Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and 2nd Amended Use by Special Review Permit No.USR17-0024, for Recreational Facilities and uses including, Race Tracks and Race Courses (Match Horse Racing), and modification of certain Development Standards to add a Commercial Recreational Facilities (truck expo shows), Event Facility (live music), Racing Facilities (a 100 -foot x 100 -foot asphalted area for truck burnout and an ATV off road race track), outside of subdivisions and historic townsites in the A (Agricultural) Zone District. This project is north of and adjacent to CR 96 and is east of and adjacent to CR 37. Parcel number 055106300024. Access is from CR 37 and CR 96 (AP17-00275) ACCESS Development Review has reviewed the application materials related to access. The parcel has three existing permitted access points: two onto CR 37 and one onto CR 96 (AP17-00275). No other access points are requested. Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there shall be no net increase in the number of accesses to a public road. Minimum access spacing are shown in Weld County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more information regarding access. ROADS AND RIGHTS -OF -WAY This portion of County Road 37 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1-90, the required setback is measured from the future right-of- way line. Be aware that physical roadways may not be centered in the right-of-way. This road is maintained by Weld County. This portion of County Road 96 is a gravel road and is designated on the Weld County Functional Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at https://www.weldgov.com/departments/publicworks/permits/. Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate existing utilities within the County right-of-way. TRAFFIC No current traffic count information is available for this portion of CR 96 or for this portion of CR 37. The traffic information submitted with the application materials indicates that traffic will not increase above the levels included in the existing accepted traffic impact statement submitted for the original use by special review (i.e. USR17-0024). No other traffic information is needed at this time. TRACKING CONTROL Tracking control is required to prevent tracking from the site onto public roadways. For access to paved roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior to entering publicly maintained roadways. A variance request for alternatives to the tracking control requirement can be submitted to Public Works for review and consideration. The site is required to have either double cattle guards with 100 ft. of road base, or road base on all driving surfaces. This appears to have been constructed as part of the previous USR cases. ROAD MAINTENANCE AGREEMENT An Improvements and Road Maintenance Agreement was required and recorded in association with USR 17-0024. It is referenced as Reception No. 20180334. This Agreement shall be reviewed to determine if any updates and/or revisions is needed. Improvements/Road Maintenance Agreement: An example agreement is available at: https://www.weldgov.com/Government/Departments/Planning-and-Zoning/Development-Review . DRAINAGE REQUIREMENTS This area IS within a Non -Urbanizing Drainage Area Non -Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON - URBANIZING areas. Detention pond and a simple drainage narrative: The applicant has submitted a drainage narrative stating that the site meets drainage exception 6. Gravel pits if the stormwater drains into the gravel pit. Releases from the site shall comply with the Weld County Storm Drainage Criteria, including dewatering. Topographical information shall be provided. Located in Sec. 8-11-40. Drainage Policy. This exception does not meet the activities proposed for the site. Therefore, a revised drainage narrative that does include an acceptable detention exception shall be submitted. Historic Flows The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Development Review for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. No additional grading is proposed. CONDITIONS OF APPROVAL A. The existing Improvements and Road Maintenance Agreement (Rec. No. 20180334) shall be reviewed and revised, as necessary, to address the traffic associated with the proposed use of the site. A waste handling plan was submitted which states that garbage bins will be provided throughout the property and a trash crew will pick up litter during and after the event. A dust abatement plan was submitted which stipulates a water truck will be utilized during and before the events, as needed. A noise report completed by Alles Taylor and Duke, LLC was provided. The report concludes: "The proposed uses of a "Burn -out Pit" and a concert venue will produce sound levels 25' from the property line of 56.4 dB, that will be below the maximum permissible sound level of 60 dB for a commercial use. Animal and feed wastes, bedding, debris, and other organic wastes shall be disposed of so that vermin infestation, flies, odors, disease hazards, and nuisances are minimized. 2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 3. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S. 4. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. Water Division 1, Water District 1 Dear Ms. Aungst: We have reviewed the above referenced application for a Site Specific Development Plan and 2nd Amended Use by Special Review permit (USR17-0024) to add commercial recreational facilities (truck expo shows), event facilities (live music), and racing facilities to an existing horse racing facility. The submitted material does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the ability of the water supply plan to satisfy any County regulations or requirements. The subject application seeks approval to add truck expo events with live music and an all -terrain vehicle course to an existing business operating a horse racing facility. The subject parcel associated with the Site Specific Development Plan totals approximately 80 acres and contains the three sheds, a 100' by 100' asphalt pad that is to be used as a "Burn -Out Pit", and an existing well. The application proposes to host five (5) truck expo events per year, with a maximum of 1,000 spectators, participants, and employees per event. The existing well was issued permit no. 306497-A for the relocation of an existing commercial well. The use of groundwater from this well is limited to drinking and sanitary facilities inside a commercial business. Water from this well may not be used for dust control, landscape irrigation, or for any other purpose, and is restricted to use inside the business building structures. The annual amount of groundwater to be withdrawn from this well is limited to Y3 acre-foot (108,600 gallons) and a totalizing flow meter is required to be installed on the well, with permanent records of all diversions maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. As noted above, well permit no. 306497-A was issued as a replacement for a previous well constructed under permit no. 306497. The well with permit no. 306497 was required to be plugged and abandoned upon completion of the new well. Sanitary requirements for the truck expo events will be met through the use of portable toilets. The applicant has confirmed that they own and operate two water trucks for their additional water needs, such as dust control. The application materials indicate that the applicant fills the water trucks from a source operated by the North Weld County Water District. Our office asks that the applicant keep a record of the filling of the water trucks and save the invoices/receipts as evidence that the water trucks are filled using a legal water source. The applicant has requested an exemption from any stormwater detention requirements, and does not propose to construct any stormwater infrastructure. The Drainage Narrative states that the request for exemption from stormwater detention is made pursuant to subsection 1.6. of the Weld County Drainage Policy, which exempts gravel pits from stormwater detention requirements if the stormwater drains into the gravel pit. Water from this well shall not be used for lawn/landscape/greenhouse irrigation, domestic animal/livestock watering, or for any other purpose outside the building structure(s). 5) The pumping rate of this well shall not exceed 15 GPM. 6) The annual amount of ground water to be withdrawn by this well shall not exceed 1/3 acre-foot (108,600 gallons). 7) Approved as the only well on a tract of land of 40.00 acres described as the NW 1/4 of the SW'/ of Sec. 6, Twp. 8 N, Rng. 65 W, S P.M., Weld County. 8) The return flow from the use of this well must be through an individual waste water disposal system of the non -evaporative type where the water is returned to the same stream system in which the well is located. 9) A totalizing flow meter must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (recorded at least annually) and submitted to the Division Engineer upon request. 10) This well shall be constructed not more than 200 feet from the location specified on this permit. NOTE: At the proposed well location, the Laramie -Fox Hills aquifer is located approximately 485 feet below ground surface and extends to a depth of approximately 845 feet.
