A public hearing was conducted on October 26, 2022, at 10:00 a.m., with the following present: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine Also present: Acting Clerk to the Board, Jess Reid Assistant County Attorney, Karin McDougal Department of Planning Services representative, Maxwell Nader Department of Public Health and Environment representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated September 19, 2022, and duly published September 21, 2022, in the Greeley Tribune, a public hearing was conducted to consider the request of CMH Homes, Inc., for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF22-0002, for four (4) lots with A (Agricultural) Zone District Uses. Karin McDougal, Assistant County Attorney, made this a matter of record. Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal, indicated Planning staff sent letters to nine (9) surrounding property owners (SPOs), and received two (2) letters back, stating no concerns. He relayed Development Review's comments concerning access, traffic associated with the site, drainage and grading. He stated an Improvements and Road Maintenance Agreement was requested, described surrounding zoning and mentioned Condition of Approval (COA) #1.H.16, at the Planning Commission. Mr. Nader entered the favorable recommendation of the Planning Commission into the record as written and displayed images of the site and surrounding views. .. Lauren Light, Department of Public Health and Environment, stated the existing residence is served by an existing domestic well and a septic system, permitted for four (4) bedrooms. She indicated, on Lot 4, the applicant will utilize the well for outdoor water use and purchase a water tap from the Central Weld County Water District for indoor water use and noted the vacant lots will have their own septic systems and water taps. Tracy Johnson, CMH Homes, Inc., represented the applicant, stated she had nothing additional to add, and in response to Chair James, she indicated she had reviewed, and agreed to abide by, the Conditions of Approval, as presented. cc: PL(TPMJ) i' f'5127, 2022-2904 PL2843 HEARING CERTIFICATION - CMH HOMES, INC. (RLDF22-0002) PAGE 2 El No public testimony was offered concerning this matter. The Board discussed the Conditions of Approval, agreed with staff's request to delete COA #1.H.16, as an annual review of the Improvements and Road Maintenance Agreement is not needed, and made no additional changes. Ei Commissioner Moreno moved to approve the request of CMH Homes, Inc., for a Site Specific Development Plan and Rural Land Division Final Plan, RLDF22-0002, for four (4) lots with A (Agricultural) Zone District Uses, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval, as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:35 a.m. This Certification was approved on the 9th day of November, 2022.
