Elevated Excavating owns the property east of this site under their holding company EE Colorado LLC. Elevated Excavating wishes to occupy 10-20 acres of the site to fit their continued growth needs. 2. Describe the current and previous use of the land. Response: The land is currently vacant farmland, and historically has been agricultural. 3. Describe the proximity of the proposed use to residences. Response: City of Fort Lupton residential area lies approximately 1.6 miles to the East The Town of Dacono lies 3.5 miles to the West 4. Explain how the proposed rezoning will correct what the applicant perceives as faulty zoning, or how the proposed rezoning will fit with what the applicant perceives as the changing conditions in the area. Response: The property is within Weld County's opportunity zoning (from Ag to C-3) would make it so the property in question would match the zoning of the property across County Road 23 to the East that Elevated Excavating currently operates on. The current agricultural zoning would not allow for Elevated Excavating 10 fully operate on the site. The proximity and visibility to hwy 52 makes this property location ideal for commercial businesses. 5. The covenants and easements granted herein shall burden, attach to and run with the Historically Irrigated Land, and shall be binding not only upon Grantors, but also upon their heirs, successors and assigns and any other persons or entities which may acquire an ownership or leasehold interest in all or any portion of the Historically Irrigated Land. The terms and provisions of these grants shall not expire and shall be perpetual unless specifically released in writing by Grantee or its successors and assigns. The covenants may be enforced by Grantee or by any party having any right, title or interest in the Subject Water Rights or by the State Engineer of the State of Colorado, at any time in any action at law or in equity. 4. Grantors shall be entitled to use the Historically Irrigated Land for any purposes not inconsistent with this Dry -Up Covenant and Non -Exclusive Easement In Gross, including, but not limited to: a] the mining and removal of sand, gravel and other minerals; 2] recreational, residential, commercial, and industrial purposes the water demands of which are supplied by a public treated water supplier; and, 3] dry -land (i.e., non -irrigated) farming of grains or other grasses provided that the root depths of such grains and grasses are shallow enough that they do not interfere with Grantee's dry -up obligations and/or Grantee's ability to transfer the historical consumptive use of the Subject Water Rights to uses other than agricultural irrigation. 5. Grantors warrant that no other person or entity has any ownership or encumbrance interest in the Historically Irrigated Land that will interfere with the effectiveness of the Dry -Up Covenant and/or Non -Exclusive Easement In Gross granted hereby. 6.
