The proposal has been reviewed on behalf of the Weld County Department of Public Works and the
Department of Planning and Zoning. Staff comments made during this phase of the application process
may not be all-inclusive, as other issues may arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site -Specific Development Plan and Use by Special Review Permit for a Kennel (dog
boarding kennel, dog daycare and dog training facility for up to 25 dogs) in the
A (Agricultural) Zone District.
This project is south of CR 6 and is east of and adjacent to CR 47.
Parcel number: 147325000040.
Access is from CR 47 (AP14-00057 {2 access points} — Residential).
ACCESS
Development Review has reviewed the application materials related to access.
The parcel has proposed accessing onto CR 47 at the two existing permitted access points (AP14-00057).
The permitted access point on the north would be for the proposed land use and the permitted access point
on the south would remain residential. The applicant shall submit an access permit application to upgrade
the northern access to reflect the proposed land use.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access location with Development Review prior to laying out your
site plan. All "preliminarily approved" accesses are subject to change during the access permitting process.
Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road.
Minimum access spacing widths are shown in Weld County Code Sec. 8-14-30. Please refer to Chapter 8
of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
This portion of CR 47 is a gravel road and is designated on the Weld County Functional Classification Map
(Code Ordnance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the documents
creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified
it shall be dedicated. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the
required setback is measured from the future right-of-way line. Be aware that physical roadways may not
be centered in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weldgcv.com/departments/publicworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
No recent traffic information is available for this portion of CR 47.
The traffic information submitted with the application materials indicates that during operation that the
maximum site traffic would be 25 passenger vehicle round trip daily and 2 tandem truck round trips daily.
75% of the traffic will travel north and 25% of the traffic will travel to the south on CR 47.
No additional traffic information is needed.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly mantained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Development Review for review and consideration.
This site requires double cattle guards and 100 ft. of road base or road base on all driving surfaces.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
The applicant shall submit a simple drainage narrative. It appears as if the site meets the following
drainage exception 8. Development of sites where the change of use does not increase the imperviousness
of the site. Located in Sec. 8-11-40. Drainage Policy.
Historic Flows
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
CONDITIONS OF APPROVAL
A. A Final Drainage Narrative is required. (Development Review)
B. The plan shall be amended to delineate the following:
1. CR 47 is a gravel road and is designated on the Weld County Functional Classification Map as an
local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and
label on the site map or plat the future and existing right-of-way (along with the documents creating
the existing right-of-way) and the physical location of the road. All setbacks shall be measured
from the edge of right-of-way. This road is mantained by Weld County. (Development Review)
2. Show and label the approved access locations, approved access widths, and the appropriate
turning radii on the site plan. The applicant must obtain an upgraded access permit in the
approved location prior to construction. (Development Review)
3. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Development Review)
4. Show and label the approved tracking control on the site plan. (Development Review)
5. Show and label the drainage flow arrows. (Development Review)
6. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around
the property. (Development Review)
Pror to Construction
A. The approved access point shall be permitted, and the tracking control shall be constructed prior to any
on -site construction. (Development Review)
B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Pror to the release of building permits, the applicant shall be required to submit a complete access
application for the "preliminarily approved" access location as shown on this plan. (Development
Review)
5. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review)

Environmental Health Services has reviewed this Site -Specific Development Plan and Use by
Special Review Permit for a Kennel (dog boarding kennel, dog daycare and dog training
facility for up to 25 dogs) in the A (Agricultural) Zone District.
The 1995 residence is served by an individual domestic well which is permitted for three
single family dwellings (185934) and an on -site wastewater treatment system sized for 3
bedrooms (G19950076). The 2014 residence is served by the domestic well and an on -site
wastewater treatment system for 3 bedrooms (SP -1300279). . A portable toilet will be
provided for employees and patrons of the facility in accordance with EH policy.
A commercial on -site wastewater treatment system was installed in 2019 for a shop wash
station for animals (SP -1900090). However, the permit has not received final approval and
cannot be used with the current well. As the well is not currently permitted for commercial
use, water will be hauled and stored in a holding tank for use in the dog kennel.
A dust abatement plan was submitted which states, in part: "Artificial turf has been placed in
high activity locations to control dust, mitigate noise, reduce mud and long term erosion. The
driveway of the property is covered in recycled asphalt to reduce dust and mud."
A waste handling plan was submitted which states, in part: "All waste will be picked up daily
and placed into trash bags and then sealed shut. All waste is then placed into a commercial
dumpster that is picked up on a weekly basis."
Noise is restricted to the residential limit. The applicants submitted their own noise study
which indicates the residential limit can be adhered to at the low reading points in the study.
The study indicates: "The proposed kennel and training facility will be staffed with dog

