HomeMy WebLinkAbout20222181.tiffRESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR CRISIS ASSESSMENT PROTOCOL AND AUTHORIZE CHAIR TO SIGN - NORTH RANGE BEHAVIORAL HEALTH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for Crisis Assessment Protocol between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, and North Range Behavioral Health, commencing upon full execution of signatures, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Crisis Assessment Protocol between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Sheriff's Office, and North Range Behavioral Health, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said memorandum of understanding. James, Chair Mil -Freeman, Pro -T Lori Saine cc: So(sKisD) /I /22 2022-2181 SO0043 Conehtka BOARD OF COUNTY COMMISSIONERS PASS -AROUND REVIEW PASS -AROUND TITLE 2022-2023 Memorandum of Understanding for Crisis Assessment Protocol between Weld County and North Range Behavioral Health DEPARTMENT: Weld County Sheriff's Office DATE: 6/1/2022 PERSON REQUESTING: Stephanie Dandurand, Director of Inmate Services, Weld County Sheriff's Office - Detentions Brief description of the problem/issue: The Memorandum of Understanding referenced above between Weld County and North Behavioral Health (NRBH) was initially executed in July of 2016 with a term of one year with four (4) extensions (2017, 2018, 2019, 2020) and the current extension is nearing expiration. The current Agreement is a new agreement for FY23 from July 18th, 2022 — July 17th, 2023 to continue with the same services of the previous years. This Agreement has provided a valuable service to the County and should be considered. It should be of note that this contract has been reviewed and approved by Karin McDougal. What options exist for the Board? (include consequences, impacts, costs, etc. of options): The Board may approve or deny this renewal request. A denial of this renewal request would eliminate the NO COST service NRBH has been providing to complete mental health evaluations and subsequent treatment determinations for community members being released from the Weld County Jail after normal county business hours. Eliminating this service would place the responsibility of completing these evaluations back on Detentions Deputies, pulling them away from their duty of maintaining safety and security in the jail. It should be noted that since the inception of the original agreement (July 2016), the Weld County Sheriffs Office has called on NRBH to complete 1646 evaluations of this nature. This was 1646 evaluations that Detentions Deputies would have had to otherwise complete. Instead, NRBH responded to the jail with professional mental health staff to evaluate and provide for the mental health needs of these community members. NRBH has completed 228 evaluations of this nature in the past year for July 2021 — May 2022. An approval of this renewal request would continue this no cost service which has proven to be an asset to the Weld County Sheriff s Office and the citizens of Weld County. **Please note this has been reviewed by Weld County Attorney office. Thank you, Sonja Kohlgraf, MBA Budget Manager Weld County Sheriffs Office Ph: 970-400-2872 1 MEMORANDUM OF UNDERSTANDING FOR CRISIS ASSESSMENT PROTOCOL BETWEEN WELD COUNTY AND NORTH RANGE BEHAVIORAL HEALTH +h THIS AGREEMENT is made and entered into this 97 day of July, 2022 by and between Weld County, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff, whose address is PO BOX 758, 1950 "O" Street, Greeley, CO 80631 hereinafter referred to as "WCSO" and North Range Behavioral Health, hereinafter referred to as "NRBH". RECITALS WHEREAS, WCSO and NRBH are partners in ensuring community members being released from the Weld County Jail have access to the most appropriate level of care/treatment for their mental health needs. At times, this may necessitate close consultation and collaboration between WCSO staff and NRBH's Crisis Response Team ("CRT") staff to meet this goal and provide appropriate opportunities for care for recently incarcerated community members. WHEREAS, the parties have the authority to enter into agreements for the protection and preservation of the public health and as may be necessary for the acquisition of equipment, for the provision of services, and for the operation of emergency services, pursuant to C.R.S section 29-11- 102(l)(a). WHEREAS, Weld County and North Range Behavioral Health are authorized to enter into this Agreement pursuant to § 29-1-203, CRS Article II, § 2-3 of the Weld County Home Rule Charter. NOW, THEREFORE, in consideration of the following mutual agreements and covenants. WCSO and NRBH hereby agree as the following: 1. Agreement: The terms of this Agreement are outlined below. This Agreement and any addenda and exhibits attached hereto or to be attached hereto, set forth of all of the covenants, promises, agreements and conditions between WCSO and NRBH and there are no other covenants, promises, agreements, or conditions, either oral or written, between them related to the subject covered by this Agreement. 