ARCHIVE BOX MISSING AS OF 12/ 19/2017 RESOLUTION WHEREAS, a public hearing was held on August 9, 1971, in the chambers of the Board of County Commissioners of Weld County, Colorado, for the purpose of hearing the petition of John P. Kimmel, 9470 Green Court, Westminster, Colorado, requesting approval of site for a dog kennel operation on the fallowing described property, -to-wit: The West 330' of-the South Half of the South Half (S}5 ) of the NW a of Section Twenty-three (23), Town-ship -Two (2) North, Range Sixty--seven (67) West of the 6th P. M. , Weld County, Color-ado, containing 5 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was some opposition to the request of petitioner for the location of a dog kennel operation, and WHEREAS, the said requested location-for a. dog kennel operation is located in an agricultural zone as set_forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) of the Zoning Resolution of Weld County, said dog kennel operation may be authorized on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and -statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, T-HEREFORE, BE IT RESOLVED, by-the Board of County Commissioners, thattheapplication of John P. Kimmel, 9470 Green Court, Westminster, Colorado, to locate a dog kennel operation on the premises indicated above be, and it hereby is granted under-the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That said dog kennel operation shall not contain more than 25 dogs at any one time. 3. That petitioner shall proceed with due diligence to effect -said dog kennel operation and that he shall have until December25 , 1971 to complete the construction of any and all facilities therefore, otherwise, the Board may, for good cause shown, on its own motion, revoke-the permit herein granted. 4. At the hearing on August 9, 197$, we understood that they were to have construction well under way at this time or dispose of dogs. To date nothing has been done in either construction, disposal or control of the all night howling and barking. We have patiently tolerated sleeping with windows closed to cut down on the noise from dogs and have also put up with the fear of dogs running loose and biting our children. We would appreciate that your decision on the going ahead with plans will be negative. The continued disturbances and no effort in controling the situa- tion by the owners will definitely devalue our property and may even prevent the sale of such. It should be approved subject to removal of the manure as required by the Health Department , and construction within one year of approval by the County Commissioners . Mr . Chichester stated the economic life of the building is approximately 10 years , however he would clean it any time he had any problem with disease and between flocks . Mr . Paul asked that when the manure is removed from the building that it be hauled away. Mrs . Sandra Davison stated she is a neighbor and has no objections to the chicken houses but when Mr . Chichester removes the manure from the build- ing he leaves it on the ground , As long as it remains there , there is no oder but when it is hauled away it is unbearable . She felt there should be some kind of guarantee that it be hauled away when the chicken house is cleaned . Mr . Bowles stated the matter would be taken under advisement as a quorum was not present. This will be a liquid terminal and booster site . Mr . Smith presented drawings of the system. and explained the process . Mr . Paul questioned if the facility would cause any air pollution . Mr. Smith stated the extent of their air pollution would be the exhaust off of a gas fired compressor . Mr . Mr. Lorenson stated the Utility Coordinating Board has reviewed their pipelines and they have their permits for road cuts from the County Engineer . SUBJECT : Building Permit DISCUSSION : Mr . Lorenson read a letter from Barney Elgin , building inspector. The letter informed the applicant his dwelling will be in the Flood Plain zone. There are no regulations restricting a building permit if the applicant elects to build in this location . SUBJECT: Modular housing DISCUSSION : Mr. Lorenson stated a bill on modular housing has recently been passed in the last session of the legislature. 6/22/71 556 The bill states that manufactured or modular housing will be certified statewide . This will meet whatever codes or standards that are set up in any county or residential zone that will allow this . Committee is supposed to be set up by July 1st. It will be made up of thirteen people that are from the building industry and from the enforcement area . SUBJECT : Letter from Windsor DISCUSSION : Mr . Lorenson stated a letter had been received from Windsor regarding "Powderhorn " a proposed new town west of there . They indicated some of their growth they are expecting . They are concerned that Federal funding that may be made avail - able for this purpose and felt that it could be put to better use in existing communities , especially Windsor , where the greatest impact would occur. Also quoted other communities in the County. It was suggested the Regional Planning Com- mission look into the matter. SUBJECT: Enivronmental Problems DISCUSSION: Mr. Lorenson read a letter from the coordinator of Environmental Problems out of the Governor ' s office regarding a detailed statement prepared by the regulatory staff of the Atomic Energy Commission . They are requesting comments on the Public Service Company ' s environmental impact report, filed with the Atomic Energy Commission . SUBJECT : Policy Board of the Regional Planning Commission DISCUSSION : Mr . Anderson stated that Larimer County and Weld County agreed that elected officials would comprise the Policy Board of the Regional Planning Commission . They will operate the same as the Planning Commissions of the two counties . The Advisory Board will be comprised of the Planning Commission members of the two counties .
