HomeMy WebLinkAbout20221057.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MONDAY, APRIL 11, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 11, 2022, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli El MINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County Commissioners meeting of March 28, 2022, as printed. Commissioner Buck seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Saine moved to approve the Certification of Hearings conducted on March 28, 2022, as follows: 1) Public Hearing Concerning the 2022-2023 Annual Action Plan Proposed Use of Community Development Block Grant (CDBG) Funds. Commissioner Buck seconded the motion, which carried unanimously. .= PUBLIC INPUT: No public input was given. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no reports. 5/3 Minutes, Monday, April 11, 2022 Page 1 2022-1057 BC0016 PRESENTATIONS: 1) RECOGNITION OF SERVICES, BUILDING TRADES ADVISORY COMMITTEE - KEVIN PAGEL AND JERRY LEMONS: Chair James read the certificates for the record. Jerry Lemons was present to accept said certificate of recognition. (Clerk's Note: The group gathered for a photo opportunity.) El PROCLAMATIONS: 1) COLORADO SEVERE WEATHER AWARENESS WEEK - APRIL 10-16, 2022: Chair James read the proclamation for the record. Roy Rudisill, Director of the Office of Emergency Management, thanked the Board for the proclamation and urging the citizens of Weld County to be informed and ready for when severe weather happens. Mr. Rudisill further stated this is an opportunity to partner with the National Weather Service, for training and other services provided to citizens, first responders and medical professionals. In turn, each Commissioner expressed their appreciation for the information shared with the community, and the teamwork and leadership exhibited by the Office of Emergency Management for the citizens of Weld County and other communities in times of need. (Clerk's Note: The group gathered for a photo opportunity.) ..= 2) NATIONAL PUBLIC SAFETY TELECOMMUNICATORS WEEK - APRIL 10-16, 2022: Chair James read the proclamation for the record. Tina Powell, Director of the Department of Public Safety Communications, thanked the Board for the trust and unwavering support of her team and the first responders, and further shared small examples of the challenging calls they address in the dispatch center. Each staff member introduced themselves for the record. In turn, each Commissioner expressed how humbling it is to take the opportunity to sit alongside the staff of the dispatch center. Commissioner Freeman commented on the Department of Public Safety Communications transition in 2013, from the City of Greeley to the County, and the phenomenal improvements made with implementation of software, combined with incredible training to help the dispatchers remain calm during the high stress and uncertain situations. Commissioner Saine moved to make an amendment to the second Whereas paragraph of this proclamation to say, "While there are many different occupations, being a dispatcher is a special calling. To the people they help, they are heroes." Chair James seconded the motion, using Chair's prerogative, and the motion passed unanimously. (Clerk's Note: The group gathered for a photo opportunity.) . = WARRANTS: 1) GENERAL WARRANTS - APRIL 8, 2022: Commissioner Moreno moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion, and it carried unanimously. 2) GREELEY-WELD COUNTY AIRPORT AUTHORITY WARRANTS - APRIL 5, AND 8, 2022: Commissioner Freeman moved to approve the Greeley -Weld County Airport Authority Warrants, as printed. Commissioner Moreno seconded the motion, and upon a roll call vote, the motion passed four (4) to one (1), with Commissioner Saine opposed. 3) COMMISSIONER WARRANTS (SCOTT K. JAMES) - APRIL 8, 2022: Commissioner Moreno moved to approve the Commissioner Warrant, as printed. Commissioner Buck seconded the motion, and upon a roll call vote, the motion passed four (4) to zero (0), with Chair James recused. 