CHANGE OF ZONE (COZ) PLANNING QUESTIONNAIRE
Answer the following questions per Section 23-2-50 of the Weld County Code. Please type on a
separate sheet. If a question does not pertain to your proposal, please respond with an
explanation — do not leave questions blank.
1. Describe the purpose of the proposed Change of Zone.
The purpose of the proposed COZ is to be able to benefit from the agricultural zone benefits.
2. Describe the current and previous use of the land.
This is a residential, single family, primary residence property.
3. Describe the proximity of the proposed use to residences.
The neighbors to the south are on acreages and own animals; we share a fence -line. Our
neighbors to the east and northeast are zoned commercial and consist of a roofing company
and construction company. We also have two neighbors to the north and one to the west that
are residential. Neighbors to the west are zoned commercial and are an assisted living facility.
4. Explain how the proposed rezoning will correct what the applicant perceives as faulty zoning,
or how the proposed rezoning will fit with what the applicant perceives as the changing
conditions in the area.
In the past, this land was zoned agricultural. More north of our area there are parcels zoned
agricultural and our southerly neighbors have acres of grassfield for their cattle. Rezoning will fit
properly with the overall region.
5. Explain how the uses allowed by the proposed rezoning will be compatible with the
surrounding land uses. Include a description of existing land uses for all properties adjacent to
the subject property.
Our neighbor to the northeast is zoned commercial by the company name of Soderberg
Roofing. The neighbors to the east are zoned commercial and are a construction company. The
neighbors to the northwest are zoned commercial by the company name of Birch Assisted
Living. The remainder of the adjacent properties are zoned residential.
6. Does the soil report indicate the existence of moderate or severe soil limitations? If so, detail
the methods to be employed to mitigate the limitations for the uses proposed.
A soil report is not required for this application.
7. Explain how this proposal is consistent with the Weld County Comprehensive Plan per
Chapter 22 of the Weld County Code.
Per Weld County Code, our proposal is in line with the Weld County Comprehensive Plan
guiding principles which includes Respecting Agricultural Heritage, Respecting Private Property
Rights, Promoting Economic Growth and Stability, and Protecting Health/Safety/General
Welfare. The change of zone from R1 to Agriculture promotes the agricultural heritage of Weld
County by allowing our children to harvest learning opportunities around agriculture and develop
skills they can use for the rest of their lives and help their community as adults. Our children
have an interest in 4H and FFA and we hope that once the COVID-19 pandemic is behind us
they can become more involved with 4H and FFA. Private Property Rights without infringement
on others is supported by the opportunity for us to grow our own produce for personal
consumption and if desired raise a few cattle. The rising goods costs can be deterred by
growing our own food and producing a sustainable livelihood for the family. We believe owning
an agricultural property will provide economic stability for our family.
8. Explain how this proposal will be compatible with future development of the surrounding area
or adopted master plans of affected municipalities.
We believe our proposal aligns to the needs of the surrounding area. In our discussion with the
Weld County Planning Department, this proposal does not impact or affect master plans and
future development.
9. Explain how this proposal impacts the protection of the health, safety and welfare of the
inhabitants of the neighborhood and the County.
This proposal does not negatively impact health, safety and welfare of inhabitants of the area.
10. Explain how this proposal complies with Article V and Article XI of Chapter 23 if the proposal
is located within any Overlay Zoning District (Airport, Geologic Hazard, or Historic Townsites
Overlay Districts) or a Special Flood Hazard Area identified by maps officially adopted by the
County.
All FloodPlain Development permit requirements in Article XI of Chapter 23 shall be met
accordingly.
CHANGE OF ZONE (COZ) DEVELOPMENT REVIEW QUESTIONNAIRE
Answer the following questions per Section 8-11-40, Appendix 8-Q, and Section 8-14-10 of the
Weld County Code. Please type on a separate sheet. If a question does not pertain to your
proposal, please respond with an explanation — do not leave questions blank.
1. Describe the access location and applicable use types (i.e., agricultural, residential,
commercial/industrial, and/or oil and gas) of all existing and proposed accesses to the parcel.
Include the approximate distance each access is (or will be if proposed) from an intersecting
county road. State that no existing access is present or that no new access is proposed, if
applicable.
Access currently exists for our residence and location directly off of Birch Avenue.
2. Describe any anticipated change(s) to an existing access, if applicable.
We do not anticipate any changes to existing access.
3. Describe in detail any existing or proposed access gate including its location.
The existing gate utilized for the property is directly off of Birch Avenue to the East of the
property. No newly proposed access gate to location.
4. Describe the location of all existing accesses on adjacent parcels and on parcels located on
the opposite side of the road. Include the approximate distance each access is from an
intersecting county road.
All adjacent parcels and opposite parcels have immediate access to Birch Avenue. The road is
a dead end at the SW corner of our property.
5. Describe any difficulties seeing oncoming traffic from an existing access and any anticipated
difficulties seeing oncoming traffic from a proposed access.
There are no difficulties seeing oncoming traffic from existing or proposed access

in the vicinity of an existing or proposed access.

Birch Avenue is flat and level.
CHANGE OF ZONE (COZ) ENVIRONMENTAL HEALTH QUESTIONNAIRE
Answer the following questions per the Weld County Code, Chapters 14, 23 and 30. Please type
on a separate sheet. If a question does not pertain to your proposal, please respond with an
explanation — do not leave questions blank.
1. Discuss the existing and proposed potable water source. If utilizing a drinking water well,
include either the well permit or well permit application that was submitted to the State Division
of Water Resources. If utilizing a public water tap, include a will serve letter from the Water
District, a tap or meter number, or a copy of the water bill.
The existing potable water source is the City of Greeley water. The proposed potable water
source will be the City of Greeley water
2. Discuss the existing and proposed sewage disposal system is on the property. If utilizing an
existing on -site wastewater treatment system (OWTS), provide the OWTS permit number. If
there is no permit due to the age of the existing system, apply for a permit through the
Department of Public Health and Environment prior to submitting this application. If a new
OWTS system will be installed, please state "a new on -site wastewater treatment system is
proposed." Only propose portable toilets if the use is consistent with the Department of Public
Health and Environment's portable toilet policy.
