The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: USR for Oil and Gas Support and Service.
This project is north of CR 2 and is east of and adjacent to CR 21.
The subject parcel number is: 146935200026.
Access is from CR 21.
ACCESS
Weld County Public Works has reviewed the application materials related to access. The subject parcel
has an existing, non -permitted access on County Road 21, located approximately 3,230 feet north of County
Road 2. This access location does not meet the County's 150 -foot minimum access spacing requirement
for a local road. No additional access is proposed.
Per Sec. 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Please
contact Tiffnee Lamb, of Planning Services, at 970-400-3718 to obtain an access permit.
ROADS AND RIGHTS -OF -WAY
County Road 21 is a gravel road and is designated on the Weld County Functional Classification Map (Code
Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the USR map the existing right-of-way (along with the creating documents) and the physical
location of the road. Pursuant to the definition of setback in the Weld County Code, Sec. 23-1- 90, the
required setback is measured from the right-of-way line. Be aware that physical roadways may not be
centered in the right-of-way. This road is maintained by Weld County.
Per, Sec. 8-13-30.B, a Weld County Right -of -Way Use Permit is required for any project that will be
occupying, constructing or excavating facilities within, and/or encroaching upon, any County rights -of -way
or easement. Right -of -Way Use Permit instructions and application can be found at:

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 21 counted 115 vpd with 20% trucks. The 851h percentile speed is 46 mph.
The traffic information submitted with the application materials indicates that there will be approximately 2
passenger car/pickup truck daily roundtrips and up to 4 semi -truck weekly roundtrips. The truck traffic will
primarily come from, and go to, County Road 2 via County Road 21.
TRACKING CONTROL REQUIREMENTS
Tracking control is required to prevent tracking from the site onto public roadways. For access to gravel
roads, tracking control devices must be either double cattle guards with 100 feet of road base or road base
on all driving surfaces. Recycled concrete is not allowed in the County right-of-way.
DRAINAGE REQUIREMENTS
This area is within a Non -Urbanizing Drainage Area. Non -Urbanizing Drainage Areas typically require
detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained
water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site.
The applicant has submitted a drainage narrative stating the site meets an exception to stormwater
detention (Exception 8 from Section 8-11-40.1., of the Weld County Code). The requirement for detention
is waived.
Historic Flows:
The applicant is required to maintain the historic drainage flow patterns and runoff amounts occurring on
and from the property.
GRADING PERMIT REQUIREMENT
A Weld County Grading Permit is required if disturbing more than 1 acre.
CONSTRUCTION STORMWAER PERMIT REQUIREMENT
A Construction Stormwater Permit is required with the State if disturbing more than 1 acre.
CONDITIONS OF APPROVAL
The USR map shall be amended to delineate the following:
1. County Road 21 is a gravel road and is designated on the Weld County Functional Classification Map
as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall delineate and
label on the USR map the existing right-of-way (and creating documents) and the physical location of
the road. All setbacks shall be measured from the edge of right-of-way. This road is maintained by
Weld County. (Development Review)
2. Show and label the existing access location, a complying access width, and complying turning radii
(65') on the USR map. (Development Review)
3. Show and label the approved tracking control on the site plan. (Development Review)
4. Show and label the entrance gate if applicable. An access approach that is gated shall be designed so
that the longest vehicle (including trailers) using the access can completely clear the traveled way when
the gate is closed. In no event, shall the distance from the gate to the edge of the traveled surface be
less than 35 feet. (Development Review)
5. Show and label the drainage flow arrows. (Development Review)
6. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the
property. (Development Review)
Prior to Operation:
The applicant must obtain an access permit for the existing access location. (Development Review)
DEVELOPMENT STANDARDS (NOTES ON THE USR MAP)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off -site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

4. Any work that may occupy and/or encroach upon any County rights -of -way or easement shall acquire
an approved Right -of -Way Use Permit prior to commencement. (Development Review)
5. The historical flow patterns and runoff amounts on the site will be maintained. (Development Review)
6. Weld County is not responsible for the maintenance of onsite drainage related features. (Development
Review)

Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use by Special Review Permit for Oil and Gas Support
and Service.
The existing residence is served by an individual domestic well (161587-A) and
an on -site wastewater treatment system (OWTS). The OWTS was evaluated in
1991 and the system was noted to be undersized and located under a driveway
(G19910275). In 1997 a repair permit was applied for however that permit has
expired (SP -9700248). The applicant shall verify that the existing system is
adequate for the residence and adheres to OWTS regulations.
The applicant is proposing that employees utilize a portable toilet which follows
EH policy.
The type of equipment being stored includes separators which will be painted on
site. The applicant did contact the State regarding whether an APEN is
required, and the State indicated, due to the limited number of items being
painted, an APEN is not needed at this time. The application states that records
will be maintained to ensure compliance with the State standards. All paint must
be stored in compliance with manufactures recommendations.
We recommend that the following requirement be met prior to allowing the plat to
be recorded:
1. The Environmental Health Services Division was unable to locate an on -site
wastewater treatment system (OWTS) repair permit for the system serving
the existing residence. The system shall be reviewed by a Colorado
Registered Professional Engineer and a repair permit submitted if required.
The review shall consist of observation of the system and a technical review
describing the system's ability to handle the hydraulic load. The review shall

be submitted to the Environmental Health Services Division of the Weld
County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations.
We recommend that the following requirements be incorporated into the permit
as development standards:
All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.
5. The facility shall comply with the Air Pollution Emission Notice
(A.P.E.N.) permit requirements as stipulated by the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as
applicable.
6. Adequate drinking, hand washing, and toilet facilities shall be provided
for employees and patrons, at all times. For employees or contractors
on site for less than 2 consecutive hours a day, and 2 or less full-time
employees on site, portable toilets and bottled water are acceptable.
Records of maintenance and proper disposal for portable toilets shall
be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets
shall be serviced by a cleaner licensed in Weld County, contain hand
sanitizers and be screened from existing adjacent residential properties
and public rights -of -way.
7. Any equipment washing area(s) shall capture all effluent and prevent
discharges from washing of vehicles and equipment in accordance with
the Rules and Regulations of the Water Quality Control Commission,
and the Environmental Protection Agency. Well permit 161587-A cannot
be utilized for business use unless repermitted.
8. All chemicals must be handled in a safe manner in accordance with
product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds
(VOC's). All chemicals must be stored secure, on an impervious
surface, and in accordance with manufacturer's recommendations.
9. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

Dear Kim Ogle,
The Applicant is requesting a Site Specific Development Plan and Use by Special Review Permit for an Oil
and Gas Support and Service (outdoor painting of oil and gas separators) in the A (Agricultural) Zone
District
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S.
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county
planning directors, this office will only perform a cursory review of the referral information and provide
informal comments. The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The proposed water supply for the business is bottled water and portable toilets. Also a copy of well
permit no. 161587-A was included in the referral material.
Well permit no. 161587-A was issued on September 13, 1991 pursuant to 37-92-602(3)(c) C.R.S. for the
replacement of the late registered well under permit no. 161587. Permit no. 161587-A was issued on the
condition that the original well is plugged and abandoned. A Well Abandonment Report was not received
for the original well therefore, it is unknown if the original well was plugged. To ensure the original well
was plugged, the well owner must submit a Well Abandonment Report (GWS-09 Form). The well is
currently permitted for fire protection, ordinary household purposes inside two (2) single family dwellings,
the watering of poultry, domestic animals and livestock on a farm or ranch and the irrigation of not more
than 10,000 square feet of home gardens and Lawns. The well is withdrawing water from the nontributary
Laramie -Fox Hills aquifer.
As permitted well permit no. 161587-A cannot be used to serve the proposed business on the property. If
the applicant plans to use well no. 161587-A for commercial use, a well permit allowing for such use must
first be obtained. The ability for the Applicant to obtain a well permit, and the allowed uses, will be
determined at the time that a well permit application is submitted to and reviewed by the State Engineers
Office.

The applicant should be aware that any proposed detention pond for this project must meet the
requirements of a "storm water detention and infiltration facility" as defined in section 37-92-602(8),
Colorado Revised Statutes, the structure may be subject to administration by this office. The applicant
should review DWR's Administrative Statement Regarding the Management of Storm Water Detention
Facilities and Post-Wildland Fire Facilities in Colorado to ensure that the notification, construction and
operation of the proposed structure meets statutory and administrative requirements. The applicant is
encouraged to use Colorado Stormwater Detention and Infiltration Facility Notification Portal, located
at https://maperture.digitaldataservices.com/gvhl?viewer=cswdif, to meet the notification
requirements.
