Dear Kris and Weld County Board of County Commissioners,
The Planning Commission agenda on May 3, 2022 included Case Number 2MJUSR22-17-0003, Applicant
GEORGE L. SANDBURG IRREVOCABLE TRUST, ATTN: JENNIFER WINTER AND MICHELLE FRIED,
C/O WINTER SEED AND AG SERVICES,LLC. This agenda item was approved by the Planning Commission
with a 4-1. I cast the only negative vote regarding this case. I want to explain the rationale for my negative support
regarding this matter.
In my opinion this proposed and expanded business and several of the proposed business activities and material
storage functions represent significant potential risks of contamination and pollution to the groundwater and surface
water runoff in the area. It is obvious from the photographs and information submitted during the hearing that
surface and roadway drainage systems are wholly inadequate to manage and control drainage and surface water
runoff from the subject property and adjoining properties. My experience in dealing with contaminated water from
similar sites and other projects through the CERCLA and RCRA superfund contamination programs is the basis of
my concerns. The current business owners and Weld County supports the growth and success of business. I Iowever,
in this proposed project configuration, there certainly is the potential for significant surface and groundwater
contamination caused by the proposed sitc activities and drainage solutions under consideration. In my opinion the
plan and the proposed drainage solutions are inadequate to protect the area from potential contamination.
This is a brief summary of the rationale that caused my negative support regarding this case. I am available to
discuss these matters with the BOCC at your convenience. Best wishes and thanks for your services to the citizens
