This proposal has been reviewed on behalf of the Weld County Department of Public Works. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site -Specific Development Plan and 2nd Amended Use by Special Review Permit
No. USR-977 for a Roping Arena and Training facility, announcer stand, storage area, and shaded viewing
area to add a campground (to accommodate up to 12 RVs) for a period of six (6) months or less per calendar
year outside of subdivisions and historic townsites in the A (Agricultural) Zone District
This project is north of and adjacent to unmaintained CR 98 and is west of CR 15.
Parcel number 045331300023.
Access is from CR 13 (AP17-00513)
ACCESS
Weld County Public Works has reviewed the application materials related to access.
The parcel utilizes unmaintained County Road 98 right-of-way to access County Road 13 at the permitted
access point (AP17-00513). The permitted access type is "commercial." No other access point is
requested.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. We
strongly encourage you to discuss your access with Public Works prior to laying out your site plan to ensure
the approved accesses are compatible with your layout. Per Sec. 24-8-40, when feasible, there shall be no
net increase in the number of accesses to a public road. Minimum access spacing are shown in Weld
County Code, Sec. 8-14-30 Table 1. Please refer to Chapter 8 of the Weld County Code for more
information regarding access.
ROADS AND RIGHTS -OF -WAY
County Road 13 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the site map or plat the future and existing right-of-way (along with the documents creating the
existing right-of-way) and the physical location of the road. If the right-of-way cannot be verified it shall be
dedicated or reserved per Weld County Code. Pursuant to the definition of setback in the Weld County
Code, Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware that
physical roadways may not be centered in the right-of-way. This road is maintained by Weld County.
This portion of County Road 98 has existing section line and petition right-of-way. Section line right-of-way
does not exist in all sections in Weld County and should be verified before a decision to utilize it is made.
Weld County commonly refers to these locations as "Non -Maintained Section Line Right -of -Way." The
existence of a physical road does not imply public right-of-way and the road may be located on private
property. All right-of-way should be verified and physical roads located in relationship to the public right-of-
way to ensure trespassing does not occur. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way and this information shall be noted on the site plan or plat. The
applicant shall delineate on the site map or plat the existing right-of-way and physical location of existing or
proposed roads. If the right-of-way cannot be verified it shall be dedicated or an adequate easement
between property owners shall be provided. Pursuant to the definition of setback in the Weld County Code,
Sec. 23-1-90, the required setback is measured from the future right-of-way line. Be aware the physical
roadway(s) may not be centered in the right-of-way. This road is NOT maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at
https://www.weIdgov.com/departments/pub/ Icworks/permits/.
Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT (2013) on this portion of CR 98 counted 25 vpd with 16% trucks. The 85th percentile speed is
49 mph.
While a preliminary Traffic Narrative was submitted, it shall be updated to include specific traffic numbers
and specific event information. This information is required to determine if any revisions are needed in the
existing Improvements and Road Maintenance Agreement (IA19-0018 - 20193535).
A final acceptable Traffic Narrative shall be submitted.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to paved
roads, tracking control devices can be double cattle guards with 100 ft. of asphalt or 300 ft of asphalt. For
access to gravel roads, tracking control devices must be either double cattle guards with 100 ft. of road
base, or road base on all driving surfaces. Temporary Tracking Control shall be used during construction
unless permanent tracking control is installed ahead of construction activities. Recycled concrete is not
allowed in County right-of-way. Tracking control for unmaintained public right-of-way is required just prior
to entering publicly maintained roadways. A variance request for alternatives to the tracking control
requirement can be submitted to Public Works for review and consideration.
Existing tracking control is deemed adequate.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
An Improvements and Road Maintenance Agreement (IA19-0018 - 20193535) for dust control, damage
repairs to specified haul routes, and triggered off -site improvements exists for this site.
This Agreement will be reviewed to determine if revisions and/or updates are needed.
DRAINAGE REQUIREMENTS
This area IS within a Non -Urbanizing Drainage Area: Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for NON -
URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets drainage exception 8.
Development of sites where the change of use does not increase the imperviousness of the site. Located
in Sec. 8-11-40. Drainage Policy.
No other drainage information is needed.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. The existing Improvements and Road Maintenance Agreement (IA19-0018 - 20193535) will be
updated and/or revised based on current traffic information. (Department of Public Works)
B. A Final Traffic Narrative is required. (Department of Public Works)
C. The plan shall be amended to delineate the following:
1. County Road 13 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. All setbacks
shall be measured from the edge of right-of-way. This road is maintained by Weld County.

right-of-way per the Weld County GIS right-of-way map. The applicant shall delineate the existing
right-of-way on the site plan. Show and label the section line Right -of -Way as "CR 98 Section Line
and Petition Right -Of -Way, not County maintained." All setbacks shall be measured from the edge

3. Show and label the approved access location (AP17-00513), approved access width and the
appropriate turning radii on the site plan. (Department of Public Works)
4. Show and label the drainage flow arrows. (Department of Public Works)
5. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Prior to Construction:
If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Department

