HomeMy WebLinkAbout710342.tiff RESOLUTION WHEREAS, a public hearing was held on Monday, August 23, 1971, for the purpose of hearing the petition of Cowan Feeders, c/o Robert W. Scherlong, LaSalle, Colorado, requesting permission for expansion of an existing cattle feedlot operation on the following des- cribed property, to-wit: The Northeast Quarter (NEB) of Section Eighteen (18), Township Three (3) North, Range Sixty-four (64) West of the Sixth (6th) P. M. , Weld County, Colorado; and that part of the Northwest Quarter (NW4) of Section Seventeen (17), Township Three (3) North, Range Sixty-four (64) West of the Sixth (6th) P. M. , Weld County, Colorado, described as follows, to-wit: Beginning at the Northwest Corner (NW Cor) of said Section 17, thence North 89° 11' 30" East a distance of 470. 25 feet; thence South 00 37' 8" West a distance of 1459. 65 feet; thence North 89° 22' 0" West a distance of 454. 2 feet to a point on the West line of said Section 17; thence North along said West line of Section 17 a distance of 1448 feet to the point of beginning, and WHEREAS, the petitioner was present and represented by Mr. Phil Reed, and WHEREAS, there was no opposition to the request of petitioner for the expansion of an existing cattle feedlot operation, and WHEREAS, according to Section 3. 3(3)(c) of the Zoning Resolution of Weld County, said cattle feedlot operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners, Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Cowan Feeders, c/o Robert W. Scherlong, LaSalle, Colorado, for the expansion of an existing cattle feedlot operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to expand said feedlot and that he shall have up to one year from date hereof to begin construction for the expansion thereof. 3. That all applicable subdivision regulations and zoning regulations be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. PL0709 710342 4. SUBJECT : Minutes MOTION : By Mr . Bowles to approve the minutes of the last regular meeting as mailed . Second by Mr . Bartels . A unanimous vote of "Aye" . Motion carried . APPLICANT : Northern Colorado Feeder Pig Co-op CASE NUMBER: SUP #113 tape 361 - 362 SUBJECT : Expansion of the hog operation LOCATION : SW4 Sec 22 T8 R66 APPEARANCE : Melvin Hoffner , Walter Danielson DISCUSSION : Mr . Lorenson recommended denial of the application . It is located within one-half mile of the Town of Pierce , it is not compatible with the proposed policy of developing future residential expansion around existing towns . When original approval was given to this site , there was no policy concerning development that had been formulated at that time . There is opposition to the development by the Town of Pierce. The County Agent and the Health Department detect no problems with the proposed expansion . The soil presents no problems . Mr . Lorenson read the letter from the Town of Pierce opposing the expansion . Mr. Danielson stated they have an operation they are proud of. Doesn ' t: feel there is an odor problem. They have 325 sows at the present time and wished to expand to 600 sows . Mr . Hoffner ex- plained their plot plan showing the present operation and the proposed expansion . Stated fly control and _ odor control is being practised. They get some odor when the manure is scattered . Mr . Paul stated there is a pollution law at this time and if the oder becomes too bad they can be sued . He suggested pumping the sludge into the honey wagon and moving further away to irrigate with the sludge . Mr. Lorenson stated he didn ' t feel there is anything wrong with the operation or the soils , the point is it is an intense agricultural use one-half mile from the town . Mr. Gallatin , mayor of Pierce and spokesman for the town , stated the utmost care in sanitation is practised by the operators of this facility but they do have an odor problem, which is not every day but they have had a lot of complaints . Felt the future growth of Pierce will be to the west. Mr . Bowles stated he felt the applicants should reconsider their investment as it is very likely they might be shut down . Mr. Nix suggested the matter be 559 ti taken under advisement . MOTION : By Mr. Bowles to take the matter under advisement. Second by Mr. Anderson . A vote of "Aye" by Anderson , Bartels , Bowles , Clark , Heitman , Nix and Weigand . Motion carried . DISCUSSION : Mr. Weigand stated the Feeder Pig Coop stands right in the growth pattern of Pierce . Mr . Bowles stated the people of