RE: APPROVE CONSENT TO ENFORCEMENT OF 2018 INTERNATIONAL FIRE CODE,
WITH AMENDMENTS, WITHIN CERTAIN AREAS OF UNINCORPORATED WELD
COUNTY LYING WITHIN FORT LUPTON FIRE PROTECTION DISTRICT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, C.R.S. §32-1-1002 (1)(d), provides that a fire code promulgated by a fire
district may not be enforced in unincorporated portions of Weld County without the consent of the
Weld County Board of Commissioners, and
WHEREAS, the Fort Lupton Fire Protection District Board of Directors has presented a
Resolution adopting the 2018 International Fire Code, with certain amendments, and
WHEREAS, after review, the Board deems it advisable to consent to the enforcement of
the 2018 International Fire Code, with certain amendments detailed in the attached Resolution of
the Board of Directors of the Fort Lupton Fire Protection District, within the unincorporated areas
of Weld County that are also within the geographic boundaries of the Fort Lupton Fire Protection
District.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Board hereby consents to enforcement of the 2018 International Fire
Code, with certain amendments detailed in the attached Resolution of the Board of Directors of
the Fort Lupton Fire Protection District, within the unincorporated areas of Weld County that are
also within the geographic boundaries of the Fort Lupton Fire Protection District.
BE IT FURTHER RESOLVED that any further amendments to the 2018 International Fire
Code by the Fort Lupton Fire Protection District shall not be effective within unincorporated Weld
County without the presentation to, and consent of, the Weld County Board of County
Commissioners.

Brief description of the problem/issue:
Fort Lupton Fire District is requesting consent to enforce the 2018 International Fire Code (IFC), with
County amendments. Fort Lupton Fire currently enforces the 2012 IFC.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
1) Consent to enforce as proposed by the Fire District.
2) Consent to enforce with changes.
3) Do not consent to enforce.
Recommendation:
Staff recommends Option No.1. Fort Lupton Fire agreed with Weld County's four (4) amendments
which are consistent with all of the other Fire Districts that have adopted the 2018 IFC. The
amendments agreed to are as follows: 1) additional access points have to be requested in writing by
the Fire District via the land use process; 2) single family residences shall not require unduly
burdensome road construction or driveway maintenance; 3) single family residences that are not
within 400 feet of a fire hydrant do not have to construct a fire hydrant; and 4) automatic sprinkler
systems are not required to be installed in a SFD that is 3,600 square feet or less of habitable space.

BOARD OF DIRECTORS OF THE
FORT LUPTON FIRE PROTECTION DISTRICT
RESOLUTION ADOPTING THE 2018 EDITION OF THE INTERNATIONAL FIRE CODE
WITH LOCAL AMENDMENTS
WHEREAS, the Fort Lupton Fire Protection District ("District") is a political subdivision
of the State of Colorado, formed pursuant to C.R.S. § 32-1-101, et seq. ("Special District Act") to
provide fire suppression, fire prevention, emergency medical, emergency rescue, and hazardous
materials services (collectively, "Emergency Services") to the citizens and their property within
its jurisdiction, and to individuals passing through its jurisdiction;
WHEREAS, the District's jurisdiction includes unincorporated portions of Weld County
("County"), as well as the City of Fort Lupton ("City");
WHEREAS, the Special District Act authorizes the District's Board of Directors ("District
Board") to adopt and enforce a fire code within the District's jurisdiction, subject to approval by
the County for the unincorporated portions of the County lying within District's jurisdiction, and
by the City for those portions of the City lying within the District's jurisdiction;
WHEREAS, the District, in consultation with the County and City, has determined that
adoption and enforcement of the 2018 Edition of the International Fire Code is best suited to
preserve public property, and the health, welfare, peace, and safety of the residents within and
visitors to its jurisdiction; and
WHEREAS, by this Resolution, the District Board desires to adopt the 2018 Edition of
the International Fire Code, with the local amendments that are attached hereto as Exhibit A and
Exhibit B, (collectively, "2018 Fire Code"), which 2018 Fire Code shall become enforceable
within that portion of the District's jurisdiction that also lies within the County, and within that
portion of the District's jurisdiction that also lies within the City, immediately upon adoption of
the 2018 Fire Code by the governing body of each such entity.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE FORT LUPTON FIRE PROTECTION DISTRICT:
1. The 2018 Fire Code is hereby adopted as the District's Fire Code for all purposes
within its jurisdiction, to become enforceable within that portion of the District's jurisdiction that
also lies within the County, and within that portion of the District's jurisdiction that also lies within
the City, immediately upon adoption of the 2018 Fire Code by the governing body of each such
entity.
2. The 2018 Fire Code shall be administered and enforced by the District's Fire Chief,
or his/her authorized representative. For purposes of enforcing the Fire Code, the District's Fire

