RESOLUT ION
WHEREAS, pursuant to law, the Colorado Department of Agriculture
by Notice and Order of February 1, 1971, declared all trees of any species
or variety of the genus ulmus infected with ceratocystis ulmi in the State of
Colorado to be a threat and a hazard to all dutch elm trees in Colorado,
and further ordered that all such infected trees be destroyed or properly
disposed of as provided therein; copy of Notice and Order attached hereto
for ready reference, and
WHEREAS, the Board of County Commissioners, Weld County, Colo-
rado, has received a petition signed by over 50 resident land owners re-
questing appointment of a county dutch elm tree disease pest inspector,
copy of said petition marked Exhibit A attached hereto and made a part
hereof by reference, and
WHEREAS, the Board recognizes the threat and hazard to dutch elm
trees in Weld County, and
WHEREAS, the Board has determined that it would be in the best in-
terest of the County to appoint a county dutch elm tree disease pest in-
spector, and
NOW, THEREFORE, BE IT RESOLVED, that the Board of County
Commissioners, Weld County, Colorado, does hereby appoint
Arthur Briggs , an employee of the Weld County
Extension Office, to be county pest inspector and to serve at the pleasure
of the Board in accordance with and pursuant to the provisions of Chapter
6, Article 10(4) CRS '63.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 9th day of January, A. D.
1974.

6-10-1. SHORT TITLE.--This article shall be known as "Pest Control Act."
6-10-2. DEFINITIONS.--As used in this article "pest" means insect pests, and
animal pests (except rodents, jack rabbits and predatory animals) and fungus or other
plant diseases and weeds. "Inspector" means any employee of the department of agri-
culture employed under this article.
6-10-3. ADMINISTRATION.--The department of agriculture shall administer this
article and shall have full authority for the proper enforcement thereof, either
directly or through county pest inspectors.
6-10-4. COUNTY PEST INSPECTORS.--The persons who may be employed under this
article, aside from employees of the department of agriculture, shall be county peat
inspectors and their deputies, who shall be appointed by the county commissioners of
the county where they are to serve and receive their pay. The county commissioners
of any county when petitioned by not less than fifty landowners of their county shall
appoint a county pest inspector at their next regular board meeting.
6-10-5. COMPENSATION.--County pest inspectors and their deputies shall be paid
a per diem, in addition to actual and reasonable expenses for carrying out the pro-
visions of this article, the amount of such per diem and the term of office to be
fixed by the county commissioners of the county concerned.
6-10-6. EXAMINATIONS.--It shall be the duty of the department of agriculture
to examine all persons appointed by the county commissioners to act as county pest
inspectors, and, if found competent and fully qualified to perform the duties of the
office, the department shall issue to such applicants a license as county pest
inspector. No person shall act as pest inspector unless he holds such license,
which shall certify to the competency of the applicant and shall authorize him to
act as county pest inspector for a period of two years from date; provided, that no
person engated in the nursery business, either as owner, agent, employee, or sales-
man shall be eligible for this position.
6-10-7. INSPECTIQNS.--(1) The department of agriculture shall inspect, when
it seems necessary, orchards, farm and garden crops and any other premises or objects
to determine if any of them are infested or infected with pests which may be dis-
seminated to the injury of others and he shall devise means for control of such
pests when possible. If such pests are found, the owner or renter or person in
charge of the infested or infected property or premises must destroy the pests
concerned under the direction of, and to the satisfaction of the inspector, and
within a period of time specified by the inspector, unless the inspector deems it
necessary himself to destroy the pests or articles on which they are found. Such
destruction shall be at the expense of the owner and with no recompense therefor,
but the cost to any one owner of property involved shall not exceed two hundred
fifty dollars.
(2) The department of agriculture, or a county pest inspector, when it is
deemed necessary and it has been authorized by the board of county commissioners
of the county, after notice to the owner or person in charge, shall spray, fumigate,
disinfect or otherwise treat trees, shrubbery, potatoes, plants, buildings, or other
property. Upon the completion of such work a statement of the cost and expense
thereof, with a description of the property upon which such work was done, shall be
filed with the board of county commissioners, who shall pay same without unnecessary
delay.
(3) Upon payment by the county commissioners of any such cost and expense,
they shall make demand in writing upon such owner or person in charge, in person or
by mail addressed to him at his last known place of residence, for reimbursement to
the county for the amount of such cost and expense. Such written notice shall in-
form such person that he may appear before the board of county commissioners at any
meeting thereof, as fixed by law, to be held within the following four months, and
be heard as to the amount of such claims. If the claim, as originally demanded by
the board, or as adjusted upon such hearing, be not paid at the end of such period,
the board shall certify such claim to the county treasurer who *hall add the amount
thereof to any taxes due, or to become due, from the debtor or owner, and if not
paid in due course, the same shall be collected by the county treasurer as delinquent
taxes. All such accounts when collected shall be paid into the general fund of the
county.
6-10-8. UNLAWFUL TO TRANSPORT PESTS.--It shall be unlawful for any person, by
any means whatsoever, to knowingly transport, into or in Colorado, live pests which
may be injurious to agriculture or horticulture in the state, except for scientific
purposes, without permission from the department of agriculture.
6-10-9. DISPOSAL OF PEST RIDDEN MATERIAL.--Any shipment of any plant material
in or into Colorado when found, or deemed liable, to carry pests or if in violation
of any Colorado or federal quarantine, may be placed in isolation or quarantine by
the state department of agriculture, and shall be completely under its control. The
owner or bailee shall abate such pests as directed by and to the satisfaction of the
department of agriculture unless the latter determines it advisable to destroy the
pest ridden articles and appurtenances thereto, or orders the same removed from the
state within forty-eight hours at the expense of the owner and without recompense
therefor in either case. Articles not removed from the state as ordered shall be
destroyed by the inspector after forty-eight hours with no recompense therefor to
the owner.
6-10-10. QUARANTINES.--Whenever the department of agriculture in its investi-
gations shall find any portion of the state to be affected with serious pests and
in its judgment farm products, domestic animals or other objects from the district
affected would be liable to spread the pests into other sections to the injury of

