RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO WEDNESDAY, AUGUST 3, 2022 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, August 3, 2022, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Scott K. James, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Perry L. Buck Commissioner Steve Moreno Commissioner Lori Saine - EXCUSED Also present: Assistant County Attorney, Karin McDougal Acting Clerk to the Board, Houstan Aragon Chief Financial Officer, Cheryl Pattelli MINUTES: Commissioner Moreno moved to approve the Minutes of the Board of County Commissioners meeting of July 20, 2022, as printed. Commissioner Buck seconded the motion and it carried unanimously. PUBLIC INPUT: Steve Teets, Greeley resident, announced there is free access to public buses for the month of August, 2022, and encouraged Weld and Larimer Counties to have discussions for a Northern Colorado regional bus system for improved public transit. He also spoke on his concern for homelessness in Greeley getting worse, and the need to find a viable solution for affordable housing. Lastly, Mr. Teets, stated many roundabouts are not pedestrian friendly, and questioned if they have addressed that issue with the new roundabout being constructed at County Roads 35 and 64 (North 35th Avenue and O Street). In response, Chair James referred to Elizabeth Relford, Deputy Director of the Department of Public Works, who confirmed that this roundabout was designed to be pedestrian friendly with sidewalks and lighting for safety. Edwin Grant, Greeley Resident, spoke on various topics including League of Nations, WWII, and the United Nations Charter. He addressed affordable housing for illegal residents, voter fraud with identity theft, listed various taxing districts and large budgets, the difference between justice and revenge, international crimes, and stated the United States can't pay for all international incidents and still be effective domestically. CI Minutes, Wednesday, August 3, 2022 Page 1 2022-2251 BC0016 Troy Whitmore, Vice President of Public Affairs for United Power, introduced Ursula Morgan, Bill Meyer, and Brian Blehm, who presented the Capital Credit Refund Check. He further explained what United Power does and how they accomplish being a non-profit, co-operative electric company, being owned by the users, and reviewed the leadership Board structure comprised of eleven (11) members and overseers. Mr. Whitmore gave a brief overview of the area they serve, and stated last August they energized 100,000 meters and the company is still growing to about 105,000 meters to date. Mr. Blehm, Weld County Community Affairs, explained in 2022, their Board chose to retire $4.5 million dollars to be allocated to the members, as they coined the term the 'co-operative difference.' He further stated this year, in Weld County, they are returning $1,498,080.00, to the 35,436 members, including the Department of Public Works. Mr. Blehm announced today's refund to Weld County is $1,453.18, which is part of a total of more than $33,000.00, to the Weld County offices since 1995. In turn, each Commissioner thanked United Power for their continued service to Weld County. (Clerk's Note: The group gathered for a photo opportunity.) Ei AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda, as printed. Commissioner Moreno seconded the motion and it carried unanimously. WARRANTS: 1) GENERAL WARRANTS - AUGUST 2, 2022: Commissioner Moreno moved to approve the General Warrants, as printed. Commissioner Buck seconded the motion and it carried unanimously. BIDS: 1) APPROVE BID #62200097, TANDEM AXLE TANK TRAILER WITH DUST PALLIATIVE SPRAY SYSTEM (QTY 2) - DEPARTMENT OF PUBLIC WORKS: Christie Peters, Purchasing Department, stated Fleet Services and the Department of Public Works are requesting the approval for this bid be continued to August 17, 2022, to allow for further review by staff. Commissioner Freeman moved to continue said bid to August 17, 2022, at 9:00 a.m., per staff's request. The motion was seconded by Commissioner Buck, and it carried unanimously. _' 2) PRESENT BID #B2200104, INTERMEDIATE DISTRIBUTION FRAME (IDF) AIR CONDITIONING (AC) PROJECT FOR DEPARTMENT OF HUMAN SERVICES AND SOUTHEAST SERVICE CENTER - FACILITIES DEPARTMENT: Ms. Peters stated two (2) bids were received and staff will make a recommendation on August 17, 2022. Commissioner Freeman commented on the large difference between the two amounts, which will need to be considered. El NEW BUSINESS: 1) CONSIDER SIGNATORY AUTHORITY AND DELEGATION OF SIGNATORY AUTHORITY FOR SUBRECIPIENT PERFORMANCE REPORT AND ASSESSMENT, OR RISK ASSESSMENT, SUBJECT TO 2 CFR § 200.415 (A) (2020): Tami Grant, Deputy Director of the Department of Human Services, stated staff is requesting the delegation of signatory authority to Jamie Ulrich, Director of the Department of Human Services, to allow her to submit the subrecipient performance report and assessments, as needed. Commissioner Freeman moved to approve delegation of signatory authority to Jaime Ulrich. The motion was seconded by Commissioner Buck, and it carried unanimously. Minutes, Wednesday, August 3, 2022 Page 2 2022-2251 BC0016 2) CONSIDER CONTRACT ID #6148 INDIVIDUAL PROVIDER CONTRACT FOR PURCHASE OF FOSTER CARE SERVICES IN A FOSTER CARE HOME AND AUTHORIZE CHAIR TO SIGN - TOMMIE TAYLOR: Ms. Grant stated this is new provisional foster care home located in Aurora, Colorado, with a contract term from June 27, 2022, through December 27, 2022. Commissioner Moreno moved to approve said contract and authorize the Chair to sign. Seconded by Commissioner Buck, the motion carried unanimously. 3) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR SELF DEFENSE TRAINING AND AUTHORIZE CHAIR TO SIGN - ELEMENT BRAZILIAN JIU JITSU: Michelle Raimer, Deputy Director of the Department of Human Resources, stated this agreement provides self-defense training courses to Weld County employees with instructors from Element Brazilian Jiu Jitsu. She further stated employees had requested self-defense training during the Active Shooter Training. In response to Commissioner Moreno, Ms. Raimer clarified the cost associated with this training. Commissioner Moreno moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. 4) CONSIDER CONTRACT ID #6163 AGREEMENT FOR INSTALLATION OF STREET LIGHTS FOR CRS 35 (N. 35TH AVE) AND 64 (O ST) INTERSECTION ROUNDABOUT PROJECT, AND AUTHORIZE CHAIR TO SIGN - PUBLIC SERVICE COMPANY OF COLORADO, DBA XCEL ENERGY: Cameron Parrott, Department of Public Works, stated the new roundabout project currently under construction, located at County Roads (CRs) 35 and 64 (North 35th Avenue and O Street), will require the installation of 20 new luminating emission diode (LED) street lights as part of the safety improvements for vehicles and pedestrians. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. 5) CONSIDER RENEWAL APPLICATION FOR A FERMENTED MALT BEVERAGE OFF -PREMISES (COUNTY) LICENSE AND AUTHORIZE CHAIR TO SIGN - 7 -ELEVEN, INC., DBA 7- ELEVEN STORE 39510H: Karin McDougal, Assistant County Attorney, stated this renewal application is for a 7 -Eleven store located at 3914 State Highway (SH) 119, Longmont, Colorado, which has existed since May 2012, and the renewal application has been reviewed and is in order with no concerns from referral agencies. The applicant was not present. Commissioner Moreno moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Buck, and it carried unanimously. PLANNING: 1) CONSIDER PARTIAL VACATION OF FOUR -LOT RECORDED EXEMPTION, RECX20-0088, FOR REMOVAL OF LOT D - DONALD AND JEANETTE MAGNUSON: Maxwell Nader, Department of Planning Services, stated staff received a letter from the applicants on May 27, 2022, requesting the removal of Lot D from Recorded Exemption, RECX20-0088, which will result in an approximate 128 -acre unplatted parcel. He further stated Lots A, B and C are not a part of this request, and all criteria of the Weld County Code have been met. Mr. Nader stated no easements are impacted by this request, and staff recommends approval. Scott Ducommun, of Alles Taylor and Duke, applicants representative, was present for questions. No public testimony was offered concerning this matter. Commissioner Freeman moved to approve said partial vacation, subject to the Condition of Approval. The motion was seconded by Commissioner Buck, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The Resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
