RE: APPROVE AMENDMENT #1 TO TASK ORDER CONTRACT FOR HEALTH
DISPARITIES AND COMMUNITY GRANT PROGRAM (HDCGP) FOR THRIVING WELD
HOUSING AND LAND USE PROJECT, AND AUTHORIZE CHAIR TO SIGN AND
SUBMIT ELECTRONICALLY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with Amendment #1 to the Task. Order
Contract for the Health Disparities and Community Grant Program (HDCGP) for the Thriving Weld
Housing and Land Use Project between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public Health
and Environment, and the Colorado Department of Public Health and Environment, commencing
upon full execution of signatures, and ending June 30, 2023, with further terms and conditions
being as stated in said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Amendment #1 to the Task Order Contract for the Health Disparities
and Community Grant Program (HDCGP) for the Thriving Weld Housing and Land Use Project
between the County of Weld, State of Colorado, by and. through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Health and Environment,
and the Colorado Department of Public Health and Environment, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to electronically sign and submit said amendment.

For the Board's approval is a contract amendment between the Colorado
Department of Public Health and Environment (CDPHE)/Office of Health Equity
and the Board of County Commissioners of Weld County for the use and benefit of
the Weld County Department of Public Health and Environment (WCDPHE).
Housing is a significant public health concern given the association between
chronic stress and housing instability and unaffordability as well as the myriad of
negative health outcomes associated with being rent burdened and living in
overcrowded environments. This project will enable staff to work with
communities and municipal governments to identify effective land -use code
modifications and affordable housing policies that can be implemented by
municipal governments to increase affordable housing options.
With the approval of the Board, the WCDPHE will enter the second contract period
of a four-year contract with CDPHE, beginning July 1, 2022, and ending June 30,
2023. The funding amount for year two is $265,737.00. Activities will be conducted
by current staff; no additional FTE is being requested. This grant also includes a
previously approved subcontract with United Way of Weld County.
Assistant Weld County Attorney, Karin McDougal, has reviewed this contract and
determined that its terms are acceptable.
The Board approved placement of this contract on the Board's agenda via pass -
around dated May 23, 2022.
I recommend approval of this contract amendment with CDPHE.

Brief description of the problem/issue:
For the Board's review and approval for placement on the agenda is a contract amendment between the
Colorado Department of Public Health and Environment (CDPHE)/Office of Health Equity and the Board of
County Commissioners of Weld County for the use and benefit of the Weld County Department of Public
Health .and Environment (WCDPHE).
Housing is a significant public health concern given the association between chronic stress and
housing instability and unaffordability as well as the myriad of negative health outcomes associated
with being rent burdened and living in overcrowded environments. This project will enable staff to
work with communities and municipal governments to identify effective land -use code modifications
and affordable housing policies that can be implemented by municipal governments to increase
affordable housing options.

This contract is undergoing review by Assistant Weld County Attorney, Karin McDougal, and we will
await that approval prior to placement on the Board's agenda.
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
Approval of this contract will permit WCDPHE to receive funding from CDPHE to significantly impact
affordable housing in Weld County by paying for staff and additional operating costs that are needed to
undertake these activities and may otherwise not be attainable from other sources.
Declining this contract will result in the termination of the new Housing and Land Use Project. Without
funding for personnel and operating costs, the project will not be feasible to implement. A shortage of
affordable housing options may continue in Weld County and the negative impacts associated with
unaffordable housing may increase.
Recommendation: I recommend approval of this contract amendment with CDPHE.

1. PARTIES
This Amendment (the "Amendment") to the Original Contract shown on the Signature and Cover
Page for this Amendment (the "Contract") is entered into by and between the Contractor, and the
State.
2. TERMINOLOGY
Except as specifically modified by this Amendment, all terms used in this Amendment that are
defined in the Contract shall be construed and interpreted in accordance with the Contract.
3. AMENDMENT EFFECTIVE DATE AND TERM
A. Amendment Effective Date
This Amendment shall not be valid or enforceable until the Amendment Effective Date
shown under the State Controller Signature. The State shall not be bound by any provision of
this Amendment before that Amendment Effective Date, and shall have no obligation to pay
Contractor for any Work performed or expense incurred under this Amendment either before
or after of the Amendment term shown in §3.B of this Amendment.
B. Amendment Term
The Parties' respective performances under this Amendment and the changes to the Contract
contained herein shall commence on the Amendment Effective Date shown under the State
Controller Signature or July 1, 2022, whichever is later, and shall terminate on the
termination of the Contract.
4. PURPOSE
The Parties entered into the agreement to increase affordable housing options for low- to
moderate -income earners in Weld County by working with Weld County municipalities and the
affected population to explore modifying land -use codes and policy change.
The Parties now desire to renew for an additional term and change current Contract Maximum
Total for the following reason: update Statement of Work and Budget for FY23 renewal.
5. MODIFICATIONS
The Contract and all prior amendments thereto, if any, are modified as follows:
A. The Contract Maximum Amount table is deleted and replaced with the Current Contract
Maximum Amount table shown on the Signature and Cover Page for this Amendment.

