RE: APPROVE PARTIAL VACATION OF TWO -LOT RECORDED EXEMPTION, RE -4163,
FOR REMOVAL OF LOT B - KENNETH HARRING
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on August 5, 2005, the Department of Planning Services approved Two -Lot
Recorded Exemption, RE -4163, and
WHEREAS, the Board has received a request from the current property owner,
Kenneth Harring, 5820 East County Road 1000 South, Cloverdale, Indiana 46120-9029,
represented by Bobby Dishell, Moye White, LLP, 41400 16th Street, 6th Floor, Denver, Colorado
80202, to vacate Lot B of Recorded Exemption, RE -4163, located on the following described real
estate, to wit:
Lot B of Recorded Exemption, RE -4163; being part
of the NW1/4 of Section 32, Township 7 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, and makes
the following findings:
1. No property will be left without access to a public road right-of-way as a result of
the vacation.
2. The easements that remain on the site are:
a. Reception #1977644, dated August 15, 1984, for a natural gas pipeline.
b. Reception #1830462, dated July 17, 1980, for an irrigation supply line.
c. Reception #2909076, dated December 14, 2001, and re-recorded at
Reception #2926652, dated February 20, 2002, for the North Weld County
Water District for a water line.
3. Reception #47515 dated March 20, 1983, for a ditch and irrigation right-of-way will
remain on the site.
4. The thirty (30) foot access easement to the subject property, which is located along
the southern boundary of Lot B of Recorded Exemption plat RE -4074 (reception
#3285530, dated May 12, 2005) from County Road 39, shall remain.

5. The eighteen (18) foot access easement to the subject property, which is located
along the northern boundary of Lot B of Recorded Exemption plat RE -4074
(reception #3285530, dated May 12, 2005) and the southern boundary of Lot A of
Recorded Exemption RE -4163 (reception #3335453, dated October 28, 2005)
from County Road 39, shall remain. This easement was established as nine (9)
feet on Lot A and nine (9) feet on Lot B of Recorded Exemption plat RE -1624
(reception #2419897, dated December 21, 1994).
6. The ten (10) foot access easement to the subject property, which is located along
the southern boundary of Lot A of Recorded Exemption RE -4163 (reception
#3335453, dated October 28, 2005) from County Road 39, shall remain.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Kenneth Harring, for Partial Vacation of Two -Lot Recorded
Exemption, RE -4163, for removal of Lot B, be, and hereby is, approved, subject to the following
condition(s):
1. As described in Sections 24-11-50.H and 24-11-50.1 of the Weld County Code, the
applicant shall submit an exemption vacation plat and deed to the Department of
Planning Services within ninety (90) days for review. Upon acceptance, the plat
shall be signed by the property owners and shall be submitted for recording, along
with the recording fee, to the Department of Planning Services. The vacation is in
effect the date of recordation of the land survey plat with the Weld County Clerk
and Recorder.
2. The applicant shall provide a thirty (30) foot access easement for the two
properties to the west. (Addressed as: 19150 and 19154 County Road 76).

NARRATIVE
On April 15, 2022, the Department of Planning Services received the attached vacation request letter signed
by Mr. Kenneth Harring requesting a partial vacation of the plat of Recorded Exemption RE -4163, recorded
October 28, 2005, reception #3335453 to vacate Lot B.
There are two easements from CR 39 that provide access to this property. Letters have been provided by
the respective property owners stating that they have no concerns with keeping these easements.
The Lot A is owned by Randy and Tracy Pfeiff and is not a part of this request. Lot A has access from CR
39 and Lot B has access from CR 76. Notice to the property owners of Lot A was sent at least ten (10) days
prior to the hearing by the Clerk to the Board.
Per a review from Development Review, it was noted that there are two access points on CR 76 that have
been in existence since at least 1970. These two access points do not meet Weld County Code due to
spacing. However, without these two access points many lots would be landlocked. Based on ownership
questions of the eastern access parcel, land constraints such as trees in the center of the two roadways,
and no known accident history Development Review is accepting the existing conditions.
There are seven (7) properties to the west of the subject property that use an access road that is not a part
of the proposed vacated plat. There are two (2) properties to the west that have a roadway that is on the
subject property and the property owner is creating an easement for these two property owners to ensure
that these two (2) properties are not landlocked.
The resulting parcel will be larger than thirty-five (35) acres.
A draft vacation plat is also attached and requires minor revisions prior to recording. A metes and bounds
description for the lot to be vacated has been included on the draft vacation plat.
Vacation Criteria:
The Vacation of a Recorded Exemption plat criteria are detailed in Chapter 24, Article XI of the Weld County

