ZONE DISTRICT TO THE A (AGRICULTURAL) ZONE DISTRICT - MARISELA MENDEZ
A public hearing was conducted on August 3, 2022, at 10:00 a.m., with the following present:
Commissioner Scott K. James, Chair

The following business was transacted:
El I hereby certify that pursuant to a notice dated June 23, 2022, and duly published June 25,
2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Marisela
Mendez, for a Change of Zone, COZ22-0006, from the R-1 (Low -Density Residential) Zone
District to the A (Agricultural) Zone District. Karin McDougal, Assistant County Attorney, made
this a matter of record.
Chair James reviewed the procedures to follow should this case result in a tie vote, due to
four (4) Commissioners being present and Commissioner Saine being excused.
Michael Hall, Department of Planning Services, presented a brief summary of the proposal,
explained the historical uses on the property, as well as surrounding uses, and described the
Notice of Hearing sign posting. Mr. Hall stated the site is located east of and adjacent to Birch
Avenue, and approximately 225 feet south of East 18th Street, with an existing access onto
County Road (CR) 41.8, also known as Birch Avenue, which is a privately maintained roadway
associated with the Union Colony Subdivision and intersects with East 18th Street, also known
as East U.S. Highway 34, which is maintained by CDOT. The roads are considered adequate in
functional classification, structural capacity and width for the potential traffic associated with the
proposed zone district. He presented a slide show and explained the Change of Zone criteria,
stating the property is located within an annexation area of the City of Greeley; however,
annexation is not being considered for this request. He explained the site has a City of Greeley
water tap and utilizes an On -site Wastewater Treatment System. Mr. Hall relayed the City of
Greeley's referral of May 25, 2022, indicated no concerns with the Change of Zone request, and
future development of the property may require annexation. He displayed a map depicting
rights -of -way in the area, displayed images of the site and surrounding views, and entered the
favorable recommendation of the Planning Commission into the record as written.

Marisela Mendez, applicant, reiterated the reason for her request.
Edwin Grant, Greeley resident, asked if the nearby Senior Assisted Living home had any
concerns with the request.
Steve Teets, Greeley resident, stated he believed the assisted living home is closer to East
18th Street and would not be affected by the request.
In response to Chair James, Ms. Mendez indicated she had reviewed the Draft Resolution
had no questions or issues, and agreed to abide by the Conditions of Approval, as presented.
The Board reviewed the draft Resolution and agreed to the Conditions of Approval, as
presented.
El Commissioner Freeman moved to approve the request of Marisela Mendez for a Change of
Zone, COZ22-0006, from the R-1 (Low -Density Residential) Zone District to the A (Agricultural)
Zone District, based on the recommendations of Planning staff and the Planning Commission,
with the Conditions of Approval, as presented. The motion was seconded by Commissioner
Moreno, and it carried unanimously. There being no further discussion, the hearing was
completed at 10:10 a.m.
This Certification was approved on the 17th day of August, 2022.
