CAUSE HEARING TO DETERMINE WHETHER OR NOT THE PERMITTEE IS IN
COMPLIANCE WITH CERTAIN DEVELOPMENT STANDARDS, FOR SITE SPECIFIC
DEVELOPOMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR-895, FOR A
SOLID WASTE DISPOSAL SITE AND FACILITY, AND USR18-0065, FOR A SOLID
WASTE DISPOSAL SITE AND FACILITIES, IN THE A (AGRICULTURAL) ZONE
DISTRICT - WASTE MANAGEMENT DISPOSAL SERVICES OF COLORADO, INC.
A public hearing was conducted on June 20, 2022, at 9:00 a.m., with the following present:

The following business was transacted:
A public Probable Cause hearing, PCSC22-0011, was conducted to consider setting a Show
Cause Hearing to determine whether or not the permittee, Waste Management Disposal Services
of Colorado, Inc., is in compliance with certain Development Standards contained in Use by
Special Review Permit, USR-895, for a Solid Waste Disposal Site and Facility, and USR18-0065,
for a Solid Waste Disposal Site and Facilities, in the A (Agricultural) Zone District. Bruce Barker,
County Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the violations,
provided the general location of the site, and displayed images of the initial site visit on April 25,
2022, as well as subsequent visits, most recently on June 18, 2022. Mr. Ogle stated as of June 18,
2022, the litter netting north of State Highway 14 had been replaced and on -site litter had been
bagged and disposed of, noting there was still some off -site litter, and several dead trees onsite.
He stated Staff recommends setting a Show Cause hearing for six (6) months later to afford the
permittee time to gain compliance with the Development Standards indicated in his presentation.
Chris Anderson, Waste Management Disposal Services of Colorado, Inc., stated he did not
have additional comments.
Commissioner Freeman stated he has lived near the facility since it was built and had never
seen a previous issue. He described the wind this spring as unusual and iterated supply chain
issues made it difficult for Waste Management Disposal Services of Colorado, Inc., to obtain the

necessary netting. Commissioners Freeman and Moreno indicated they would be in favor of a
continuance of the Probable Cause hearing. In response to Commissioner Saine, Mr. Anderson
confirmed they had completed the litter netting replacement, relayed there is still some off -site
litter that needs to be cleaned up, and outlined the proactive steps they are taking to ensure
compliance at the facility. After discussion of the timeframe for a continuance, the Board decided
to continue said matter to August 31, 2022, at 9:00 a.m.
In the matter of Probable Cause hearing, PCSC22-0011, Commissioner Saine moved to
continue the Probable Cause hearing to August 31, 2022, at 9:00 a.m., for Use by Special Review
Permit, USR-895, for a Solid Waste Disposal Site and Facility, and USR18-0065, for a Solid
Waste Disposal Site and Facilities, in the A (Agricultural) Zone District, held by Waste
Management Disposal Services of Colorado, Inc. The motion was seconded by
Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing
was completed at 10:01 a.m.
This Certification was approved on the 6th day of July, 2022.