Code, being the Obsolete Land Divisions Article within the Weld County Subdivision Ordinance.
Section 24-11-10.A of the Weld County Code, states in part: "Previously approved Recorded Exemptions
and Subdivision Exemptions may be amended, corrected, or vacated."
Section 24-11-50 of the Weld County Code, provides specific criteria for the vacation process. The
processing of this vacation and memorandum have been prepared in accordance with this Code section.
Section 24-11-50.A of the Weld County Code details the items to be submitted by the property owners in
order to request a complete or partial vacation of an exemption. The submitted materials were deemed
complete and include the vacation request letter and the draft vacation plat map.
Section 24-11-50.6 of the Weld County Code, states, in part, "Partial vacations may be used to vacate the
largest lot within a Recorded Exemption plat, which is greater than thirty-five (35) acres in size, without
affecting the remaining lots withing the same plat."
The Department of Planning Services staff has reviewed this request and recommends that this request be
approved for the following reasons:
1. No property will be left without access to a public road right of -way as a result of the vacation.
2. The easements that remain on the site are
a. Reception #1977644, dated August 15, 1984, for a natural gas pipeline
b. Reception #1830462, dated July 17, 1980, for an irrigation supply line
c. Reception #2909076, dated December 14, 2001 and re-recorded at Reception #2926652,
February 20, 2002 for a North Weld County Water District for water line.

site.

boundary of Lot B of Recorded Exemption plat RE -4074 (reception #3285530, dated May 12, 2005)
and the southern boundary of Lot A of Recorded Exemption RE -4163 (reception #3335453, dated
October 28, 2005) from County Road 39, shall remain. This easement was established as nine (9)
feet on Lot A and nine (9) feet on Lot B of Recorded Exemption plat RE -1624 (reception #2419897,
dated December 21, 1994)
6. The ten (10) foot access easement to the subject property, which is located along the southern
boundary of Lot A of Recorded Exemption RE -4163 (reception #3335453, dated October 28, 2005)
from County Road 39, shall remain. /
Recommendation:
The Department of Planning Services staff has reviewed this request and recommends that this request be
approved by the Board of County Commissioners subject to the following condition.
A. The applicant shall provide a thirty (30) foot access easement for the two properties to the west.
(Addressed as: 19150 and 19154 County Road 76)
B. If the vacation request is approved by the Board of County Commissioners, the vacation plat shall
be submitted to the Department of Planning Services for review in accordance with Sections 24-
11-50.H and I of the Weld County Code. Upon acceptance of the plat, the plat shall be signed by
the property owners and shall be submitted for recording with the recording fee to the Department
of Planning Services. The vacation is in effect the date of recordation of the land survey plat with
the Weld County Clerk and Recorder.

To Whom This May Concern:
This letter is a Vacation Request Letter, which is being submitted as part of the application for a partial Plat
Vacation of Recorded Exemption 0709 -32 -03 -RE 4163 ("Vacation").
This Vacation is being requested to allow us to fully exercise our rights to create distinct parcels of land
when each parcel is greater than thirty-five acres (See C.R.S 30-28-101). This will enable us to generate
more revenue from our property by enabling us to enter into more leases and have different uses on parcels
instead of being limited by one parcel.
The improvements that currently exist are:
• Barbed wire fence
• Concrete irrigation structure and culverts
• PVC Irrigation pipe
While no easements are being vacated as part of this Vacation, the following easements affect the property:
A 10' utility easement detailed on the current Recorded Exemption
A 18' access easement detailed on the current Recorded Exemption
A water line easement recorded under Reception No. 2909076 and re-recorded under Reception
No. 2926652
An irrigation supply line easement recorded under Reception No. 1830462.
A gas pipeline easement recorded under Reception No. 1977644