Marshal is an authorized representative of the Fire Chief. This section shall not limit the
designation of additional authorized representatives if the Fire Chief deems it necessary for the
effective enforcement of the Fire Code.
3. Nothing contained in this Resolution shall be construed as modifying or limiting in
any manner the powers, duties, and responsibilities of the District, or the Districts Fire Chief, or
his/her authorized representative(s), as provided by all applicable federal, state, or local laws, rules,
and ordinances, or common law ("Applicable Lairs").
4. The 2018 Fire Code shall be interpreted in conformance with all Applicable Laws,
and shall, to the extent possible, be interpreted in a manner that does not conflict with the building
codes, regulations, and ordinances of the County or the City, as applicable depending upon the area
in which the 2018 Fire Code is being interpreted.
5. If any provision of this Resolution or the 2018 Fire Code is for any reason held to be
invalid, that invalidity shall not affect the validity of the remaining provisions of this Resolution and
the 2018 Fire Code. The District Board expressly declares it would have adopted this Resolution and
the 2018 Fire Code even if a provision contained in either this Resolution or the 2018 Fire Code is
declared invalid.

LOCAL AMENDMENTS TO THE
2018 EDITION OF THE INTERNATIONAL FIRE CODE
CITY OF FORT LUPTON
Adoption by the Fort Lupton Fire Protection District for the purpose of prescribing regulations
governing conditions hazardous to life and property from fire, hazardous materials, or explosion,
that certain Codes and Standards known as the International Fire Code, including all Appendix
Chapters and amendments made in and to the 2018 International Fire Code. The 2018 International
Fire Code is amended and changed in the following respects:
1. Section 101.1 Title. These regulations shall be known as the Fire Code of the Fort Lupton
Fire Protection District, hereinafter referred to as "this code"
2. Section 110.4 Violation Penalties. Persons who shall violate a provision of this code or
who shall fail to comply with any of the requirements thereof or who shall erect, install,
alter, repair or do work in violation of the approved construction documents or directive of
the fire code official, or of a permit or certificate used under provisions of this code, shall
be guilty of a misdemeanor, punishable by a fine of not more than five hundred dollars
($500.00) or imprisonment. Each day that a violation continues after due notice has been
served shall be deemed a separate offense.
3. Section 112.4 Failure to Comply. Any person who shall continue any work after having
been served with a Stop Work Order, except such work as that person is directed to perform
to remove a violation or unsafe condition, shall be liable for a fine of not less than five
hundred dollars ($500.00) or more than one -thousand dollars ($1000.00).
4. Chapter 9. Fire Protection Systems shall be modified to include the following provisions:
DEVELOPMENTS NOT SERVED BY PUBLIC WATER SYSTEM -REQUIREMENT
FOR FIRE EXTINGUISHING SYSTEMS. The extension or enlargement of a platted
subdivision, or the development of any platted but underdeveloped subdivision, which is
not served by a public water system, shall require that each dwelling unit in such extension,
enlargement, or development in a previously undeveloped subdivision shall have an
automatic fire extinguishing system, which has been approved by the local fire code
official.
That the geographic limits referred to in certain sections of the 2018 International Fire Code are
hereby established as follows:
1. Section 5704.2.9.6.1 Locations where above -ground tanks are prohibited. Storage of
class I and II liquids in above -ground tanks outside of buildings is prohibited within the
City limits of the City of Fort Lupton, except for previously existing storage facilities which
shall be subject to the exemption provided herein. New storage facilities shall be allowed
only upon completion of a plan review and approval of the Fort Lupton Fire Protection
District.