trainer's not just handlers. This staff will be very cognitive of excessive barking dogs and will
immediately address this excessive barking with positive training and as necessary removal
from the situation to keep barking at a minimum. Our goal is to have a respectful environment
for all.

A Pet Animal Care Facilities Act (PACFA) license is required.
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. The On -Site Wastewater Treatment system permitted as SP -1900090 shall receive final
approval in accordance with the Weld County On -Site Wastewater Treatment System
(OWTS) Regulations.
We recommend the following requirements are incorporated into the permit as development
standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities
Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to
include those wastes specifically excluded from the definition of a solid waste in the Solid
Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, fugitive particulate emissions, blowing debris, and other potential nuisance
conditions. The applicant shall operate in accordance with Chapter 14, Article 1 of the
Weld County Code. The accepted waste handling plan shall be adhered to.
4. Fugitive dust should attempt to be confined on the property. Uses on the property should
comply with the Colorado Air Quality Commission's air quality regulations. The accepted
dust abatement plan shall be adhered to.
5. The facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in 25-12-103 C.R.S.

6. Any On -site Wastewater Treatment Systems located on the property must comply with all
provisions of the Weld County Code, pertaining to On -site Wastewater Treatment
Systems. The On -Site Wastewater Treatment system permitted as SP -1900090 cannot
be used for business use unless the well permitted as 185934 is repermitted for
commercial use or water is hauled to the facility for kennel use.
7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes
as applicable. The well permitted as 185934 cannot be used unless it is repermitted for
commercial use.
8. For employees or patrons on site for less than 2 consecutive hours a day, and 2 or less
full-time employees on site, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained on a quarterly basis
and available for review by the Weld County Department of Public Health and
Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County,
contain hand sanitizers and be screened from existing adjacent residential properties and
public rights -of -way.
9. Animal and feed wastes, bedding, debris, and other organic wastes
shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are
minimized.
10.The applicant shall comply with the Colorado Department of Agriculture (CDA), Division of
Animal Industry regulations.
11.The operation shall comply with all applicable rules and regulations of State and Federal
agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV22-00048) was noted. This
violation was initiated due to the operation of a dog training, grooming, boarding and kennel operation
without first obtaining the required land use permits. This case has been forwarded to the County
Attorney's Office; therefore, an investigation fee IS required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff -initiated complaints without there being a safety component to the
complaint.
If this application is approved, and once the applicant completes all Conditions of Approval and
submission a final and approved map for recording, the Zoning Violation (ZCV22-00048) would be closed.
If this application is denied, the Zoning Violation (ZCV22-00048) case would proceed accordingly through
the County Court process.

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have no
conflicts with the proposed activity. We have included additional comments below:
1. There are no active or proposed 1041 WOGLA Permits on the associated parcel. There are
several oil and gas well sites in the area surrounding the parcel, none directly on the
associated parcel.
2. The USR lands may include additional oil and gas related infrastructure, such as off -location
flowlines or pipeline which are a use by right and not regulated by Weld County. OGED
requests that the applicant reviews flowline data available from the COGCC map viewer and
utilize Colorado 811 prior to any excavation activities.
This determination is based upon the review of the application materials submitted by the applicant and
other relevant information available on the E -Permit site.