4) COMMISSIONER WARRANTS (STEVE MORENO) - APRIL 8, 2022: Commissioner Freeman moved to approve the Commissioner Warrant, as printed. Commissioner Buck seconded the motion, and upon a roll call vote, the motion passed four (4) to zero (0), with Commissioner Moreno recused. Minutes, Monday, April 11, 2022 Page 2 2022-1057 BC0016 NEW BUSINESS: 1) CONSIDER AMENDMENT #4 TO AGREEMENT FOR SERVICES FOR MOTOR VEHICLE SELF-SERVICE KIOSKS AND AUTHORIZE CHAIR TO SIGN - INTELLECTUAL TECHNOLOGY, INC.: Bruce Barker, County Attorney, on behalf of Carly Koppes, Weld County Clerk and Recorder, explained the amendment is a phased retrofit to help mitigate fraud in the first quarter of 2022. Commissioner Moreno commented on how great these kiosks are, and when directions are followed, they work efficiently to reduce long lines and wait times, and he further moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. 2) CONSIDER APPLICATION, GRANT AWARD LETTER AND SUMMARY OF GRANT AWARD TERMS AND CONDITIONS FOR HELP AMERICANS VOTE ACT (HAVA) ELECTION SECURITY AWARD, AND AUTHORIZE CLERK AND RECORDER TO SUBMIT APPLICATION ELECTRONICALLY, AND AUTHORIZE CHAIR TO SIGN AND SUBMIT GRANT AWARD ELECTRONICALLY: Mr. Barker, on behalf of Ms. Koppes, stated the County has received grant funds, in the amount of $14,055.09, that will go toward the purchase and installation of security cameras and security measures on the doors. Commissioner Moreno moved to affirm said application, accept the grant award letter and summary of grant award terms and conditions, authorize the Clerk and Recorder to electronically submit the application, and authorize the Chair to sign and submit the grant award electronically. The motion was seconded by Commissioner Buck, and it carried unanimously. • 3) CONSIDER DECLARATION OF CERTAIN EQUIPMENT AS SURPLUS PROPERTY, APPROVE SALE OF SAME AT AUCTION WITH ROLLER AND ASSOCIATES, AND DELEGATE AUTHORITY TO CONTROLLER TO SIGN ANY NECESSARY DOCUMENTS: Cheryl Pattelli, Chief Financial Officer, stated the items listed are at their end -of -life, and ready for auction on April 13, 2022. Commissioner Freeman moved to approve said declaration of surplus property, approve sale of same at auction, and authorize the Controller to sign any necessary documents. Seconded by Commissioner Buck, the motion carried unanimously. • 4) CONSIDER TEMPORARY CLOSURE OF CR 70 BETWEEN CRS 39 AND 41: Amy Mutchie, Department of Public Works, stated this closure began March 31, 2022, and will go through April 29, 2022, for the emergency replacement of a partially collapsed irrigation culvert. Ms. Mutchie stated the road is secured, but is currently under water and it will take time to drain and dry before repairs can be made. Ms. Mutchie further explained the detour route has a one (1) mile section of gravel road, and water will be used for dust mitigation, as needed. Commissioner Buck moved to approve said temporary closure. The motion was seconded by Commissioner Moreno, and it carried unanimously. =. 5) CONSIDER TEMPORARY CLOSURE OF CR 22 BETWEEN CRS 31 AND 41: Ms. Mutchie stated this closure will begin on April 25, 2022, and go through June 17, 2022, for Bridge 22/35A deck replacement and subsequent road construction. Ms. Mutchie stated road signs and message boards will be in place, with the detour route having two (2) miles of gravel road, where magnesium chloride will be used for dust mitigation. In response to Commissioner Freeman, Jay MacDonald, Director of the Department of Public Works, stated there are limited detour options, they intend to close the road in phases to keep traffic moving, and will rebuild the entire five (5) mile segment. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner Moreno, and it carried unanimously. • 6) CONSIDER APPOINTMENT TO HUMAN SERVICES ADVISORY COMMISSION: Commissioner Freeman moved to approve said appointment. The motion was seconded by Commissioner Saine, and it carried unanimously. Minutes, Monday, April 11, 2022 Page 3 2022-1057 BC0016 PLANNING: 1) CONSIDER IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT ACCORDING TO POLICY REGARDING COLLATERAL FOR IMPROVEMENTS, AUTHORIZE CHAIR TO SIGN, AND ACCEPT OFF -SITE COLLATERAL FOR USE BY SPECIAL REVIEW PERMIT, USR19-0063 - LAZY TWO RANCH, LLC, AND DUANE AND LYNN ROSS, C/O CONNELL RESOURCES, INC.: Jazmyn Trujillo -Martinez, Department of Planning Services, requested approval of the Improvements Agreement and acceptance of Project Collateral, in the total amount of $474,801.50, procured in the form of a performance bond from Travelers Casualty and Surety Company of America, and further stated the applicant understands the required improvements to be completed included in the scope of work. Commissioner Moreno moved to approve said agreement, accept Project Collateral, and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
