CORRECTED LAKOTA LAKES (PF-594) TO ALLOW ONE (1) SECOND SINGLE
FAMILY DWELLING UNIT PER LOT IN THE PUD - LANDOWNERS OF LAKOTA
LAKES RANCH PUD
A public hearing was conducted on February 16, 2022, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated January 26, 2022, and duly published
January 28, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request
of the Landowners of Lakota Lakes Ranch PUD, for an Amended Planned Unit Development
Final Plan, PUDF21-0002, of Corrected Lakota Lakes (PF-594) to allow one (1) Second Single
Family Dwelling Unit per lot in the PUD. Bruce Barker, County Attorney, made this a matter of
record.
Diana Aungst, Department of Planning Services, presented a brief summary of the proposal
and the general location of the site. She stated 20 referrals were sent out, 12 agencies responded
and outlined the Little Thompson Water District (LTWD) referral comments, regarding water taps
for accessory structures. She mentioned the Department of Planning Services sent notice to
17 surrounding property owners (SPOs) and one (1) phone call was received, regarding the water
taps. She noted the site is within the three (3) mile referral area of the Towns of Windsor,
Johnstown and Milliken, the City of Greeley and Larimer County, and within the Coordinated
Planning Agreement (CPA) area of the Towns of Windsor, Johnstown and Milliken. She discussed
the access, drainage and traffic for the site and then referenced an email (Exhibit B) from the
Mucklers (original developers of the PUD). She outlined their requested changes to the Resolution
and Staff's response to each. Ms. Aungst entered the favorable recommendation of the
Department of Planning Services staff into the record as written and displayed images of the site
and surrounding views.
Lauren Light, Department of Public Health and Environment, reiterated the LTWD provides
water to the site, stated septic systems provide sewer service and noted separate septic systems

may be required for accessory structures, depending on how the lot and septic were originally
designed.
Tanner Schwartz, landowner in Lakota Lakes Ranch, represented the HOA and stated he
agreed with everything staff presented.
No public testimony was offered concerning this matter.
Gordon Kemmer, SPO, expressed concern with doubling the number of residences on each
of the properties and stated he would like to reserve the right to possibly do the same on his
property. Chair James clarified there are different rules, per Code, for different Zone Districts and
Ms. Aungst indicated Mr. Kemmer's lot has a Recorded Exemption and confirmed he is eligible
for a second residence, as long as he completes the Zoning Permit for a second dwelling.
Chair James suggested adding "attempt to" to COA #1.B (requirements of the Front Range
Fire Rescue) and the Board agreed to the change.
No public testimony was offered regarding the change made to the Conditions of Approval.
In response to Chair James, Mr. Schwartz indicated he had reviewed, and on behalf of the
Lakota Lakes Ranch HOA, agreed to abide by, the Conditions of Approval, as amended.
Commissioner Moreno moved to approve the request of the Landowners of Lakota Lakes
Ranch PUD for an Amended Planned Unit Development Final Plan, PUDF21-0002, of Corrected
Lakota Lakes (PF-594) to allow one (1) Second Single Family Dwelling Unit per lot in the PUD,
based on the recommendations of Planning staff, with the Conditions of Approval, as amended.
The motion was seconded by Commissioner Buck, and it carried unanimously. There being no
further discussion, the hearing was completed at 10:44 a.m.