2. Protocol: If the Weld County Sheriffs Office mental health staff are not present or available to perform necessary mental health/substance use assessments, WCSO Certified Peace Officers may contact CRT for support (970-347-2120 and follow the prompts). a. CRT Mobile Response CRT staff will respond to the jail (with NRBH employee and government issued ID) within one hour of the initial call to complete the assessment. b. WCSO will provide CRT staff with a private and secure place to complete the necessary assessment. °Zoo? c. CRT staff will complete the assessment and may make accommodations which may include but are not limited to: i. Placement of the person on a Ml. If the responding CRT clinician is not licensed, CRT may request for a Certified Peace Office to sign the M1 document after collaboration. ii. Placement of person on an Emergency Commitment if concerns are substance abuse related. iii. Coordination and placement in inpatient level care to include placement at the ATU. iv. Coordination and placement in NRBH's respite unit. v. Thorough safety planning for the person with support to return home including potential CRT follow-up or referral for outpatient treatment. d. In cases where placement in another facility is recommended, CRT will utilize NRBH's transportation system. e. CRT will share the overall recommendations and dispositions of the assessments with WCSO staff. f Consultation: CRT staff may provide verbal consultation with WCSO staff if they need a second opinion or would like recommendations for potential placement/resource acquisition. 3. Compensation: This Agreement does not involve an exchange of funds. 4. Terms: This Agreement becomes effective upon full execution of the Agreement by the parties. This Agreement shall continue for a one (1) year period. Upon the end of the one (1) year period, the parties may elect to renew the contract on an annual basis upon the same or similar nature. 5. Termination: Each party has the right to terminate this Agreement, with or without cause, upon ninety (90) days written notice to the other party. 6. Non -Exclusive Agreement: This Agreement is nonexclusive and the County may engage or use other contractors or persons to perform services of the same or similar nature. 7. Assignment: Neither party may assign or transfer this Agreement or any interest therein or claim thereunder, without the prior written approval of the other. 8. Compliance with Laws: WCSO and NRBH agree to comply with the applicable provisions of all federal, state, or local laws or ordinances and all lawful orders, rules, and regulations issued thereunder, and any provisions, representations or agreements, or contractual clauses required thereby to be included or incorporated by reference or operation of the law in this Agreement. 9. Modification: Any amendments or modifications to this agreement shall be made in writing and signed by all parties. 10. Non -Liability: The parties agree that is no events shall either party be liable due to any stoppage, delay, or any impairment in the protocol pursuant to this Agreement where stoppage, delay, or impairment result from acts of God, fire, war, legal or equitable proceeding, or any other cause which is outside the control of the party. 11. Government Immunity: No portion of this Agreement shall be deemed a waiver, express or implied, of any immunities, rights, benefits, protections, or other provisions which either party, or it's officers, employees or agents, may possess pursuant to the Colorado Government Immunity Act § 24-10-101, et seq., C.R.S., as applicable now or hereafter amended. 12. Choice of Law/Venue/Compliance with Law: Colorado law, and rules and regulations established pursuant thereto, shall be applied in the interpretation, execution, and enforcement of this Agreement. Any provision included or incorporated herein by reference which conflicts with said laws, rules and/or regulations shall be null and void. The proper venue for any action regarding this Agreement shall be in Weld County, Colorado. All parties agree to comply with any applicable federal, state, or local laws, rules, and regulations. 13. Severability: If any section, subsection, paragraph, sentence, clause, or phrase of this Agreement is for any reason held or decided to be invalid or unconstitutional, such a decision shall not affect the validity of the remaining portions. The parties hereto declare that they would have entered into this Agreement and each and every section, subsection, paragraph, sentence, clause, and phrase thereof, irrespective of the fact that any one or more sections, subsections, paragraph, sentences, clauses, or phrases might be declared to be unconstitutional or invalid. 14. Third Party Beneficiary Enforcement: It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under the Agreement shall be an incidental beneficiary only. 15. Fund Availability: Nothing in the Agreement shall be construed to require Weld County to provide funding for any purpose under this Agreement that has not previously been budgeted and adequately appropriated.