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Department of Public Works)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Department of Public Works)
5. The Property Owner shall comply with all requirements provided in the executed Improvements
Agreement. (Department of Public Works)
6. The Improvements Agreement for this site may be reviewed on an annual basis, including a site visit
and possible updates. (Department of Public Works)
7. Access will be along unmaintained County right-of-way and maintenance of the right-of-way will not be
the responsibility of Weld County. (Department of Public Works)
8. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and 2nd Amended Use by Special Review Permit No. USR-977 for a
Roping Arena and Training facility, announcer stand, storage area, and shaded viewing
area to add a campground (to accommodate up to 12 RVs) for a period of six (6)
months or less per calendar year outside of subdivisions and historic townsites in the A
(Agricultural) Zone District.
According to the application, the applicants are requesting to add 12 camping spaces
with water and electrical connections.
A change in use for the existing well (permit 225968) has been submitted to the Division
of Water Resources. The current well is permitted for: "The use of ground water from
this well is limited to fire protection, ordinary household purposes inside not more than
three ( 3) single family dwellings, the watering of poultry, domestic animals and livestock
on a farm or ranch and the irrigation of not more than one ( 1) acre of home gardens
and lawns."
We recommend that the following requirement be met prior to recording the plat:
1. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for commercial
use.
We recommend that the following requirements from 1 MUSR17-93-977 be incorporated
into the permit as development standards:
1. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, flies, odors, disease hazards, and
nuisances are minimized.

2. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
3. No permanent disposal of wastes shall be permitted at this site. This is not meant
to include those wastes specifically excluded from the definition of a solid waste in
the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
4. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
5. Fugitive dust should attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
6. This facility shall adhere to the maximum permissible noise levels allowed in in the
Residential Zone as delineated in 25-12-103 C.R.S.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility at all times. Temporary uses that are utilized
for a time period of six months or less, portable toilets and bottled water are
acceptable. Records of maintenance and proper disposal for portable toilets shall
be retained on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be serviced
by a cleaner licensed in Weld County and shall contain hand sanitizers.
8. Any On -site Wastewater Treatment System located on the property must comply
with all provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
9. The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
10. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Ms. Aungst:
We have reviewed the above referenced application for a Minor Amendment to a Site Specific
Development Plan and Use by Special Review permit (USR93-977) for a roping arena and training facility.
The submitted material does not appear to qualify as a "subdivision" as defined in section
30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide comments. The comments will not address the ability of the water supply plan
to satisfy any County regulations or requirements.
The subject application seeks approval to add a campground to an existing business operating a
roping arena and training facility. The subject parcel associated with the Site Specific Development Plan
totals approximately 79 acres and contains the roping arena, multiple sheds, a public restroom, two steel
barns, two steel shelters, and a single-family dwelling. The campground is proposed to accommodate up
to twelve (12) recreational vehicles for a period of six months or less per calendar year.
The roping arena and proposed recreation vehicle campground will be served by an existing well
with permit no. 324600. Permit no. 324600 was issued pursuant to section 37-92-602(3)(b)(I), C.R.S. on
November 19, 2021 for the change of use of a well previously permitted as permit no. 225966. The use of
groundwater from this well is limited to drinking and sanitary facilities inside a commercial business.
Water from this well shall not be used for dust control, irrigation, domestic animal or livestock watering,
or for any other purpose outside the business building structures and recreational vehicles associated with
the campground. The annual amount of groundwater to be withdrawn from this well shall not exceed 1/3
acre-foot (108,600 gallons) and the applicant must install a totalizing flow meter on the well. Permanent
records of all diversions must be maintained by the well owner (recorded at least annually) and submitted
to the Division Engineer upon request. Permit no. 324600 is approved as the only well on a 35.4 -acre
portion of the 80 -acre property.
The existing single-family dwelling on the property is served by an existing well with permit no.
324601. Permit no. 324601 was issued pursuant to section 37-92-602(3)(b)(II)(A), C.R.S. on November 19,
2021 for a change of parcel description for an existing well previously permitted as permit no. 225968.
The physical location of the well with permit no. 324600 was within the area encumbered by permit no.
225968, in violation of the terms and conditions of permit no. 225968. Permit no. 324601 was therefore

issued in order to facilitate the issuance of the commercial well permit. Permit no. 324601 is approved as
the only well on a 45 -acre portion of the 80 -acre property. The use of groundwater from the well with
permit no. 324601 is limited to fire protection, ordinary household purposes inside not more than three
(3) single family dwellings, the watering of poultry, domestic animals and livestock on a farm or ranch,
and the irrigation of not more than one (1) acre of home gardens and lawns.
The terms and conditions of permit no. 324601 allow for the applicant to water domestic animals
and livestock owned by the applicant, however, the watering of domestic animals and livestock owned by
visitors to the roping arena or campground users would be considered a non-exempt commercial use.
Therefore the applicant may not use water from well permit no. 324601 (or permit no. 324600) for the
watering of domestic animals and livestock owned by parties other than those residing in the single-family
dwelling on the property. If the applicant would like to use a well to water domestic animals and livestock
owned by other parties, the applicant would need to obtain a non-exempt well permit pursuant to a
substitute water supply plan approved by this office or an augmentation plan approved by the water
court.
The applicant has confirmed that they own and operate a 5,000 gallon water truck for their
additional water needs, such as dust control at the arena. This office would not be opposed to water for
domestic animals and livestock owned by visitors to the roping arena or campground users being supplied
by the water truck so long as it is filled using a source permitted for such non-exempt commercial use.
The applicant informed our office that they fill their water truck at a hydrant located in the town of
Wellington, and proposes to continue to fill their truck with this source to serve as the water supply for
the watering of domestic animals and livestock owned by visitors to the arena and campground. The
applicant may also fill the truck using other sources, so long as such sources are permitted for
non-exempt commercial use. Our office asks that the applicant keep a record of the filling of the water
truck and save the invoices/receipts as evidence that the water truck is filled using a legal water source.
The applicant has requested an exemption from any stormwater detention requirements, and does
not propose to construct any stormwater infrastructure. The Drainage Narrative states that the proposed
amendment will not have a measurable increase in the imperviousness of the site.
