Dear Mr. Gathman:
We have reviewed the above referenced Change of Zone application. The submitted material
does not appear to qualify as a "subdivision" as defined in section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to
county planning directors, this office will only perform a cursory review of the referral information
and provide comments. The comments will not address the ability of the water supply plan to satisfy
any County regulations or requirements.
The application seeks to rezone a parcel of 13.21 acres from the A (Agricultural) Zone District
to the 1-3 (Heavy Industrial) Zone District. The rezoning is requested to more appropriately reflect
the use of the property, which is currently used for commercial and industrial purposes including
parking and staging for a trucking and construction business and flyash transloading as approved
under USR15-0040.
The source of water supply for the property is an existing tap from the Little Thompson Water
District. The applicant provided a copy of a water bill dated August 31, 2021 as evidence of water
supply. There are no permitted wells or decreed water rights located on the subject property.
This office has no concerns regarding the proposed Change of Zone. Should you or the
