HomeMy WebLinkAbout20222249.tiffHEARING CERTIFICATION DOCKET NO. 2022-68.A RE: PROBABLE CAUSE HEARING, PCSC22-0003, TO CONSIDER SETTING A SHOW CAUSE HEARING TO DETERMINE WHETHER OR NOT THE PERMITTEE IS IN COMPLIANCE WITH CERTAIN PERMIT CONDITIONS, FOR ZONING PERMIT FOR A HOME OCCUPATION CLASS II, ZPHB16-0015 - SANTOS VEGA AND LUZ YADIRA VEGA A public hearing was conducted on August 8, 2022, at 9:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine — EXCUSED Also present: Acting Clerk to the Board, Jess Reid County Attorney, Bruce Barker Planning Services Department representative, Michael Hall The following business was transacted: A public Probable Cause hearing, PCSC22-0003, was conducted to consider setting a Show Cause Hearing to determine whether or not the permittees, Santos Vega and Luz Yadira Vega, are in compliance with certain Permit Conditions contained in Zoning Permit for a Home Occupation Class II, ZPHB16-0015. Bruce Barker, County Attorney, made this a matter of record. gni Michael Hall, Department of Planning Services, stated the site is permitted for a home office for JYJ Construction Services, LLC, being a construction/trucking company, and relayed, per an anonymous complaint submitted to the Department of Planning Services in December 2021, there are numerous commercial vehicles parked onsite, as well as the outdoor storage of construction equipment. Mr. Hall conducted several site visits and determined the site did not appear to be compliance with Permit Conditions #A.8 (On parcels of land less than eighty (80) acres, the number of commercial vehicles is limited to two (2) such vehicles with two (2) rear axles) and #A.9 (No exterior storage of materials, goods, supplies or equipment related to the business is permitted). He displayed images from his site visits, outlined the violation timeline and indicated the property owners failed to respond to the violation notifications, which were sent via regular and certified mail and the certified letters were returned to the Department of Planning Services as "unclaimed." He stated he has recently been in verbal communication with Mr. Vega and a pre - application meeting is scheduled for tomorrow to discuss options to either bring the property into compliance or submit Change of Zone (COZ) and Site Plan Review (SPR) applications, to permit the trucking business. He stated Planning Services staff recommends scheduling a Show Cause hearing in October to monitor where Mr. Vega is in the process of correcting the violation and mentioned the County Attorney's Office and the Weld County Department of Planning Services — Code Compliance Division are advancing paired violations forward to the County Court for case number ZCV21-00368, for violations of an unscreened, non-commercial junkyard and unpermitted commercial vehicles, tires, box trucks, concrete/stone, portable toilets and other cc: P`CM/NN/HO,CA(86) 9 /ZCS/22 2022-2249 PL2539 HEARING CERTIFICATION - SANTOS VEGA AND LUZ YADIRA VEGA (PCSC22-0003) PAGE 2 miscellaneous commercial debris. Per the terms of the pending Motion, Stipulation and Order, compliance must be demonstrated by October 21, 2022, and, as such, he recommended the Show Cause hearing be scheduled after October 24, 2022, or October 26, 2022. Santo Vega, property owner, stated he uses the property to change the oil of the commercial trucks, as the businesses he previously used for this service have closed. Mr. Hall explained why Mr. Vega will need to pursue a COZ, opposed to a Use by Special Review permit and in response to Commissioner Moreno, Mr. Hall outlined the anticipated timeline for the COZ and SPR process. In the matter of Probable Cause hearing, PCSC22-0003, Commissioner Freeman moved to find there is adequate evidence to set a Show Cause hearing, for October 26, 2022, at 9:00 a.m., for Zoning Permit for a Home Occupation Class II, ZPHB16-0015, held by Santos Vega and Luz Yadira Vega, based on the evidence presented by Planning staff. The motion was seconded by Commissioner Buck, and it carried unanimously. There being no further discussion, the hearing was completed at 9:41 a.m. This Certification was approved on the 22nd day of August, 2022.