2. Section 5706.2.4„4 Locations where above -ground tanks are prohibited. Storage of
class I and II liquids in above -ground tanks outside of buildings is prohibited within the
City limits of the City of Fort Lupton, except for previously existing storage facilities which
shall be subject to the exemption provided herein. New storage facilities shall be allowed
only upon completion of a plan review and approval of the Fort Lupton Fire Protection
District.
3. Section 5806.2 Limitations. Storage of flammable cryogenic fluids in stationary
containers outside of buildings is prohibited within the boundaries of the Fort Lupton Fire
Protection District, including all areas within the City of Fort Lupton except that such
storage may be allowed only upon completion of a plan review and approval of the Fort
Lupton Fire Protection District.
4. Section 6104.2 Maximum capacity within established limits. The storage of liquified
petroleum gas within the Fort Lupton Fire Protection District is prohibited except for
previously existing storage facilities and except for residential barbeque tank or outdoor
barbeque grills and except for propane tanks of 1000 gallons or less which are located
within the Fire District, but outside the city limits of the City of Fort Lupton, all of which
shall be exempt. New storage facilities involving tanks which exceed 1000 gallons shall
require approval of the Fort Lupton Fire Protection District after plan review.
The following section A 10l .2 of Appendix A shall be repealed and replaced, and to be known as
Section A l0 l .2:
I. A101.2 Board of appeals established. In order to hear and decide appeals of orders,
decisions or determinations made by the fire code official relative to the application and
interpretation of this code, there shall be and is hereby created a board of appeals. The
board of appeals shall be the Board of Directors of the Fort Lupton Fire Protection District.
The fire code official shall be an ex officio member of said board but shall have no vote on
any matter before the board. The board shall render all decisions and findings in writing to
the appellant with a duplicate copy to the fire code official.

Fire code adoption required exemptions from commissioners for consent to enforce requests.
1. IFC 503.1.2 Additional Access. (amend to read as follows)
Additional Access permit(s) for fire safety may be requested from Weld County
through the access permit process set forth in the Weld County Code, in the
unincorporated portions of the Fire District.
2. 503.2 Specifications. (amend to read as follows)
Fire apparatus access roads shall be installed and arranged in accordance with Sections
503.2.1 through 503.2.8. Single and double family residences will not require unduly
burdensome road construction or driveway maintenance.
3. IFC 507.5.1 Where required (amend to read as follows)
Where a portion of the facility or building hereafter constructed or moved into or within
the jurisdiction is more than 400 feet (122m) from a hydrant on a fire apparatus access
road, as measured by an approved route around the exterior of the facility or building,
on -site fire hydrants and mains shall be provided where required by the fire code
official.
Exceptions:
a. Requirement does not apply to Group R-3 (single and double family) and
Group U occupancies
4. IFC 903 Automatic Fire Sprinkler Systems (amend to read as follows)
Automatic sprinkler systems shall not be required in one and two-family dwellings that
are less than 3600 square feet of habitable space above grade.