6. LIMITS OF EFFECT AND ORDER OF PRECEDENCE
This Amendment is incorporated by reference into the Contract, and the Contract and all prior
amendments or other modifications to the Contract, if any, remain in full force and effect except
as specifically modified in this Amendment. Except for the Special Provisions contained in the
Contract, in the event of any conflict, inconsistency, variance, or contradiction between the
provisions of this Amendment and any of the provisions of the Contract or any prior modification
to the Contract, the provisions of this Amendment shall in all respects supersede, govern, and
control. The provisions of this Amendment shall only supersede, govern, and control over the
Special Provisions contained in the Contract to the extent that this Amendment specifically
modifies those Special Provisions.

STATEMENT OF WORK
These provisions are to be read and interpreted in conjunction with the provisions of the contract specified above.
I. Entity Name: Weld County Department of Public Health and Environment
Term: July 1, 2022 —June 30, 2023
II. Project Description: This project serves to build an engaged community that can work with municipalities to explore
modifying land -use codes and implementing policies to increase affordable, high quality, stable, and safe housing in
Weld County. To accomplish this, the Weld County Department of Public Health and Environment (WCDPHE) shall
work directly with Weld County municipalities and low -to -moderate income earners to identify affordable housing
policies and land -use code modifications to increase affordable housing options for low -to -moderate income earners
through a community and municipal engagement approach. Affordable housing options are needed as Weld County is
facing a serious housing crisis. The current population of 325,000 has already greatly increased over the past few
years and is projected to grow to 548,000 residents by 2040. This project is beneficial to the State of Colorado as
affordable housing is a significant public health concern given the association between chronic stress, housing
instability, unaffordability and the fact that unaffordable housing disproportionally affects low- to moderate -wage
earners. In addition to chronic stress, low- to moderate -income earners may be rent burdened (30% of monthly
income for housing), live in overcrowded or double -up (multiple family) environments, and live in unsafe,
substandard housing which may be associated with a myriad of negative health outcomes including auto -immune
illnesses, cancer, asthma, obesity, cardiovascular and pulmonary diseases.
The affected population this project plans to engage, and who would benefit from the project, are low -to -moderate -
income earners in Weld County. Low- to moderate -income earners would primarily benefit through an increase in
affordable housing options that were determined through a collaborative process in which they were involved.
Secondly, low -to -moderate income earners would benefit from training that enables community members to become
engaged in decision -making processes and gain the knowledge, skills, and tools necessary to promote change.
Project activities will be performed in both the rural, unincorporated areas of Weld County as well as municipalities
across the county. The types of activities to be performed include the creation of community and municipality
engagement plans, a Housing Needs Assessment, and a Weld County Housing Report. Expected outcomes include an
inventory of housing and land -use policy options and an engaged community that has the knowledge, skills, and tools
to promote change.
Pursuant to the Colorado Revised Statutes (C.R.S.) 25-4-2205, the purpose of the Office of Health Equity is to serve
in a coordinating, educating, and capacity -building role for state and local public health programs and community -
based organizations promoting health equity in Colorado, by implementing strategies tailored to address the varying
complex causes of health disparities, including the economic, physical, and social environment.
III. Definitions:

income earners in order to facilitate their engagement in land -use and housing policy decision -making in Weld
County

planners, and officials engaged in land -use and housing policy decisions in Weld County
5. Quarters:
Q1 — Quarter 1: July 1 -September 30, 2022
Q2 — Quarter 2: October 1 -December 31, 2022
Q3 — Quarter 3: January 1 -March 31, 2023
Q4 — Quarter 4: April 1 -June 30, 2023.