AMENDED AND RESTATED LIMITED LIABILITY COMPANY AGREEMENT
OF
CBEP SOLAR 1, LLC
This Amended and Restated Operating Agreement (this "Agreement") of CBEP Solar 1, LLC, a
Delaware limited liability company (the "Company"), is made effective as of June 8, 2021 (the
"Effective Date"), by and between the Company and Cloudbreak Energy Holdco, LLC, as the sole
member of the Company (the "Member").
Explanatory Statement
WHEREAS, the Company was formed as a limited liability company on January 19, 2021 by the
filing of a Certificate of Formation with the Secretary of State of the State of Delaware pursuant to and in
accordance with the Delaware Limited Liability Company Act, as amended from time to time (the "Act");
WHEREAS, Cloudbreak Energy Partners, LLC ("CBEP Parent") was the initial sole member;
WHEREAS, CBEP Parent then transferred 100% of the interests in the Company to Cloudbreak
Energy Holdco, LLC, the now current sole Member of the Company; and
WHEREAS, the current sole Member wishes to set forth the terms and conditions pursuant to
which the Company shall be operated and by which it shall exist.
NOW, THEREFORE, in consideration of the mutual covenants herein contained and intending to
be legally bound hereby, the parties hereto covenant, agree, and certify as follows:
1. Name. The name of the Company is CBEP Solar 1, LLC.
2. Purpose. The purpose of the Company is to engage in any lawful act or activity for which
limited liability companies may be formed under the Act and to engage in any and all activities necessary
or incidental thereto.
3. Principal Office; Registered Agent.
(a) Principal Office. The location of the principal office of the Company shall be
4845 Pearl East Cir, Suite 118 #53242, Boulder, CO 80301, or such other location as the Member may
from time to time designate.
(b) Registered Agent. The registered agent of the Company for service of process in
the State of Delaware and the registered office of the Company in the State of Delaware shall be that
person and location reflected in the Certificate of Formation. In the event the registered agent ceases to
act as such for any reason or the registered office shall change, the Member shall promptly designate a
replacement registered agent or file a notice of change of address, as the case may be, in the manner
'provided by law.
4. Members.
(a) Member. The Member owns 100% of the membership interests in the Company.
The name of the Member is Cloudbreak Energy Holdco, LLC and the business, residence or mailing
address of the Member is 4845 Pearl East Cir, Suite 118 #53242, Boulder, CO 80301.

(b) Additional Members. One or more additional members may be admitted to the
Company with the consent of the Member. Prior to the admission of any such additional members to the
Company, the Member shall amend this Agreement to make such changes as the Member shall determine
to reflect the fact that the Company shall have such additional members. Each additional member shall
execute and deliver a supplement or counterpart to this Agreement, as necessary.
(c) Membership Interests: Certificates. The Company will not issue any certificates
to evidence ownership of the membership interests.
(d) Liability of Member. Except as otherwise required in the Act, the debts,
obligations, and liabilities of the Company, whether arising in contract, tort or otherwise, shall be solely
the debts, obligations and liabilities of the Company, and the Member shall not be obligated personally for
any such debt, obligation or liability of the Company solely by reason of being the Member or
participating in the management of the Company.
5. Management.
(a) Authori ; Powers and Duties of the Member. The Member shall have exclusive
and complete authority and discretion to manage the operations and affairs of the Company and to make
all decisions regarding the business of the Company. Any action taken by the Member shall constitute the
act of and serve to bind the Company. Persons dealing with the Company are entitled to rely conclusively
on the power and authority of the Member as set forth in this Agreement. The Member shall have all
rights and powers of a manager under the Act, and shall have such authority, rights and powers in the
management of the Company to do any and all other acts and things necessary, proper, convenient or
advisable to effectuate the purposes of this Agreement.
(b) Election of Officers; Delegation of Authority. The Member may, from time to
time, designate one or more officers with such titles as may be designated by the Member to act in the
name of the Company with such authority as may be delegated to such officers by the Member (each such
designated person, an "Officer"). Any such Officer shall act pursuant to such delegated authority until
such Officer is removed by the Member. Any action taken by an Officer designated by the Member
pursuant to authority delegated to such Officer shall constitute the act of and serve to bind the Company.
Persons dealing with the Company are entitled to rely conclusively on the power and authority of any
Officer set forth in this Agreement and any instrument designating such Officer and the authority
delegated to him or her.
6� Indemnification
(a) Covered Person. As used herein, the term "Covered Person" shall mean (i) the
Member, (ii) each officer, director, partner, member, employee, agent or representative of the Member,
and (iii) each Officer, employee, agent or representative of the Company.
(b) Standard of Care. No Covered Person shall be liable to the Company or any other
Covered Person for any loss, damage or claim incurred by reason of any action taken or omitted to be
taken by such Covered Person in his, her or its capacity as a Covered Person, so long as such action or
omission does not constitute fraud, gross negligence, willful misconduct or a material breach or knowing
violation of this Agreement by such Covered Person.
(c) Good Faith Reliance. A Covered Person shall be fully protected in relying in
good faith upon the records of the Company and upon such information, opinions, reports or statements
(including financial statements and information, opinions, reports or statements as to the value or amount