others, the-department may declare a quarantine against such section to prevent the
transfer of carriers of such pests from the quarantined area. Whenever it is ascer-
tained that pests are likely to be introduced into Colorado by the importation of
farm products, farm animals or other objects, the department of agriculture may
declare a quarantine against the importation into Colorado of such pest carriers.
Quarantines promulgated by the department of agriculture shall have full force and
effect of law and violations thereof shall be subject to the same penalties as are
violations of this article.
6-10-11. EMERGENCY INSPECTION.--Should demand arise or circumstances necessi-
tate inspection for pasts of crops, plant material or other articles or premises, the
department of agriculture is authorized to provide such inspection and to charge the
owner adequate fees therefor to cover cost of such inspections. The department of
agriculture shall have authority to impound, prohibit movement, sale or disposal of
such crops, plant material or other articles until such fees are paid; provided, that
relaese of such crops, plant materials or other articles shall also be dependent on
meeting all inspection requirements.
6-10-12. RIGHT OF ENTRY.--Persons employed under this article, together with
such help as they may need in the prosecution of their work, are authorized, during
reasonable business hours, to enter upon or into any premises, land, buildings, or
other places of business for the purpose of carrying out the provisions of this
article , or any other law administered by the department of agriculture.
6-10-13. FEDERAL AGREEMENTS.--The department of agriculture may enter into agree-
ments with any agency of the federal government and delegate authority to representa-
tives thereof when such agencies or representatives may assist in carrying out the
provisions of this article, or any other law administered by the department of agri-
culture.
6-10-14. PENALTIES.--Each and every violation of any of the provisions of
this article and each and every noncompliance with any notice or direction given
by any person employed under this article shall be punishable by a fine in the sum
of not less than twenty-five dollars, nor more than five hundred dollars, and each
and every day that any person, firm or corporation shall fail to comply with any
notice in writing from the department of agriculture or other person employed under
this article, shall be deemed a separate offense. The abuse or misuse, in the judg-
ment of the department of agriculture, of any certificate, permit or appointment
shall be cause for the revocation of such instrument.
6-10-15. REPORTS.--County pest inspectors shall make a full report of work
done to the department of agriculture once each month.

The Dutch Elm Disease Order made effective February 27, 1969, is hereby
revoked and reenacted in the following manner, to become effective February 1,
1971, and to remain in full force and effect until further notice.
DUTCH ELM DISEASE ORDER
WHEREAS, the fact has been determined that Dutch elm disease, caused by the
fungus Ceratocystis ulmi, the most devastating shade tree disease in the United
States, has become established in certain areas of Colorado; and
WHEREAS, there is no cure presently known for this disease once it has be-
come established, except to destroy the infected wood;
NOW, THEREFORE, I, Clinton E. Jeffers, Commissioner, Colorado Department of
Agriculture, under the authority vested in me by the Colorado Department of Agri-
culture Act, Chapter 6, Article 1; the Pest Control Act, Chapter 6, Article 10;
and the Pest and Plant Quarantine Act, Chapter 6, Article 11, Colorado Revised
Statutes 1963, by this order declare all trees of any species or variety of the
genus Ulmus infected with Ceratocystis ulmi in the State of Colorado to be a
threat and a hazard to all elm trees in Colorado, and by this order require that
all above-ground portions of such infected trees be destroyed or properly dis-
posed of as provided herein.
It shall be unlawful to possess or to transport into or within the State of
Colorado all or any part of trees infected with the aforementioned fungus; PRO-
VIDED, HOWEVER, that wood, branches and roots of such trees may be transported
either to a safe place for burning or burial under a minimum of two feet of
earth within ten days following discovery of such infection, or to such sites
and under such conditions as are approved by the Department of Agriculture for
processing and subsequent elimination of the disease hazard; and, PROVIDED
FURTHER, that infected trees may be treated in a manner approved by the Depart-
ment of Agriculture to effect a cure for the disease, if and when en effective
cure becomes known.
Possession of living cultures of Ceratocystis ulmi in any of its life
stages, except by qualified persons for diagnostic or research purposes as
approved by the Department of Agriculture, shall be unlawful.

