RESOLUTION
WHEREAS , a public hearing was held on Monday, November 8,
1971 , in the chambers of the Board of County Commissioners of Weld
County, Colorado, for the purpose of hearing the petition of Rieker,
Haney and Smith, c/o Lou Rieker, First National Bank Building, Greeley,
Colorado, requesting a change of zone concerning two tracts of land and
designated on submitted plat as follows , to-wit:
No. 1 : TRACT A - from "A" Agricultural District to "E-UD"
Estates Unit Development;
No. 2: TRACT B - from "A" Agricultural District to "H-UD"
High Density Unit Development, and
WHEREAS, the petitioners were present, and
WHEREAS , there was no opposition to the changes of zone , and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE , BE IT RESOLVED, by the Board of County
Commissioners , that the petition of Rieker, Haney and Smith, c/o Lou
Rieker, First National Bank Building, Greeley, Colorado, for changes of
zone concerning the following two tracts of land, to-wit:
No. 1: TRACT A - from "A" Agricultural District to "E-UD"
Estates Unit Development;
No. 2: TRACT B - from "A" Agricultural District to "H-UD"
High Density Unit Development;
said tracts being more particularly described as follows:
TRACT A: Proposed E-UD Development - A tract of land located
in the West Half of the Southwest Quarter (W 1/2 SW 1/4) of
Section 24, Township 5 North, Range 66 West of the Sixth
Principal Meridian, Weld County, Colorado and being more
particularly described as follows:
Commencing at the West Quarter Corner (W 1/4) of said Section

1 . That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2 . All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning
resolutions of Weld County, Colorado
3. Subject to the Greeley Code of Ordinances, providing that the
developer shall comply with all the rules and regulations of the City of
Greeley relating to drainage outside the city limits , including the payment
of drainage fees; and that contractual agreement shall be made providing

adequate water and sewer services which are necessary for the type of
development proposed for said tracts.
4. Subject to approval by the Utility Board for an additional 56
feet of right of way along the west side of the property on 35th Avenue.
5. Subject to providing for a sealed retention pond area of
approximately 5 acres.
6. That said changes of zone here granted are conditional only
for a period of twelve months from date hereof, on condition that developers
proceed with due diligence to begin development of the areas re-zoned and
submit plans for such development for the approval of the Weld County
Planning Commission; and that major construction shall commence thereon
within said twelve month period; otherwise, the County may take action
to re-zone the property to its present classification.