of the assets, liabilities, net income or net losses of the Company or any facts pertinent to the existence
and amount of assets from which distributions might properly be paid) of the following persons or groups:
(i) another Member; (ii) one or more Officers or employees of the Company; (iii) any attorney,
independent accountant, appraiser or other expert or professional employed or engaged by or on behalf of
the Company; or (iv) any other person selected in good faith by or on behalf of the Company, in each case
as to matters that such relying person reasonably believes to be within such other person's professional or
expert competence. The preceding sentence shall in no way limit any person's right to rely on information
to the extent provided in § 18-406 of the Delaware Act.
(d) Limitation of Liability. This Agreement is not intended to, and does not, create or
impose any fiduciary duty on any Covered Person. Furthermore, each of the Members and the Company
hereby waives any and all fiduciary duties that, absent such waiver, may be implied by applicable law,
and in doing so, acknowledges and agrees that the duties and obligation of each Covered Person to each
other and to the Company are only as expressly set forth in this Agreement. The provisions of this
Agreement, to the extent that they restrict the duties and liabilities of a Covered Person otherwise existing
at law or in equity, are agreed by the Members to replace such other duties and liabilities of such Covered
Person.
(e) Indemnification. To the fullest extent permitted by the Act, as the same now
exists or may hereafter be amended, substituted or replaced (but, in the case of any such amendment,
substitution or replacement, only to the extent that such amendment, substitution or replacement permits
the Company to provide broader indemnification rights than the Act permitted the Company to provide
prior to such amendment, substitution or replacement), the Company shall indemnify, hold harmless,
defend, pay and reimburse any Covered Person against any and all losses, claims, damages, judgments,
fines or liabilities, including reasonable legal fees or other expenses incurred in investigating or defending
against such losses, claims, damages, judgments, fines or liabilities, and any amounts expended in
settlement of any claims (collectively, "Losses") to which such Covered Person may become subject by
reason of:
(i) any act or omission or alleged act or omission performed or omitted to be
performed on behalf of the Company, any Member or any direct or indirect subsidiary of the foregoing in
connection with the business of the Company; or
(ii) such Covered Person being or acting in connection with the business of
the Company as a member, manager, director, Officer, employee or agent of the Company, any Member,
or any of their respective affiliates, or that such Covered Person is or was serving at the request of the
Company as a member, manager, director, Officer, employee or agent of any person including the
Company;
provided, that (x) such Covered Person acted in good faith and in a manner believed by
such Covered Person to be in, or not opposed to, the best interests of the Company and within the scope
of such Covered Person's authority conferred on him or it by the Company and, with respect to any
criminal proceeding, had no reasonable cause to believe his conduct was unlawful, and (y) such Covered
Person's conduct did not constitute fraud, gross negligence, willful misconduct or a material breach or
knowing violation of this Agreement by such Covered Person. In connection with the foregoing, the
termination of any action, suit or proceeding by judgment, order, settlement, conviction, or upon a plea of
nolo contendere or its equivalent, shall not, of itself, create a presumption that the Covered Person did not
act in good faith or, with respect to any criminal proceeding, had reasonable cause to believe that such
Covered Person's conduct was unlawful, or that the Covered Person's conduct constituted fraud, gross
negligence, willful misconduct or a material breach or knowing violation of this Agreement.