Trees or parts thereof of the genus Ulmus in a dead or dying condition that
may serve as a breeding place for the smaller European elm bark beetle Scolytus
multistriatus, or the native elm bark beetle, Hylurgopinus rufipes, are hereby
declared to be a threat and a hazard to all elm trees in Colorado. Transporta-
tion into or within the State of Colorado or possession within the State of
Colorado of such trees or parts thereof, except for immediate burning or burial,
or for processing in a manner approved by the Department of Agriculture, shall
be unlawful unless the bark has been completely removed; PROVIDED, HOWEVER, that
brood wood may be maintained by such persons and under such conditions as are
approved by the Department of Agriculture for research purposes.
The penalty for violation or noncompliance with this order, as provided by
Chapter 6, Article 10, Section 14, CRS 1963, shall be a fine of not lees than
twenty-five dollars, nor more than five hundred dollars, with each day of viola-
tion or noncompliance being deemed a separate offense.

NOW, THEREFORE, I, John P. Orcutt, Commissioner, Colorado Department of Agriculture,
under the authority vested in me by the Colorado Department of Agriculture Act, Chapter
6, Article 1; the Pest Control Act, Chapter 6, Article 10; and the Pest and Plant
Quarantine Act, Chapter 6, Article 11, Colorado Revised Statutes 1963, by this order
declare all trees of any species or variety of the genus Ulmus infected with
Ceratocystis ulmi in the State of Colorado to be a public nuisance and to be a threat
and a hazard to all elm trees in Colorado, 'and by this order require that all above
ground portions of such infected trees be destroyed. It shall be unlawful to process,
sell, give away or transport into or within the State of Colorado all or any part of
trees infected with the aforementioned fungus; PROVIDED, HOWEVER, that wood, branches
and roots of such trees may be transported to a safe place for burning or burial under
a minimum of two (2) feet of earth within ten (10) days following discovery of such
infection.
Trees or parts thereof of the genus Ulmus in a dead or dying condition that may

Approved elm tree sanitation methods and culture should be practiced in all areas
to prevent the dissemination of Dutch Elm Disease to noninfected areas in Colorado..
This order shall take effect on and after February 27, 1969 , and
remain in full force and effect until further notice.

the state department of agriculture, and shall be completely under its control. The
owner or bailee shall abate such pests as directed by and to the satisfaction of the
department of agriculture unless the latter determines it advisable to destroy the
peat ridden articles and appurtenances thereto, or orders the same removed from the
state within forty-eight hours at the expense of the owner and without recompense
therefor in either case. Articles not removed from the state as ordered shall be
destroyed by the inspector after forty-eight hours with no recompense therefor to
the owner.
6-10-10. QUARANTINES.--Whenever the department of agriculture in its investi-
gations shall find any portion of the state to be affected with serious pests and
in its judgment farm products, domestic animals or other objects from the district
affected would be liable to spread the pests into other sections to the injury of

others, the department may declare a quarantine against such section to prevent the
transfer of carriers of such pests from the quarantined area. Whenever it is ascer-
tained that pests are likely to be introduced into Colorado by the importation of
farm products, farm animals or other objects, the department of agriculture may
declare a quarantine against the importation into Colorado of such pest carriers.
Quarantines promulgated by the department of agriculture shall have full force and
effect of law and violations thereof shall be subject to the same penalties as are
violations of this article.
6-10-11. EMERGENCY INSPECTION.--Should demand arise or circumstances necessi-
tate inspection for pasts of crops, plant material or other articles or premises, the
department of agriculture is authorized to provide such inspection and to charge the
owner adequate fees therefor to cover cost of such inspections. The department of
agriculture shall have authority to impound, prohibit movement, sale or disposal of
such crops, plant material or other articles until such fees are paid; provided, that
relaese of such crops, plant materials or other articles shall also be dependent on
meeting all inspection requirements.
6-10-12. RIGHT OF ENTRY.--Persons employed under this article, together with
such help as they may need in the prosecution of their work, are authorized, during
reasonable business hours, to enter upon or into any premises, land, buildings, or
other places of business for the purpose of carrying out the provisions of this
article , or any other law administered by the department of agriculture.
6-10-13. FEDERAL AGREEMENTS.--The department of agriculture may enter into agree-
ments with any agency of the federal government and delegate authority to representa-
tives thereof when such agencies or representatives may assist in carrying out the
provisions of this article, or any other law administered by the department of agri-
culture.
6-10-14. PENALTIES.--Each and every violation of any of the provisions of
this article and each and every noncompliance with any notice or direction given
by any person employed under this article shall be punishable by a fine in the sum
of not less than twenty-five dollars, nor more than five hundred dollars, and each
and every day that any person, firm or corporation shall fail to comply with any
notice in writing from the department of agriculture or other person employed under
this article, shall be deemed a separate offense. The abuse or misuse, in the judg-
ment of the department of agriculture, of any certificate, permit or appointment
shall be cause for the revocation of such instrument.
6-10-15. REPORTS.--County pest inspectors shall make a full report of work
done to the department of agriculture once each month.