Pierce were opposed to the operation in the first place but were told there would be no odor involved whatsoever . Mr . Lorenson stated he felt the only odor is when they clean the place out and start spreading the sludge on the field . Mr. Weigand stated there have been approximately ten houses put in on the west side of Pierce . Felt if the expansion is allowed , they would be tell - ing Pierce they are through . RESOLUTION : (tape 362) Be it therefore resolved to recommend denial to the Board of County Commissioners . Motion by Mr. Heitman stating the Planning Commission has as policy tried to discourage all kinds of growth that is not adjacent to existing towns . Mr . Bowles stated the Planning Commission had been assured there would be no basis of complaints regarding odor by the proponents and there obviously have been complaints and the Planning Commission would be derelict to let them expand . Mr. Weigand stated they are trying to discourage the urban sprawl . It was agreed to incorp- orate these remarks in the motion . , Second by Mr . Anderson . A vote of VAye" by Anderson , Bartels , Bowles , Clark , Heitman , Nix and Weigand . Motion carried. APPLICANT: David Fagerburg CASE NUMBER : S-90 tape 361 SUBJECT: Preliminary plat of Grand View Estates LOCATION : Wz SW4 Sec 24 T6 R66 + EZ SE4 Sec 23 T6 R66 APPEARANCE : Tom Collins , Jim Barton , Tim O ' Neal , David Fagerburg DISCUSSION : Mr . Barton presented the preliminary plat , the area is zoned "E" "Estates " . It is located east of Seeley Lake . They are proposing 1 acre lots . They would use North Weld water and septic tanks at the present time. Stated percolation tests have been submitted to the County Health Department as well as the Planning department. They plan to relocate 35th Avenue , this has been tentatively approved by the County Engineer. Mr. Lorenson recommended denial of the plat because the soil problem in part of the area would effect septic systems . Seasonal high water tables would also effect the septic systems . A major portion of the site is assessed as irrigated C-2 land which indicates it has a value of $120 . 00 per acre which is above the average . It has high value for agricultural use. A letter from the City of Greeley was read stating the Greeley Comprehensive Plan opposes new residential development outside the projected growth areas . This development would be outside the growth area . Greeley utility connections would be unavailable now or in the near future , septic tanks would be necessary . Due to soil conditions , there is concern regarding the environmental impact this may have on Seeley and the Poudre river . Suggested careful study be given before allowing septic tank systems in the area . Mr. Paul stated he had not been presented any information regarding the application for a septic tank system. Mr . Lorenson stated the lots meets the "A" zone requirements . Mr . O ' Neal stated there would be covenants on the area requiring owners to hook on to 7/6/71 560 a sewer system when it becomes available , also to restrict the development to where there is good percolation now, such as tract "A" . MOTION : By Mr . Bowles to table the matter until such time the County Health Department makes a recommendation . Second by Mr. Weigand . A vote of "Aye" Anderson , Bartels , Bowles , Clark , Heitman , Nix and Weigand . Motion carried . DISCUSSION : Mr . Carl Leffler stated they do have plans for a sewer system for the area . It would not hook on to the Greeley system. Mr . Collins stated at the meeting with the Utility Board , one of the requirements was that the houses be set on a level that would make it possible to hook on to a sewer system when it is made available . ,- APPLICANT : Cowan Feeders -- CASE NUMBER : SUP x#112 tape 361 __---- SUBJECT : Feed lot expansion -- LOCATION : NE4 Sec 18 T3 R64 + NW4 Sec 17 T3 R64 1 APPEARANCE : Robert Scherlong and Bill Reid . I DISCUSSION: Mr . Lorenson recommended approval . It is compatible with the surrounding land use and zoning , it has been approved by the Health Department, the County Agent stated there is no problems with the design of the expansion , there are no waste or soil problems related to it. Any possible drainage would be into a dry creek . Mr. Sherlong stated they have 12 ,000 head at this time and would increase to 22 ,000 . They would like to make a change in some of the pens . Some of the pens shown on the west side of the proposed expansion would to added to the south . They have very