(f) Reimbursement. The Company shall promptly reimburse (and/or advance to the
extent reasonably required) each Covered Person for reasonable legal or other expenses (as incurred) of
such Covered Person in connection with investigating, preparing to defend or defending any claim,
lawsuit or other proceeding relating to any Losses for which such Covered Person may be indemnified
pursuant to this Section 6; provided, that if it is finally judicially determined that such Covered Person is
not entitled to the indemnification provided by this Section 6, then such Covered Person shall promptly
reimburse the Company for any reimbursed or advanced expenses.
(g) Entitlement to Indemnity. The indemnification provided by this Section 6 shall
not be deemed exclusive of any other rights to indemnification to which those seeking indemnification
may be entitled under any agreement or otherwise. The provisions of this Section 6 shall continue to
afford protection to each Covered Person regardless of whether such Covered Person remains in the
position or capacity pursuant to which such Covered Person became entitled to indemnification under this
Section 6 and shall inure to the benefit of the executors, administrators, legatees and distributees of such
Covered Person.
7. Term. The tern of the Company shall be perpetual unless the Company is dissolved and
terminated in accordance with Section 11.
8. initial Capital Contribution. The Member hereby agrees to contribute to the Company
such cash, property or services as determined by the Member.
9. , Tax Status; Income and Deductions.
(a) Tax Status. As long as the Company has only one member, it is the intention of
the Company and the Member that the Company be treated as a disregarded entity for federal and all
relevant state tax purposes and neither the Company nor the Member shall take any action or make any
election which is inconsistent with such tax treatment. All provisions of this Agreement are to be
construed so as to preserve the Company's tax status as a disregarded entity.
(b) Income and Deductions. All items of income, gain, loss, deduction and credit of
the Company (including, without limitation, items not subject to federal or state income tax) shall be
treated for federal and all relevant state income tax purposes as items of income, gain, loss, deduction and
credit of the Member.
10. Distributions. Distributions shall be made to the Member at the times and in the amounts
determined by the Member.
11. Dissolution_ Liquidation.
(a) The Company shall dissolve, and its affairs shall be wound up upon the first to
occur of the following: (i) the written consent of the Member or (ii) any other event or circumstance
giving rise to the dissolution of the Company under Section 18-801 of the Act, unless the Company's
existence is continued pursuant to the Act.
(b) Upon dissolution of the Company, the Company shall immediately commence to
wind up its affairs and the Member shall promptly liquidate the business of the Company. During the
period of the winding up of the affairs of the Company, the rights and obligations of the Member under
this Agreement shall continue.

(c) In the event of dissolution, the Company shall conduct only such activities as are
necessary to wind up its affairs (including the sale of the assets of the Company in an orderly manner),
and the assets of the Company shall be applied as follows: (i) first, to creditors, to the extent otherwise
permitted by law, in satisfaction of liabilities of the Company (whether by payment or the making of
reasonable provision for payment thereof); and (ii) thereafter, to the Member.
(d) Upon the completion of the winding up of the Company, the Member shall file a
Certificate of Dissolution in accordance with the Act.
12. Miscellaneous.
(a) Amendments. Amendments to this Agreement may be made only with the
consent of the Member.
(b) Governing Law. This Agreement shall be governed by and construed in
accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict
of law provision or rule (whether of the State of Delaware or any other jurisdiction).
(c) Severability. In the event that any provision of this Agreement shall be declared
to be invalid, illegal or unenforceable, such provision shall survive to the extent it is not so declared, and
the validity, legality and enforceability of the other provisions hereof shall not in any way be affected or
impaired thereby, unless such action would substantially impair the benefits to any party of the remaining
provisions of this Agreement.

While the two access points on CR 76 do not meet Weld County Code they have been in existence for some
time. Without these two access points, many lots would be landlocked. Development Review would prefer to see the
two accesses condensed into one, however based on ownership questions of the eastern access parcel, land constraints
such as trees in the center of the two and no known accident history, Development Review would accept existing.
County Road 76 is a paved road and is designated on the Weld County Functional Classification Map (Code Ordinance
2017-01) as a local road. Latest ADT on CR 76 counted 186 vpd with 11% trucks. The 85th percentile speed is 55 mph.

Approved with Conditions
The Weld County Department of Planning Services has determined through an administrative review that the
standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is approved
with the following conditions in accordance with information submitted in the application and the policies of
Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Individual Sewage Disposal System (I.S.D.S.) regulations.