7) Ratification of Bills for September 2021
Director Grajeda made a mat on to ratify the approval of the Bills for September
2021. Vice President Patton seconded the motion. The motion to ratify the approval
of the bills for September 2021 was unanimously approved.

a) Change Meeting Dates for November and December due to Holiday's
Vice President Patton made a motion to change the meeting dates for
November and December due to hol.day's (same as Pension Meetings) to
November 18, 2021, and December 16, 2021. Treasurer Gordon Alexander
seconded the motion. The motion was unanimously approved.
b) Set Date for Public Hearing to Adopt 2022 Budget, Pending Final
Assessed Valuation
Treasurer Gordon Alexander made a motion to set the date for the public
hearing to adopt the 2022 budget to November 18, 2021. Vice President Patton
seconded the motion. The motion to set the date for the public hearing to
adopt the 2022 budget to November18, 2021 was unanimously approved.
c) Approval of UMB Bond Payment in the amount of $491,206.25

d) Adoption of the 2018 International Fire Code
Fire Marshal Tamlin reported that he has been working with both the City of Fort Lupton
and Weld County to get the 2018 codes adopted. Director Grajeda asked if there were a
lot of changes. Fire Marshal Tamlin stated that most of the changes where chapter
changes. Vice President Patton asked when this new code would take effect Fire Marshal
Tamlin stated that the City of Fort Lupton is planning on January 14. 2022, and Weld
County is hoping to take effect on January 1, 2022,
Vice President Patton made a motion to approve adopt the 2018 international fire Code
and the follow ng resolution. Treasurer Gordon Alexander seconded the motion.

FORT LUPTON FIRE PROTECTION DISTRICT:
1. The 2018 Fire Code is hereby adopted as the District's Fire Code for all purposes within its
jurisdiction, to become enforceable within that portion of the District's jurisdiction that also lies
within the County, and within that portion of the District's jurisdiction that also lies within the City,
immediately upon adoption of the 2018 Fire Code by the governing body of each such entity.
2. The 2018 Fire Code shall be administered and enforced by the District's Fire Chief, or his/her
au thnrized representative. For purposes of enforcing the Fire Code. the District's Fire

Marshal is an authorized representative of the Fire Chief. This section shall not limit the designation
of additional authorized representatives if the Fire Chief deems it necessary for the effective
enforcement of the Fire Code.
3. Nothing contained in this Resolution shall be construed as modifying or limiting in any manner the
powers, duties, and responsibilities of the District, or the Districts Fire Chief, or his/her authorized
representative(s), as provided by all applicable federal, state, or local laws, rules, and ordinances, or
common law ("Applicable Laws").
4. The 2018 Fire Code shall be interpreted in conformance with all Applicable Laws, and shall, to the
extent possible, be interpreted in a manner that does not conflict with the building codes, regulations,
and ordinances of the County or the City, as applicable depending upon the area in which the 2018
Fire Code is being interpreted.
5. If any provision of this Resolution or the 2018 Fire Code is for any reason held to be invalid, that
invalidity shall not affect the validity of the remaining provisions of this Resolution and the 2018
Fire Code. The District Board expressly declares it would have adopted this Resolution and the 2018
Fire Code even if a provision contained in either this Resolution or the 2018 Fire Code is declared
invalid.

