on August 15, 2022, at 9:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Clerk to the Board, Esther E. Gesick County Attorney, Bruce T. Barker Department of Human Resources Director, Jill Scott The following business was transacted: El I hereby certify that pursuant to a notice dated August 1, 2022, and duly published August 3, 2022, in the Greeley Tribune, a public hearing was conducted to consider declining participation in the Colorado Paid Family and Medical Leave Insurance Program ("FAMLI"), as authorized by C.R.S. § 8-13.3-522, and to decline to collect employee premiums through paycheck deductions for payment to FAMLI for those employees who elect FAMLI coverage, pursuant to C.R.S. § 8-13.3-514(1), by personally paying to FAMLI employee premiums in a fashion and manner similar to that required of self-employed individuals. Bruce Barker, County Attorney, made this a matter of record. Ryan Rose, Director of Administrative Services, stated a work session with the Board of County Commissioners, and notice to all employees was on August 2, 2022, concerning the FAMLI program approved in state-wide election in 2020. He reviewed what is allowed and stated the proposal to opt out is based on the determination that Weld County already provides comprehensive access to coverage, as reflected in the side -by -side comparison included in the record. Mr. Rose further stated, if Weld County participates in the program, an amount must be collected from each employee's base wage, as well as matched, with the actual benefit not starting until January 1, 2024, and the County would have to wait three (3) years to decline participation. He stated employees may still opt in and must pay their premiums directly to FAMLI, and detailed the additional requirements of the employee with assistance from the Department of Human Resources. Therefore, staff recommends opting out and reviewing participation annually. CC'. PE(3/hR/RR) c A CIsB) V27/22 2022-2363 PE0033 HEARING CERTIFICATION - APPROVE DECLINING PARTICIPATION IN THE COLORADO PAID FAMILY AND MEDICAL LEAVE INSURANCE PROGRAM ("FAMLI"), AND TO DECLINE TO COLLECT EMPLOYEE PREMIUMS THROUGH PAYCHECK DEDUCTIONS FOR PAYMENT TO FAMLI PAGE 2 In response to Chair James, Mr. Rose stated this is a brand-new program in Colorado, and today's action does not preclude the County from choosing to opt into the program in the future, once it is better vetted at the state level. He noted the website and certain criteria is still being built and developed. No public testimony was offered concerning this matter. Commissioner Moreno moved to approve declining participation in the Colorado Paid Family and Medical Leave Insurance Program ("FAMLI"), as authorized by C.R.S. § 8-13.3-522, and to decline to collect employee premiums through paycheck deductions for payment to FAMLI for those employees who elect FAMLI coverage, pursuant to C.R.S. § 8-13.3-514(1), by personally paying to FAMLI employee premiums in a fashion and manner similar that required of self- employed individuals. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 9:44 a.m. This Certification was approved on the 29th day of August, 2022.
