HomeMy WebLinkAbout20222514.tiffRESOLUTION RE: GRANT APPEAL CONCERNING DECISION BY THE DEPARTMENT OF PLANNING SERVICES TO DENY ACCESS PERMITS ON COUNTY ROADS 74 AND 43 - GREG AND MELANIE WORRELL WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 2-4-10 of the Weld County Code, the Board of County Commissioners considered the appeal of the decision by the Department of Planning Services to deny two Access Permits on County Roads 74 and 43, submitted by the appellants, Greg and Melanie Worrell, and WHEREAS, the Board heard testimony and took evidence from Department of Planning Services staff and the appellants, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the appellants and the Department of Planning Services, the Board deems it advisable to grant the appeal of Greg and Melanie Worrell, reverse the decision of the Department of Planning Services, and remand the issue back to staff with instruction to issue the Access Permits, subject to the following conditions: 1. The applicant shall consult with the County Floodplain Manager to confirm that construction will not increase the fill or disturb the floodplain in the areas of new access points. Upon consultation, the applicant shall submit any additional information and obtain any permits as deemed necessary by the Floodplain Manager. 2. The applicant shall ensure adequate separation between the new access location and existing shared access on County Road 43. Physical separation shall be shown by a separate culvert pipe and adequate radiuses between the two access points. New access shall be fully on the applicants' property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the appeal of Greg and Melanie Worrell, be, and hereby is, granted, and the decision of the Department of Planning Services to deny Access Permits is reversed and remanded back to staff with instruction to issue the access permits, subject to the conditions listed above. James, Chair 2022-2514 EG0080 MEMORANDUM TO: Board of County Commissioners DATE: August 31, 2022 FROM: Dawn Anderson, Development Review SUBJECT: Appeal of Access Permit Denial for Greg Worrell Weld County Department of Planning Services received two access permit applications from Greg Worrell in June, 2022 (Exhibit A). Upon review, neither access request met the minimum safety standards for spacing listed within Section 8-14-30 of the Weld County Code. Staff advised Mr. Worrell of the code criteria and explained options to come into compliance withthe code or submit a variance request, requiring evidence of a hardship. On August 9, 2022, Mr. Worrell submitted two new/modified access permit applications (Exhibit B) to staff, with the inclusion of a hardship letter (Exhibit C). The first access permit application requests a new shared residential (RES)/agriculture (AG) access point (Exhibit D - red star) on CR. 74 for parcel 070933400077 (known as Lot B of AmRE-5032 (Exhibit G), along the eastern boundary of the parcel, noting the intent that two adjacent existing access points on CR. 74 would be consolidated/ closed upon approval of this new location). The hardship letter (Exhibit C) indicates the accesses to be consolidated/closed include an AG access permitted through AP11-00220 (Exhibit F), approx. 490ft. to the east, which is no longer utilized (Exhibit D - green circle), and an existing (unpermitted) RES access approx. 100ft to the west (Exhibit D - pink circle), serving parcel 070933400058, known as Lot A of RE -1705 (Pratt) (Exhibit H). The letter also indicates this proposed access (red star) will be utilized for access to the Worrell residence, the Pratt residence, and for ag access to the hay barn. Exhibit D also indicates an existing AG access for Johnson (yellow circle) which is a distance of 175ft west of the proposed access (red star). Permitted access #3 on CR. 43 (Exhibit D - purple circle), located approx. 470ft north of CR. 74, includes an easement identified on the plats for BOTH AmRE-4095 AND AmRE-5032 (Exhibit I) for joint/shared access to the Studebaker and Worrell properties for RES/AG uses. CR. 74 is a paved road and is classified on the Weld County Functional Classification Map as an Arterial Roadway. The latest ADT on this road counted 2,417VPD with 19% trucks, and an 85% percentile speed of 57mph. The second access permit application (Exhibit B) requests an extension of the width of the currently shared RES/AG access point on CR. 43 for parcel 070933400076, to "add" an additional AG access for access to the orchard (Exhibit E - yellow star) on the south side of the existing shared access (yellow circle). The extension/addition would create a 60ft wide access (30ft existing + 30ft addtl) at this location which does not meet the code safety criteria for access width. Maximum width of a shared access with residential and agricultural use is 40 feet per section 8.6.1 of the Weld County Engineering and Construction Criteria (WCECC) manual. The shared access provides access to parcel 070933400074, known as Lot A of Corr RE -5032 (Warren) (Exhibit J) as well as Worrell's parcel and is permitted as AP11-00220/AP18-00015. The hardship letter (Exhibit C) indicates the Lot A neighbor (Warren) has blocked the current access and litigation is proceeding. The map provided indicates that the current shared access (Exhibit E - yellow circle) is a distance of 110ft from the Ferguson access to the north (purple circle). There are two residential