James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine — EXCUSED Also present: Acting Clerk to the Board, Jan Warwick Assistant County Attorney, Karin McDougal Department of Planning Services representative, Michael Hall The following business was transacted: I hereby certify that pursuant to a notice dated June 23, 2022, and duly published June 25, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of Noelia Leal and Melissa Keen, for a Site Specific Development Plan and Use by Special Review Permit, USR22-0010, to exceed the maximum allowed building coverage (up to 12%) in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. IE Chair James reviewed the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Saine being excused. El Michael Hall, Department of Planning Services, presented a brief summary of the proposal, described the size of the existing structures, and stated the request will correct an existing issue and place the building structures at 12% of the parcel. Mr. Hall shared the Condition of Approval (COA) requires an Improvement Location Certificate (ILC) to determine if the structures on the property meet the setback and offset requirements of the Weld County Code and are outside any recorded easements for the Aristocrat Subdivision plat, and noted any encroachment would have to be removed or receive approval for a Board of Adjustment (BOA) Variance Application. Mr. Hall described the sign posting and the location of the site, which is located within the three (3) mile referral area of the City of Fort Lupton, who did not return a referral response or respond to the Notice of Inquiry (NOI). He relayed the Department of Planning Services sent notices to 38 surrounding property owners (SPOs) with no responses returned. He also explained the traffic patterns, described the access from Patrick Street, indicated the traffic of a residential dwelling will generate approximately nine (9) round trips per day, and the Drainage Narrative states the site meets a stormwater drainage exception. No public testimony was offered concerning this matter. Noelia Leal, applicant, indicated she had reviewed the Conditions of Approval and Development Standards, as presented. The Board reviewed the proposed Resolution. In response to Commissioner Freeman, Mr. Hall confirmed the building size and consequences of potential future development of the property owner, since this request exceeds the lot coverage area. In response to Commissioner Moreno, Ms. Leal confirmed she understood no further structures will be allowed. El In response to Chair James, Ms. Leal indicated she had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as presented. Ei Commissioner Moreno moved to approve the request of Noelia Leal and Melissa Keen for a Site Specific Development Plan and Use by Special Review Permit, USR22-0010, to exceed the maximum allowed building coverage (up to 12%) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as presented. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:20 a.m. This Certification was approved on the 17th day of August, 2022.