Dear Chris Gathman:
We have received the May 2, 2022 referral concerning K9cations LLC application for a Site Specific
Development Plan and Use by Special Review Permit for a dog boarding kennel, daycare and training
facility for up to 25 dogs. The business will include staff and customers as part of the training
classes to be offered. The property subject of this application is an approximately 43 -acre parcel
located in the S %2 NW '/a of Sec. 25, Twp. 1 N, Rng. 65 W, 6th P.M. at 1644 County Road 47. The
land is currently used for residential use in two homes, livestock, and for growing alfalfa hay.
This referral does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums
to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the
water supply plan for this project or the ability of the water supply plan to satisfy any County
regulations or requirements. In addition, the comments provided herein cannot be used to
guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical
availability of water.
Bottled water and portable toilets will be provided for staff and customer usage. Water for the
dogs will be hauled to the site. Any water hauled to the site must be obtained from a legal source.
The proposed water supply for the current residential uses is well permit no. 185934. Permit no.
185934 was issued on April 5, 1995 pursuant to section 37-92-602(3)(b)(II)(A), C.R.S. for use in up to
three single-family dwellings; fire protection; the watering of poultry, domestic animals, and
livestock on farms and ranches; and the irrigation of not over one acre of home gardens and lawns.
The well cannot be used for irrigation of alfalfa or any other uses not permitted by the well permit.
Since ownership of the property has changed, the applicants should file a change in owner name
form (GWS-11) to update the contact information for this well permit, which is available for

A review of our records shows well permit no. 229-WCB may be located on the property. This well
was first put to beneficial use July 21, 1954 for domestic use. The use of this well is limited to its
historic domestic uses that existed as of May 8, 1972 which have continued since that time [provided
such uses are no greater than those uses allowed for a well permit pursuant to section 37-92-602(1),
C.R.S., which are: fire protection, ordinary household purposes inside not more than three single-
family dwellings, the watering of poultry and domestic animals and the irrigation of not more than
one acre of home gardens and lawns]. Uses that expand the historical use of the well are not
permitted.
A review of our records also shows irrigation well permit nos. 4360 -F -R and 4361-F located on the
property which are covered by the Central Colorado Water Conservancy District Ground Water
Management Subdistrict augmentation plan, case no. 02CW335; and well no. 4360 -F -R is also
covered by the Boxelder Creek Property's augmentation plan, case no. 07CW1254. Well permit no.
4360 -F -R was issued March 31, 1975 on the condition that the old well, permit no. 4360-F, be plugged
and abandoned. A Well Abandonment Report was not received for well no. 4360-F, therefore it is
unknown if the well was plugged. To ensure well no. 4360-F was plugged and abandoned in
compliance with permit no. 4360 -F -R, the well owner must submit a Well Abandonment Report
(Form GWS-09) available for download at: https://dwr.state.co.us/eforms.

1. Print the new owner's name and include the mailing address and phone number.
2. Indicate if the change in ownership/address is for a well permit, livestock water tank.or erosion control
dam. Be sure to include the prer permit. tank or darn number.
3. Complete the well location information. If the address of the well location is different than the mailing
address of the owner, include the address where the well is located. If the owner has more than one
well, provide well name or number as designated by the owner; i.e. North Well. The actual well location
must include 1/4, 1, Section, Township and Range. Check the appropriate boxes for North or South and
East or West directions. Complete the Subdivision, Lot, Block and Filing information, if applicable.
4. Complete the location information for the livestock water tank or erosion control dam. The actual
location must include 1/4, Section, Township, Range and P.M. Check the appropriate boxes for North or
South and East or West directions.
5. Check the reason(s) for submitting the form, whether it is a change In ownership/address and/or location
correction.
6. The owner of the structure must sign, Print or type your name in the first block if it is different from item
No. 1. If signing as a representative of a company who owns the structure, then your title must also be
included in the first block. Sign the second block and date the last block.
USE THIS FORM TO CORRECT THE LOCATION OF YOUR WELL IF:
A. Your well was permitted, registered, or first used prior to May 8, 1972 for ordinary household
purposes in up to three single-family dwellings, fire protection, the watering of poultry, domestic animals,
and livestock on farms and ranches and the irrigation of not over one acre of home gardens and lawns.
B, Your well is not of the type described in A above, but was permitted or registered prior to May 17,
1965. inside the Designated Ground Water Basins, other procedures and publication may be required.
C. Your well was decreed by the Water Court for the correct location.