LOCAL AMENDMENTS TO THE
2018 EDITION OF THE INTERNATIONAL FIRE CODE
CITY OF FORT LUPTON
Adoption by the Fort Lupton Fire Protection District for the purpose of prescribing regulations
governing conditions hazardous to life and property from fire, hazardous materials, or explosion, that
certain Codes and Standards known as the International Fire Code, including all Appendix Chapters
and amendments made in and to the 2018 International Fire Code. The 2018 International Fire Code
is amended and changed in the following respects:
1. Section 101.1 Title. These regulations shall be known as the Fire Code of the Fort Lupton Fire
Protection District, hereinafter referred to as "this code"
2. Section 110.4 Violation Penalties. Persons who shall violate a provision of this code or who shall
fail to comply with any of the requirements thereof or who shall erect, install, alter, repair or do work
in violation of the approved construction documents or directive of the fire code official, or of a
permit or certificate used under provisions of this code, shall be guilty of a misdemeanor, punishable
by a fine of not more than five hundred dollars ($500.00) or imprisonment. Each day that a violation
continues after due notice has been served shall be deemed a separate offense.
3. Section 112.4 Failure to Comply. Any person who shall continue any work after having been
served with a Stop Work Order, except such work as that person is directed to perform to remove a
violation or unsafe condition, shall be liable for a fine of not less than five hundred dollars ($500.00)
or more than one -thousand dollars ($1000.00).
4. Chapter 9. Fire Protection Systems shall be modified to include the following provisions:
DEVELOPMENTS NOT SERVED BY PUBLIC WATER SYSTEM -REQUIREMENT FOR FIRE
EXTINGUISHING SYSTEMS. The extension or enlargement of a platted subdivision, or the
development of any platted but underdeveloped subdivision, which is not served by a public water
system, shall require that each dwelling unit in such extension, enlargement, or development in a
previously undeveloped subdivision shall have an automatic fire extinguishing system, which has
been approved by the local fire code official.
That the geographic limits referred to in certain sections of the 2018 International Fire Code are
hereby rstahlished as follow
1. Section 5704.2.9.6.1 Locations where above -ground tanks arc prohibited. Storage of class I
and 11 liquids in above -ground tanks outside of buildings is prohibited within the City limits of the
City of Fort Lupton, except for previously existing storage facilities which shall be subject to the
exemption provided herein. New storage facilities shall be allowed only upon completion of a plan
review and approval of the Fort Lupton Fire Protection District.

2. Section 5706.2.4.4 Locations where above -ground tanks are prohibited. Storage of class I and
II liquids in above -ground tanks outside of buildings is prohibited within the City limits of the City of
Fort Lupton, except for previously existing storage facilities which shall be subject to the exemption
provided herein. New storage facilities shall be allowed only upon completion of a plan review and
approval of the Fort Lupton Fire Protection District.
3. Section 5806.2 Limitations. Storage of flammable cryogenic fluids in stationary containers
outside of buildings is prohibited within the boundaries of the Fort Lupton Fire Protection District,
including all areas within the City of Fort Lupton except that such storage may be allowed only upon
completion of a plan review and approval of the Fort Lupton Fire Protection District.
4. Section 6104.2 Maximum capacity within established limits. The storage of liquified petroleum
gas within the Fort Lupton Fire Protection District is prohibited except for previously existing
storage facilities and except for residential barbeque tank or outdoor barbeque grills and except for
propane tanks of 1000 gallons or less which are located within the Fire District, but outside the city
limits of the City of Fort Lupton, all of which shall be exempt. New storage facilities involving tanks
which exceed 1000 gallons shall require approval of the Fort Lupton Fire Protection District after
plan review.
The following section A 101.2 of Appendix A shall be repealed and replaced, and to be known as
Section A 101.2:
1. A101.2 Board of appeals established. In order to hear and decide appeals of orders, decisions or
determinations made by the fire code official relative to the application and interpretation of this
code, there shall be and is hereby created a board of appeals. The board of appeals shall be the Board
of Directors of the Fort Lupton Fire Protection District. The fire code official shall be an ex officio
member of said board but shall have no vote on any matter before the board. The board shall render
all decisions and Findings in writing to the appellant with a duplicate copy to the fire code official.

Additional Access permit(s) for fire safety may be requested from Weld County through the access
permit process set forth in the Weld County Code, in the unincorporated portions of the Fire District.

