HomeMy WebLinkAbout20221329.tiffHEARING CERTIFICATION DOCKET NO. 2022-43 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR22-0006, FOR COMMERCIAL RECREATIONAL FACILITIES (INDOOR VOLLEYBALL SPORT COURT AND TWO (2) OUTDOOR VOLLEYBALL SAND COURTS) OUTSIDE OF SUBDIVISIONS AND HISTORIC TOWNSITES IN THE A (AGRICULTURAL) ZONE DISTRICT - ANDREW CASTLE AND ANGELA KNOPF-CASTLE A public hearing was conducted on May 18, 2022, at 10:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem - EXCUSED Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jan Warwick County Attorney, Bruce Barker Department of Planning Services representative, Kim Ogle Department of Public Health and Environment representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated April 11, 2022, and duly published April 13, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Andrew Castle and Angela Knopf -Castle, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0006, for Commercial Recreational Facilities (indoor volleyball sport court and two (2) outdoor volleyball sand courts) outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Chair James called up the applicant, Angela Knopf -Castle, and reviewed the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present, and Commissioner Freeman being excused. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and described the location of the site, which is within the three (3) mile referral area and within the existing Intergovernmental Agreement (IGA) of the Towns of Windsor and Severance. He relayed the Town of Windsor returned a Notice of Inquiry (NOI) dated December 13, 2021, stating the subject property is outside the Town of Windsor's Growth Management Area, and is ineligible for annexation, and the Town of Severance returned a NOI dated February 23, 2022, stating no concerns. He relayed the Towns of Windsor and Severance, in their referral comments dated March 4, 2022, indicated they had no concerns with the application, and he reviewed the various land use designations per the Town of Severance Future Land Use Map, updated in 2020. CC: PLc /TP), PuJCClrttc LHCLO OCD/a-71Qa 2022-1329 PL2823 HEARING CERTIFICATION -ANDREW CASTLE AND ANGELA KNOPF-CASTLE (USR22-0006) PAGE 2 Mr. Ogle described the surrounding land uses, including rural residential and two Special Use by Review Permits, and displayed a map of the location of the property. He stated the access is onto County Road (CR) 25, which is a local, gravel road and requires 60 feet of right-of-way. He relayed no traffic information is available, a Drainage Narrative has been submitted, and this is a commercial sports facility, as well as ongoing residential use. He stated Notice was sent to nine (9) surrounding property owners (SPOs) with no correspondence returned. Mr. Ogle displayed images of the site and surrounding views and entered the favorable recommendation of the Planning Commission into the record as written. He requested the Board strike Condition of Approval (COA) #1.A, (Building Inspection requirements) which have already been fulfilled. e Lauren Light, Department of Public Health and Environment, stated the site is served by the North Weld Water District, with a septic system sized for three (3) bedrooms, the auxiliary building is also served by North Weld Water District, with a septic permit sized for 15 people that was issued in December 2021, but has not yet received final approval, and there is a Building Permit, which will include the final approval of the septic system. She explained Development Standards #12 through #16 are for water and septic and there are no outstanding issues with the request. IR Angela Knopf -Castle, applicant, gave her thanks to staff, expressed her privilege of working with young women in the sport of volleyball. She shared the importance of communication, friendships, and work ethic, which she is hoping to install into the young people she works with. Sara Baessler, Eaton resident, expressed her support for the applicant, sharing her two girls receive more than volleyball coaching from the applicant, including character molding and high ideals. El The Board discussed the Conditions of Approval and Development Standards, and in response to Commissioner Moreno, Ms. Knopf -Castle explained the anticipated hours of operation, which will be dependent on the seasons, and described the entrance lights to the buildings. Mr. Ogle confirmed there is no formal Lighting Plan. Chair James suggested striking a portion of the language of Development Standard (DS) #3 to strike "by pre -scheduled appointment'. After some discussion, it was decided to strike DS #4 (number of employees). Chair James requested, in DS #17, to strike "in accordance with the plan". The Board agreed to all of the aforementioned changes. IIR No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. e In response to Chair James, Ms. Knopf -Castle indicated she has reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. IE Commissioner Moreno moved to approve the request of Andrew Castle and Angela Knopf -Castle for a Site Specific Development Plan and Use by Special Review Permit, USR22-0006, for Commercial Recreational Facilities (indoor volleyball sport court and two (2) outdoor volleyball sand courts) outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, 2022-1329 PL2823 HEARING CERTIFICATION - ANDREW CASTLE AND ANGELA KNOPF-CASTLE (USR22-0006) PAGE 3 with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 10:35 a.m. This Certification was approved on the 6th day of June, 2022.