The report must be typed or printed in BLACK INK All changes on the form must be initialed and dated. Attach
additional sheets if more space is required. Each additional sheet must be identified at the top by the well owner's
name, the permit number, form name/number and a sequential page number. Report depths in feet below ground
surface.
This form may be reproduced by photocopy methods, or by computer generation with prior approval by the State
Engineer.
The original and one copy of this form must be submitted to the State Engineer's Office within 60 days after completing
the well or 7 days after the permit expiration date, whichever is earlier. Another copy of the form must be provided
to the well owner.
If this form is submitted in conjunction with the Well Completion and Test Report, form number GWS-31, ONLY THE
PERMIT NUMBER AND OWNER NAME NEED TO BE COMPLETED in items 1 and 2.
1. Complete the Permit Number in full.
2. Fill in Name and Mailing Address of Well Owner where correspondence should be sent.
3. Complete the blocks for the actual location of the well. For wells located in subdivisions the lot, block and
subdivision information must also be provided.
4. Indicate the type of pump installed and complete the requested information. When installing pumps greater
than 50 gpm, complete the additional information in this area.
5. Provide the information on other equipment which may be installed in the well.
6. Report test data as required by Rule 13.9. Spaces are provided to report all measurements made during the
test. The report should show that the test complied with the provisions of the rules. If a test was not performed
explain when it will be done. If available, report clock time when measurements were taken.
7. Record the type and the amount of disinfection used, how placed and the length of time left in the hole.
6. Indicate if a water quality analysis was performed and submit a copy of the report if available.
9. Use the remarks area to note any additional information including additional equipment installed, water supply
construction problems.
10. Fill in Company Name and Address of Contractor who constructed the well. The report must be signed by the
licensed contractor responsible for the installation of pumping equipment.

4. Report the ground surface elevation in feet above sea level if available. This value may be obtained from
a topographic map. Describe the drilling method used to construct the well and the date completed.
Indicate the total depth drilled and the actual completed depth of the well.
5. Fully describe the materials encountered in drilling. Do not use formation names unless, they are in
conjunction with a description of materials,
Examples of descriptive terms include:
Grain size -Boulders, gravel, sand, silt, clay.
Hardness --Loose, soft, tight, hard, very hard.
Color --All materials. Most critical in sedimentary rock.
Depth when water is encountered (if it can be determined).
6. Provide the diameters of the drilled bore hole.
7. The outside diameter, kind, wall thickness and interval of casing lengths must be indicated.
8. Indicate the type and size of filter (gravel) pack and the interval where placed.
9. indicate the type and setting depth for any packers installed.
10. The density of the grout slurry must be reported and may be indicated as pounds per gallon, gallons of
water per sack, total gallons of water and number of sacks used, etc. Specify the grout placement

1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant that no injury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump Installation Contractors in accordance with Rule 17.
3) Approved pursuant to CRS 37-92-602(3)(b)(II)(A) as the only well on a tract of land of 44 acres described as part
of the NW1/4 Section 25, Township 1 N, Range 65 West of the 6th P.M., more particularly described on the
attached exhibit A.
4) The use of ground water from this well is limited to ordinary household purposes inside three single family
dwellings, fire protection, the watering of poultry, domestic animals, and livestock on farms and ranches, and the
irrigation of not over one (1) acre of home gardens and lawns.
5) The total depth of the well shall not exceed 75 feet or the first shale layer, whichever comes first, which
corresponds to the base of the alluvial aquifer.
6) The maximum pumping rate shall not exceed 15 GPM.
7) The • return flow from the use of the well must be through an individual waste water disposal system of the
non -evaporative type where the water is returned to the same stream system in which the well is located.
8) This well shall be constructed not more than 200 feet from the location specified on this permit. 4_445 --
Note: To insure a maximum productive life of this well, perforated casing should be set through the entire
producing interval of the approved zone or aquifer indicated above.