accesses further north at a distance of 440ft & 575ft from the existing Worrell/Warren access for property owner Wright (orange circle CR. 43 is a paved road and is classified on the Weld County Functional Classification Map as a Collector roadway. The latest ADT on this road counted 1,518VPD with 25% trucks, and an 85% percentile speed of 66mph. This was previously denied for being too close to other neighboring access points. However, my current access point (historical Gustafson property) and the Pratt access would also be removed. We would share my new access. Therefore, two current access points would be reduced to a single Ag/Res access. Furthermore, when the County Commissioners voted to allow a special use permit for my neighbor to the North (Directional Drilling Plus) they knew that he was blocking my only Res/Ag access to my house and barn (for hay sales). They decided that access would be a separate issue and now this is that day! Civil litigation is ongoing, but the lawyers say that resolution could be over a year away. Specifically, this new Ag/Res access will allow me to get to my house and for hay customers to get to my hay barn. Hay sales are most frequent in the summer, but some all year. We haven't been able to sell hay for more than seven months with the blocked access. My "Right To Farm" must have this hardship remedy NOW! Also, please see the Access Permit application form for moving my Ag access on CR 43 (shared with Res access of Nusbaum) to a single Ag access at the North end of the orchard (which abuts our NE property line on CR 43). This Ag access would be immediately next to the Res and Commercial access of Warrens and Directional Drilling Plus. The two access points would function as a single 30 foot + 30 foot = 60 foot access. This is necessary because these neighbors have blocked off our right to access the orchard by their newly installed fence at our shared access point. Therefore, there is now no entry into the orchard and we cannot operate our traditional U - Pick orchard. (Even the new access off CR 74, if granted, would be too far for orchard use.) Once again, the County Commissioners decided this would be a separate issue and here it is today. Fruit is rotting on the trees or can only be sold wholesale at a cost lower than production. U -Pick is good for Weld County as we draw customers from the local region as well as the Denver metro area and beyond. These folks buy goods and services here besides our apples. The new Ag access will have some use year round, but mostly on weekends between July and October. It is also the only safe way for our custom hay cutting equipment on long trailers to enter and exit the hay fields. Please let me open the orchard by providing immediate permission for the requested Ag access off of CR 43! Please help resolve the constant conflict with our northern neighbor by giving us our own Res/Ag access off of CR 74 and letting them have their own private Res/Business access on CR 43. However, we appeal to the County Commissioners to grant our requests for the new access so that we can resume our family farming operations. Please see the Access Permit Application form for moving our Ag access on CR 74 to the west property border. This was previously denied for being too close to other n eighboring access points. However, our current access point which dead ends in the field (historical Gustafson property) on CR 74 would be removed. So we would maintain the same number of access points. We need to move the access in order to connect to the existing field road, giving hay customers access to the hay barn near o ur house. Furthermore, when the County Commissioners voted to allow a special use permit for my neighbor to the North (Directional Drilling Plus) they knew that he was blocking my only Res/Ag access to my house and barn (for hay sales). They decided that access would be a separate issue and now this is that day! Civil litigation is ongoing, but the lawyers say that resolution could be over a year away as our date for jury trial is not until July 2023!! Hay sales are most frequent in the summer, but some all year. We haven't been able to sell hay for more than seven months with the blocked access. My "Right to Farm" must have this hardship remedy NOW! Also, please see the Access Permit application form for moving my Ag access on CR 43 (shared with Res access of Nusbaum) to a single Ag access at the North end of the orchard (which abuts our NE property line on CR 43). This Ag access would be immediately next to the Res and Commercial access of Warrens and Directional Drilling Plus. The two access points would function as a single 30 foot + 30 foot = 60 foot access for traffic safety. This is n ecessary because these neighbors have blocked off our right to access the orchard by their newly installed fence from our shared access point. Therefore, there is now no entry into the orchard and we cannot operate o ur traditional U -Pick orchard. (Even the new access off CR 74, if granted, would be too far for orchard use.) Once again, the County Commissioners decided this would be a separate issue and here it is today. Fruit is rotting on the trees or can only be sold wholesale at a cost lower than production. U -Pick is good for Weld County as we draw customers from the local region as well as the Denver metro area and beyond. These folks buy goods and services here besides our apples.