1. The Contractor shall use the Community Engagement Plan to facilitate community
engagement events to inform the community about the connection between housing
and health, give an overview of policy and land -use options to increase affordable
housing and gather data on lived experience related to housing affordability in Weld
County.
Sub -Activities #1
1. The Contractor shall schedule community engagement events.
2. The Contractor shall create materials for community engagement events in English and
Spanish.
3. The Contractor shall advertise community engagement events.
4. The Contractor shall facilitate a minimum of five (5) community engagement events.
5. The Contractor shall collect data on community members' lived experiences related to
affordable housing in Weld County at community engagement events.
6. The Contractor shall document internal successes and challenges encountered during
implementation of the Community Engagement Plan.
7. The Contractor shall update the Community Engagement Plan.
Primary Activity #2
2. The Contractor shall use the Municipal Engagement Plan to facilitate municipal
engagement meetings to build relationships and explore affordable housing and land -
use options.
Sub -Activities #2
1. The Contractor shall contact municipal staff and elected officials to discuss housing burden
and affordable housing.
2. The Contractor shall create materials for municipal engagement meetings.
3. The Contractor shall facilitate meetings with city and town officials, planners, and staff to
share information on housing burden in Weld County and solicit feedback and support.
4. The Contractor shall collect data from municipal staff to analyze views on housing issues
and to identify potential solutions to increase affordable housing within the communities.
5. The Contractor shall document internal successes and challenges encountered during
implementation of the Municipal Engagement Plan.
6. The Contractor shall update the Municipal Engagement Plan to reflect any modifications.

1. The Contractor shall develop key messages and talking points for community engagement
events and municipal meetings.

3. The Contractor shall analyze local housing stock, expected and experienced growth, and
current housing shortages from municipal, county and state sources.
4. The Contractor shall develop the Housing Needs Assessment Report for Weld County using
the quantitative and qualitative data gathered.

5. The Contractor shall disseminate the Housing Needs Assessment Report to county and
municipal staff and key stakeholders.

5. The Contractor shall disseminate the Weld County Housing Report to county and municipal
staff, community members, and key stakeholders to better understand housing issues in

1. The content of electronic documents located on CDPHE and non-CDPHE website and
information contained on CDPHE and non-CDPHE website may be updated periodically
during the contract term. The Contractor shall monitor documents and website content for
updates and comply with all updates.
2. The Contractor shall submit quarterly progress reports on the template provided by CDPHE
and follow the Quarterly Reporting Guidance. This document is incorporated, made part of
this contract by reference and is available on the following website which has been

3. CDPHE will provide the Contractor with the quarterly progress report template via email
within 60 days of the date of this Contract.
4. The Contractor shall participate in the cross -site and grantee -led evaluations:
a) using specific tools, resources, templates and guidelines;
b) providing baseline data, metrics, measures and progress reporting via a reporting tool
provided by the HDCGP evaluation contractor;
c) adhering to established timelines and schedules;
d) through evaluation -related training and technical assistance;
e) providing access to program information and data as needed by the HDCGP evaluation
contractor; and
f) other evaluation monitoring and data submissions as determined by the evaluation
contractor and HDCGP
5. The Contractor shall include the following information in the Housing Needs Assessment
Report:
a) demographics
b) economic information
c) local housing stock
d) expected and experienced growth
e) housing shortages
f) existing land -use codes, and
g) housing policies in municipalities.

CDPHE's monitoring of this contract for compliance with performance requirements will be conducted throughout
the contract period by the Health Disparities Grant Program Manager and Fiscal Officer. Methods used will include a
review of documentation determined by CDPHE to be reflective of performance to include fiscal and programmatic
documentation as applicable. The Contractor's performance will be evaluated at set intervals and communicated to the
Contractor. A Final Contractor Performance Evaluation will be conducted at the end of the life of the contract.
VI. Resolution of Non -Compliance:
The Contractor will be notified in writing within ten (10) calendar days of discovery of a compliance issue. Within
thirty (30) calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to determine
the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The
action(s) and timeline for completion will be documented in writing and agreed to by both parties. If extenuating
circumstances arise that require an extension to the timeline, the Contractor must email a request to the Health
Disparities Grant Program Manager and receive approval for a new due date. The State will oversee the
completion/implementation of the action(s) to ensure timelines are met and the issue(s) is resolved. If the Contractor
demonstrates inaction or disregard for the agreed upon compliance resolution plan, the State may exercise its rights
under the provisions of this contract.