little run off due to the sandy soil . Mr . Lorenson stated they would have to amend their legal descrip- tion before a recommendation could be made to the County Com- missioners . RESOLUTION : Be it therefore resolved to recommend approval of the feed lot expansion to the Board of County Commissioners subject to the submission of an amended legal description . Motion by Mr . Bowles , second by Mr . Heitman . Motion to include a maximum of 22 ,000 head . A vote of "Aye" by Anderson , Bartels , Bowles , Clark , Heitman , Nix and Weigand . Motion carried . SUBJECT : Discussion with Gerhart . Brunner DISCUSSION : Mr . Lorenson stated the property in question is located two miles north of Windsor. Three building permits have been issued in that area , a fourth one was recently issued . Mr. Colette has sold 5 .parcels without subdividing . The 5th parcel was separated by a distinct area . Mr. Colette agreed to not sell any more parcels . Mr. Brunner had purchased a parcel earlier but had not applied for a building permit . Mr. Colette has offered to return Mr. Brunners money, however Mr. Brunner would like to build on this site . MOTION: By Mr . Bowles to issue a building permit to Mr. Brunner. . Second by Mr. Bartels . A vote of "Aye" by Anderson , Bartels , Bowles , Clark , Heitman , Nix and Weigand . Motion carried . SUBJECT : Colony Park DISCUSSION : Mr. Lorenson read a letter from the Town of Evans re- garding Colony Park . They objected to not having been notified 7/6/71 561 . . of the application for a zone change for Colony Park . However , the developers had been in contact with them and given a slight presentation and had requested a tie on to their sanitation district , which he found they could not supply them with . The resolution had been subject to Evans approval of the drainage . SUBJECT: Eastman Kodak DISCUSSION : Mr . Lorenson stated a letter had been received from Eastman Kodak stating they would like to help in any way to have story of the Regional Planning Commission , the past , the present and the future . It will tell about planning in both counties . They will give the Regional Planning Commission the means to put the story together. There was no action taken on it at the last meeting as they wanted further details . An executive meeting the Planning Commission was held at 6 :00 P . SUBJECT: Enforcement .of violations DISCUSSION : There was general discussion regarding the enforcement of violations in zoning , mobile homes , etc . Mr . Connell stated he had met with Bob Miller , the District Attorney, He is willing to cooperate . Civil action or criminal action can be filed by the County Commissioners for an injunction . to remove or rectify the violation . There was a general discussion re- garding Home Owner ' s Associations , the different types , the enforcement , rules and regulations . 7/6/71 662 { SUBJECT : Staff DISCUSSION : Mr . Lorenson reviewed the need for additional staff to aid the incorporated towns to complete their zoning , sub- division regulations etc . He also reviewed the income for the first six months which was mainly for building permits . Estimated the income would be higher than the original pro- posal for the year. SUBJECT : Regional program DISCUSSION . Mr. Lorenson stated the State will contribute $34 ,000 for the regional program. This amount is for Larimer and Weld counties . Each county would pay half of $17 ,000.00 in kind services . The total amount would amount to $51 ,000.00. This would be from 6/1 /71 to 6/1 /72 . Mr. Lorenson presented his proposal to get the Regional Plan done . This would mean add- itional personnel for the remainder of this year. The Regional work program was presented . It will have to be determined how the amount allotted in the budget should be used . SUBJECT : Greeley ' s road plan DISCUSSION : Mr . Lorenson presented the plan . Highway 392 would be- come an expressway or freeway type, the west Greeley by-pass would be equivalent to 83rd Avenue . Additional right-of-way will have to be obtained . This plan has been approved by the State Highway Department. MOTION : By Mr . Weigand to adopt the Greeley road plan as presented for the Greeley area . Second by Mr. Bowles . A unanimous vote of "Aye" Motion carried . SUBJECT : Greeley Comprehensive Plan DISCUSSION : Greeley would like to have the county give their approval of their Comprehensive Plan . It was agreed to meet with Greeley to review this plan before giving their approval . Meeting adjourned.
