REGULATION UNDER TITLE VI - CIVIL RIGHTS 1964:
BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that the Assurance of Compliance as submitted by the United States
Department of Agriculture Forest Service be and the same is hereby approved.

Assurance of Compliance With The Department of Agriculture
Regulation Under Title VI of The Civil Rights Act of 1964
THE COUNTY OF WELD (hereinafter called the "Applicant".)
(Name of Applicant or Recipient)
HEREBY AGREES THAT it will comply with Title VI of the Civil Rights Act of
1964 (PL 88-352) and all requirements imposed by or pursuant to the Regulations of
the U.S. Department of Agriculture (7 CFR Part 15) issued pursuant to that Act; and
HEREBY GIVES ASSURANCE THAT it will immediately take any measures neces-
sary to effectuate this agreement.
If any real property or structure thereon is provided or improved with the aid of
Federal financial assistance extended to the Applicant by the Department, this assur-
ance shall obligate the Applicant, or in the case of any transfer of such property, any
transferee, for the period during which the real property or structure is used for a pur-
pose for which the Federal financial assistance is extended or for another purpose involv-
ing the provision of similar services or benefits. If any personal property is so provided,
this assurance shall obligate the Applicant for the period during which it retains owner-
ship or possession of the property. In all other cases, this assurance shall obligate the
Applicant for the period during which the Federal financial assistance is extended to it
by the Department.
THIS ASSURANCE is given in consideration of and for the purpose of obtaining
any and all Federal financial assistance extended after the date hereof to the Applicant
by the Forest Service, U.S. Department of Agriculture on account of permits issued
under Secretary's Regulation U-11 (36 CFR 251.2) and designated

The Applicant recognizes and agrees that such Federal financial assistance will be
extended in reliance on the representations and agreements made in this assurance, and
that the United States in addition to any other rights and remedies provided by this
assurance, the Civil Rights Act of 1964, or the Regulations issued thereunder, shall
have the right to enforce this agreement by suit for specific performance or by any other
available remedy under the laws of the United States or the State in which the breach
or violation occurs.
This assurance is binding on the Applicant, its successors, transferees, and as-
signees, and the person or persons whose signatures appear below are authorized to
sign this assurance on behalf of the Applicant.

Dear Permittee:
The Roosevelt National Forest is currently updating its records on
special-use permits. In accordance with the provisions of Title VI
of The Civil Rights Act of 1964, a nondiscrimination assurance of
compliance is required on all permits for which Federal assistance
is received. This includes most free special-use permits.
We are aware of your compliance; however we do not have signed docu-
ments for each permitted use on the Forest. In order to avoid further
imposition, a "Master Assurance" is enclosed (listing all special uses
to date) . In the future, additional uses will be added to the "Master' ,
as necessary, and you will not be required to sign additional
Assurances.
Kindly sign and date all enclosed copies. Retain the original and
return the duplicates to this office within two (2) weeks of receipt.
Your cooperation is greatly appreciated.

Gentlemen:
Please refer to the special use permit issued to you and designated
"Borrow Pit 10/7/63," and "Borrow Pit 10/16/64."
Annually we are required to examine all special use permits issued
free of charge to determine the applicability of Regulation U-11.
This regulation allows the Forest Service to issue a permit free of
charge if the following conditions are met:
1. Funds derived through the permit are not used to increase
the value of improvements owned by you.
2. Funds derived through the permit are not used to support
other activities by you.
3. The use authorized by this permit is not commercial in
nature.
4. The use authorized by this permit benefits the general
public.
If you meet all of the above requirements, a justification statement
should be prepared and submitted to this office. At the same time,
a statement of assurance should be made confirming that you have
complied with Title VI of the Civil Rights Act of 1964 as required
in your special use permits.