2. 503.2 Specifications. (amend to read as follows)
Fire apparatus access roads shall be installed and arranged in accordance with Sections 503.2.1
through 503.2.8. Single and double family residences will not require unduly burdensome road
construction or driveway maintenance.
3. IFC 507.5.1 Where required (amend to read as follows)
Where a portion of the facility or building hereafter constructed or moved into or within the
jurisdiction is more than 400 feet (I 22m) from a hydrant on a fire apparatus access road, as measured
by an approved route around the exterior of the facility or building, on -site fire hydrants and mains
shall be provided where required by the fire code official.
Exceptions:
a. Requirement does not apply to Group R-3 (single and double family) and Group U occupancies
4. IFC 903 Automatic Fire Sprinkler Systems (amend to read as follows)
Automatic sprinkler systems shall not be required in one and two-family dwellings that are less than
3600 square feet of habitable space above grade.

e) Annual Performance Evaluations
Chief Tiffany stated that its that time of year and he will be bringing the
evaluations to the Board for the November meeting. President Leinweber asked
if any other Board members would like to volunteer to complete Chiefs Review
Director Grajeda and Treasurer Gordon Alexander stated they will help
President Leinweber with Chiefs Evaluation.
f) Approval of the 2021 Audit Engagement Letter with Feis and Company
for an amount not to exceed $6,570.00
Vice President Patton made a motion to approve the 2021 audit engagement letter
with Feis and Company for an amount not to exceed $6,570.00. Treasurer
Alexander Seconded the motion. The motion tapprove the 2021 audit
engagement letter was unanimously approved.
g) Pension Payment Increase (added by Director Austin)
Director Austin made a motion to increase pension payments 5.00 per year of
service as recommended by the pension Board. Treasurer Alexander noted he has
a conf,ict of interest and seconded the motion. The motion to increase pension
payments 5.00 per year of service was unanimously approved. Chief Tiffany asked
when this increase takes effect. President Leinweber noted it will be effective
January 1,2022,
10) Reports
a) Fire Chief
Chief Tiffany reported that the state of Colorado approved the District for the
Foam buy back program where the State will buy back the foam the District
currently has as it was found to cause cancer and Chef purchased new foam that
is safer to use.
Chief Tiffany reported that the cost for the Pierce will be at least 6% higher than
the previous truck. Chief Tiffany believes that the committee can get a plan ready and
have a contract available by January for the Board to sign.
Chief Tiffany reported that there was a story on KDVR that there is a shortage of
volunteers in the state.
Chief Tiffany reported that there have been a couple of sad events with Colorado Fire
Districts that a Firefighter from Yuma passed away and while enroute to the funeral a
joes firefighter stopped at a scene of a fire and passed away on scene.
Chief Tiffany reported that the crews have been doing a lot of mutual aid training with
Brighton Fire.
Chief Tiffany reported that the trailer for the Haggland is on site.
Chief Tiffany reported that the district assisted Hudson fire at a hanger fire that was a
total loss and that crews were on scene for several hours.
Chief Tiffany reported that a few warranty items are being worked on at station 3
Chief Tiffany thanked the Board of Directors and stated that there as been a lot of good
feedback from the staff on the Covid Bonus.
b) Fire Prevention
Fire Marshal Tamlin had nothing to report.
c) Maintenance
Chief Tiffany reported that Maintenance has the sprinkler system blown out. And
that things are going very well.
d) Urban Renewal
Director Grajeda reported that the upgrades for 3' and 4 street is on hold.
Director Grajeda reported that there is a new grant opening in January the FLURA
boat d is going to ti y ag, ,
Director Grajeda reported that there is a new iGA that the FLURA Board wit be
looking at for the newly formed (Metro District.
e) Board President
President Leinweber thanked all first responders, All Firefighters and all Police
officers for First Responder apprec,ation day
President Leinweber thanked everybod 5v fcr the hard work on the fire code,
budget, and audit. Treasurer Gordon A exander seconded the thanks. All the
Board Members stated they appreciate a I of the hard work from all of the
Employees of the District

President Leinweber adjourned into executive session to discuss items
subject o negotiations per §24-6-402 (4)(e) to include the Board of
Directors, and Chief Tiffany at 8:06 p.m,