A. The plat shall be titled: Recorded Exemption No. RE 4163.
B. The applicant shall submit evidence that the Weld County Department of Public Health and
Environment has approved this application along with any conditions required. Evidence of
approval shall be submitted to the Department of Planning Services.
C. Lot A shall use the existing residential access point as no additional accesses shall be granted.
D. Lot B shall use the existing agricultural / oil and gas / ditch road access points necessary for
agricultural operations as no additional accesses shall be granted.
E. All approved accesses shall be clearly shown on the plat. The applicant shall contact the Weld
County Department of Public Works to determine if a culvert is necessary at any approved road
access point. If a drainage culvert is required, a 15 inch Corrugated Metal Pipe (CMP) is Weld
County's minimum size. If the applicant chooses to place a larger culvert please contact the
Weld County Department of Public Works to adequately size the culvert.
F. County Roads 39 and 76 are designated on the Weld County Road Classification Plan as local
paved roads, which requirfeet of right-of-way at full build out. A total of 30 feet from the
centerline of County Roads 39 and 76 shall be delineated right-of-way on the plat. These roads
are maintained by Weld County.
G. The Greeley Soil Conservation District has provided information regarding the soils on the site.
The applicant shall review the information and use it to positively manage on site soils.
All vehicles located on the property must be operational with current license plates, or be
screened from all adjacent properties and public rights of way, or be removed from the property.
All other items considered to be part of a noncommercial junkyard must also be removed from
the property or screened from adjacent properties and public rights -of -way.
Lot A shall comply with the two and one-half (2' h) acre net minimum lot size required by Section
24-8-40.L of the Weld County Code.
The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
K. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.
2) No building or structure as defined and limited to those occupancies fisted as Groups A,
B, E, F, H, I, M and R in Section 302.1 of the 2003 International Building Code, shall be
constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any
wellhead. Any construction within a 200 -foot radius of any tank battery or 150 -foot radius
of any wellhead shall require a variance from the terms of the Section 23-3-10 of the Weld
County Code.

3) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
4) Lot A is not eligible fora future land exemption in accordance with Section 24-8-20.C.1
of the Weld County Code.
5) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
6) Prior to the release of building permits, the applicant shall submit evidence to the
Department of Planning Services that Lot B has an adequate water supply of sufficient
quality, quantity and dependability.
7) Prior to the release of building permits for any structure exceeding 3,600 square feet, the
applicant must comply with the requirements of Appendix III -A of the International Fire
Code.
8) Should noxious weeds exist on the property or become established as a result of the
proposed development the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Chapter 15, Articles I and II of the Weld County Code.
9) Effective January 1, 2003, Building Permits issued on the proposed lots will be required
to adhere to the fee structure of the County Road Impact Program. (Ordinance 2002-11)
10) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the. most productive
agricultural counties in the United States, ranking fifth in total market value of agricultural
products sold. The rural areas of Weld County may be open and spacious, but they are
intensively used for agriculture. Persons moving into a rural area must recognize and
accept there are drawbacks, including conflicts with longstanding agricultural practices
and a lower level of services than in town. Along with the drawbacks come the incentives
which attract urban dwellers to relocate to rural area: open views, spaciousness, wildlife,
Tack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County would
quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area. Well
run agricultural activities will generate off -site impacts, including noise from tractors and
equipment; slow -moving farm vehicles on rural roads; dust from animal pens, field work,
harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from
ditch buming; flies and mosquitoes; and the use of pesticides and fertilizers in the fields,
including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out
of the way of residential development without threatening the efficient delivery of irrigation
to fields which is essential to farm production.
Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to
be a public or private nuisance if the agricultural operation alleged to be a nuisance
employs methods or practices that are commonly or reasonably associated with
agricultural production.

Weld County covers a land area of over 4,000 square miles in size (twice the State of
Delaware) with more than 3,700 miles of state and County roads outside of municipalities.
The sheer magnitude of the area to be served stretches available resources. Law
enforcement is based on responses to complaints more than on patrols of the county and
the distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who
must leave their jobs and families to respond to emergencies. County gravel roads, no
matter how often they are bladed, will not provide the same kind of surface expected from
a paved road. Snow removal priorities mean that roads from subdivisions to arterials may
not be cleared for several days after a major snowstorm. Snow removal from roads within
subdivisions are of the lowest priority for public works or may be the private responsibility
of the homeowners. Services in rural areas, in many cases, will not be equivalent to
municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban
dwellers.
Children are exposed to different hazards in the county than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines,
territorial farm dogs, and livestock present real threats to children. Controlling children's
activities is important, not only for their safety, but also for the protection of the farmer's
livelihood. Parents are responsible for their children.
3. The applicant shall submit two (2) paper copies of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar
plat along with all other documentation required as conditions of approval. The Mylar plat shall be
recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff.
The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County
Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the
date the Administrative Review was signed. The applicant shall be responsible for paying the recording
fee.
4. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS
formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The
preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent
to maps@co.weld.co.us.
5. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not be
recorded within the required sixty (60) days from the date the Administrative Review was signed a $50.00
recording continuance charge shall be added for each additional 3 month period. (Department of
Planning Services)
6. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application is
based on satisfying the Conditions of Approval. Should an applicant be unwilling or unable to meet any
one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County
Board of County Commissioners with a staff recommendation for denial.
