RESOLUTION FOR WIDENING ROAD
THROUGH a Ni:- SECTION 10-4-67
BETWEEN MILLIKEN & JOHNSTOWN
AND ROAD ON FAST SIDE OF SECTION 10
Commissioner Carlson moved the adoption of
the following resolution, which was duly seconded and
on vote unanimously carried:
RESOLVED , That the County Commissioners enter
into and execute as first party written arbitration
agreement for possession of and determining compensation
for road right of way as prepared by the County Attorney
and executed this date by G. C . Binder, as second party ,
and James F. Mellon, as third party , for widening road
through North Half of North Half of Section 10, and along
the east side of Section 10, Township 4 North of Range 67
West of the 6th P. M.

A 'Strip of ground 20 feet wide, adjoining on the south
and parallel with the present road extending easterly and westerly

part of land belonging to G. Charles Binder and Mary C. Binder, being
the Northwest Quarter and West Half of the Northeast Quarter (14We and
Wj- NE+) of Section 10 , Township 4 North, Range 67 West of the 6th P .M.
Said strip of ground containing 1 .8 acres , more or less.
The consideration herein stated is in full compensation for all damages which would be considered and assessed
in any award or verdict in a proceeding under the Statutes of Colorado, to condemn said strip of land for
public road.

Notice is hereby given that in pursuance of a petition here=
tofore presented to the Board of County Commissioners of Weld
County, the said Commissioners have appointed three Road
Viewers to meet at point named below, at-. 33aoo'clock_ _ M,
on the. 21st day of September , A. D., 19 12 , and proceed
thence to view the line prayed for in said petition, as follows, to=
wit: Commencing at . east end and going west of road described as
follows:
From the northwest corner of section 9, township 4 north, range
67 west, thence oast along section line,_ or as near as practical, to
the northeast corner of section 10, township 4 north, range 67 west, a
distance of two miles to intersect with county roads at each end.
The names of the viewers are Ci C Levis, S H Southard, and J Fl Dillon
and to attend to such other duties as are required of them as view=
ers of said proposed road, at which time and place all whom it
may concern may, if they see fit, appear.
